Laid over Summary Abatement Assessments: J0902A Properiy clean ups from December 31, 2008 to January 14, 2009; J0903V Towin� abandoned vehicles from private property during December 2008 265 Curtice Street East (J0902A) Referred back by Council on May 6. No one appeared; Ms. Moermond recommended approving the assessment. 2341 Ellis Avenue (J0903� Referred back by Council on May 6. Page 3 Mr. Essling stated orders were issued on November 19, 2008 to remove or repair a gray Honda with expired tabs and also appeared inoperable with a compliance date of December 3. The property was re-inspected on December 3 and was not in compliance. A work arder was sent to the Police Department who removed the vehicle for a total assessment of $393. Laurel Spear, property owner, stated that when the car was removed, she believed someone had stolen it until her neighbor told her that the police had towed it. She admitted that the tabs were expired and the battery was dead; however, she obj ected to the City towing a vehicle from a private property. She said she was told on two separate occasions by impound lot staff that if she signed the title over to the vehicle, she would not be charged any fees. She later received a certified letter from the City indicating that the vehicle was going to be sold at auction. She called the impound lot again to confirm that she would not be charged any fees and was told that she had been misinformed about having to pay fees associated with the towing and storage of the vehicle. She said that she could understand that she may be responsible far the fees; however, she did not want other owners to be misinformed by impound lot employees concerning assessed fees associated with towing a vehicle from private property. Ms. Moermond recommended deleting the assessment and stated that she would send a letter to the Chief regarding this incident and request that he inform his staff what the code was concerning vehicles that were towed from private properties to the impound lot. 569 Humboldt Avenue (J0902A) Referred back by Council on May 6. Mr. Essling stated a letter was sent on 7anuary 7, 2009 to remove snow and/or ice from the public sidewalk with a compliance date of January 10. The property was inspected on 7anuary 14 and was not in compliance. A wark order was sent to the Parks Aeparhnent who did the work on January 15, 2009 for a total assessment of $235. James Plaster, property owner, stated that he had shoveled the walk himself and that the City did not do the work. Ms. Moermond asked to see the video which showed what appeared to be fresh snow which the 09-613 May 19, 2009 Legislative Hearing Minutes City crew shoveled to widen the sidewalk. Page 4 Ms. Moermond told Mr. Plaster that he could have done a better job shoveling; however, since it appeared to be fresh snow, she recommended reducing the assessment from a total of $235 to a total of $50. 1641 Juno Avenue (J0902A) Referred back by Council on May 6. Mr. Essling stated a letter was sent on January 16, 2009 to remove snow and/or ice from the public sidewalk with a compliance date of January 19. The property was inspected on 7anuary 19 and was not in compliance so the inspector issued a summary abatement order on January 20 with a compliance date of January 23. The property was re-inspected on January 26 and was not in compliance. A work order was sent to the Parks Deparlment who did the work on January 27, 2009 for a total assessment of $235. Ms. Moermond asked to see the video which showed a corner lot which the City crew shoveled and put down sand and salt. Aaron Leventhal, property owner, stated that he had surgery on his heel and was in a cast for four months. He said he did his best to remove the snow and chip away at the ice as best he could while maneuvering on one leg. Ms. Moermond told Mr. Leventhal that she believed he should have hired someone to keep his walk clear of snow. She recommended approving the assessment. 43 Kine Street �+ ast (J0902A) Referred back by Council on May 6. Dave Yankovec, property owner appeared. Mr. Essling stated that according to the file, the letter to remove snow and ice was never sent. Ms. Moermond recommended deleting the assessment. 1001 McLean Avenne (J0901A1 Referred back by Council on May 6. No one appeared; Ms. Moermond recommended approving the assessment. 1999 Sheridan Avenue (J0902A) Referred back by Council on May 6. Mr. Essling stated a letter was sent on Januaxy 15, 2009 to remove snow and/or ice from the public sidewalk with a compliance date of January 18. The property was inspected on January 21 and was 09-613 May 19, 2009 Legislative Hearing Minutes Page 5 not in compliance. A work order was sent to the Parks Department who did the work on January 23, 2009 for a total assessment of $235. The orders were mailed to Andrew Mariska and to the occupant at 1999 Sheridan. There was no returned mail. Steve Christopher appeared and stated that Andrew was the property owner and was on a work assignment in Japan for two years. He said that he had lived at the property with Andrew since 2005 and claimed that he never received the notice. He said the only way he found out about this hearing was through Andrew's father, Stan. He did not believe the assessment should be approved since he did not believe proper legal notification had been made. Ms. Moermond asked to see the video which showed the City crew shoveled the walk and put down sand and salt. Ms. Moermond stated that legal notification had been made and she recommended approving the assessment. 560 State Street #A (J0902A) and 560 State Street #B (J0902A) Referred back by Council on May 6. Mr. Essling stated a letter was sent on January 15, 2009 to remove snow and/or ice from the public sidewalk with a compliance date of January 18. The property was inspected on January 23 and was not in compliance. A work order was sent to the Parks Department who did the work on January 26, 2009 for a total assessment of $130. It appeared that only one letter was sent to the occupant of 560 State Street so only one notification would have been received. Shawntera Hardy appeared on behalf of the property owners and stated that she was the board president far their townhouse association. She said that they hired a service to remove snow from their property and if she had known about the letter, she would have contacted their service to do the work. Ms. Moermond asked to see the video which showed the City crew shoveling the walk in front of units A and B.
