RESOLVED, That it appears that in the matter of
Formal Bid No. 6561, that none of the several bids contained
any proposal for the specified Item, 200 tons of Screenings,
Size 114 x 1 now.urggntly needed for the Workhouse; that
by error the bid of North Western -Hanna Fuel Co. was construed
as incorporating a proposal for said specified Item instead
of the proposed Item, 200 tons Screenings, Size 1�/2 x 28
$10.25 per ton, and the award of contract and contract
purportedly pursuant to said Bid and covering additional items
included such misconstruction; that said Company, upon dis-
covery of said error, has refused to deliver the first speci-
fied Item except for the higher market price of the same,
$10.60 per ton; that the pertinent contract, Comptroller's
No. G 947, dated September 5, 1957, by and between said
Company and the City of Saint Paul, shall be amended by
an appropriate rider executed by said Company, its Surety
and said City, striking therefrom the provisions of the
same for the furnishing by said Company to the City, there-
under, of said first specified Item and proportionately
decreasing the aggregate purchase price thereunder provided
to be paid by the City.
RESOLVED, FURTHER, That by reason of the foregoing
facts, the urgent necessity for the furnishing of said Item,
200 tons Screening, Size 1/4 x 1/q to said City for the Workhouse,
that an emergency has bsen created and now exists wherein
failure to act promptly will work an injury to said,City;
and that to meet said emergency and to provide'against such
injury, the Purchasing Agent, with the written consent of
the h,,Iayor and the Comptroller, hereby is authorized, without
further competitive bids, in the premises, to purchase said
Item from said Company for the current market price of the
same, to-wit: $10,.. 0 per ton.
