1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a one story, wood frame, single family dwelling located on property hereinafter
4 referred to as the "Subject Properiy" and commonly lrnown as 318 VICTORIA STREET
5 NORTH. This property is legally described as follows, to wit:

9 WHEREAS, based upon the records in the Ramsey County Recorder's Office and
10 information obtained by Deparhnent of Safety and Inspections on or before October 20, 2008,
11 the following are the now known interested or responsible parties for the Subject Property:

16 WHEREAS, Department of Safety and Inspections has served in accordance with the
17 provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
18 Abate Nuisance Building(s)" dated January 27, 2009; and

WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by February 26, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
29 WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
30 and Inspections requested that the City Clerk schedule public hearings befare the Legislative
31 Hearing Officer of the City Council and the Saint Paul City Council; and

33 WHEREAS, the interested and responsible parties have been served notice in accordance
34 with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
35 purpose of the public hearings; and

37 WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
38 City Council on Tuesday, May 12, 2009 to hear testimony and evidence, and after receiving
39 testimony and evidence, made the recommendation to approve the request to order the interested

40 or responsible parties to make the Subject Property safe and not dehimental to the public peace,
41 health, safety and welfare and remove its blighting influence on the community by demolishing
42 and removing the structure in accordance with all applicable codes and ordinances. The
43 demolition of the structure to be completed within fifteen (15) days after the date of the Council

WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, June
3, 2009 and the testimony and evidence including the action taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order conceming the Subject Property at 318 VICTORIA STREET NORTH.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then laiown
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition haue not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, VacanUNuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighring influence on the community by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The demolition and removal of the
structure must be completed within fdteen (15) days after the date of the Council
Hearing.
If the above corrective acrion is not completed within this period of time Deparhnent of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and chazge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

T'he Department of Safety and Inspecrions has declared this building(s) to constitute a"nuisance"
as defined by Legislarive Code, Chapter 45. The Department of Safety and Inspections has
issued an order to the then known responsible parties to eliminate this nuisance condiYion by

The property was re-inspected on February 26, 2009. There was no compliance and the
nuisance condition remains unabated, the community continues to sufFer the blighting influence
of this property. It is the recommendation of the Department of Safety and Inspecuons that the

remove this building in a Umely manner, and failing that, anthorize the DepaTtment of Safery and
Inspecrions to proceed to demolition and removal, and to assess the costs incurred against the

The building is a one story, wood frame, single-family dwelling on a lot of 4,792 square feet.
According to our files, it has been a vacant building since Mazch 29, 2008.
The current property owner is Citimortgage, Inc., per AMANDA and Ramsey County property
records.
There has been five (5) Si_JIvIMARY ABATEMENT NOTICES since 2008.
There have been three (3) WORK ORDERS issued for:
- Removal of garbage/rubbish
- Cut tall grass and weeds
- Remove snow and ice
On December 16, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NiJISANCE BUILDING was posted on January 27, 2009 with a compliance date of
February 26, 2009. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid. (Assessedon 8/21/08 and 4/29/09)

Inspections, Division of Code Enforcement, hereby declares the premises located at:

45.02, and subject to demolition under authority of Chapter 45.11.
On December 16, 2008, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspecrion will identify specific defects,
necessary repairs and legai requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.
This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.

ORDER:
Repair the structure to a habitable condrtion.

This structure is a registered vacant building that must have a Code Compliance
Certificate before the structure may be occupied. Obtain a Code Compliance
Certificate from the Departrnent of Safety and Inspections. You may contact Jim
Seeger at D.S.I., 651-266-9016, for a code compliance inspection, pexxnits, and
issuance of the Code Compliance Certificate. Under Chapter 33.03 of he Saint
Paul Legislative Code, failure to obtain a Code Compliance Certificate before
occupying the shucture may result in issuance of criminal suxnmonses.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by February 26, 2009 the Department of Safety
and Inspections, Division of Code Enforcement, wili begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property tases as a special assessment in
accordance with law.

If this building is located in a historic dish or site (noted above, just below the property
address) then you must contact Heritage Preservation (HPC) stafF to discuss your proposal for
the repairs required by this order and compliance with preservation guidelines. Copies of the
guidelines and design review application and forms aze available from tl�e Department of Safety
and Inspections web site (see letterhead) and from the HPC staff. No permits will be issued
without HPC review and approval. HPC staff also can be reached by calling 651-266-9078.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The deparhnent is fiirther required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony wiil be
heazd from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accardance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

Prepare and paint interior and exterior as necessary. Observe necessary abatement
procedure if lead base paint is present (See St. Paul Legislative Code, Chap. 34 for
additional informarion).
Habitable rooms with new usage and replaced windows shall have glass area equal to 8%
of floor area, or a minimum of 8 sq. ft., one-half of which shall operate; and all bedroom
windows shall meet emergency egress requirements (20" minimum width, 24" minimum
height, but not less than 5.7 sq. ft. overall openable area; minimum 5.0 sq. ft. openable
area if sill height is within 44 inches of grade).
Provide smoke detectors per the Minnesota Building Code and carbon monoxide
detectors per State law.
Repair siding, soffit, fascia, trim, etc. as necessary.
Provide weather-sealed, air-sealed, and vermin-sealed exterior.
Provide proper drainage around house to direct water away from foundarion.
Install downspouts and a complete gutter system.
Install rain leaders to direct drainage away from the foundation.

20. Dry out basement and eliminate source of moisture.
21. Remove mold, mildew and moldy or water-damaged materials.

ELECTRICAL
1. Ground the electrical service to the water service with a copper conductor within 5' of the
entrance point of the water service.
2. Provide a complete circuit directory at service panel indicating location and use of all
circuits.
3. Verify that circuit breaker amperage matches wire size.
4. Ground bathroom light in first floor bathroom and rewire light to code.
5. Install globe-rype enclosed light fixture on all closet lights.
6. Repair or replace all broken, missing or loose light fixtures, switches & outlets, covers
and plates.
7. Check all outlets for proper polarity and verify ground on 3-prong outlets.
8. Remove any 3-wire ungrounded outlets and replace with 2-wire or ground 3-wire to code.
9. Throughout building, install outlets and light fixtures as specified in Bulletin 80-1.
10. Install hard-wired, battery backup smoke detectar as specified in Bulletin 80-1 and other
smoke detectors as required by the IRC. Also, Install carbon monoxide detector(s) within
10 feet of all bedrooms.

9. Ordering the owner to remove or repair the building(s) at 318 Victoria Street North within
fifteen (15) days from adoption of resolution.
The property owner of record, Citunortgage, did not appear. Adrianne Hannert appeared and stated
that she lived next door to this property at 857 Carroll Avenue. She said that no one had lived at the
property since 2006 and she and her husband maintained the property shoveling the snow every
winter. She said they had met with a realtar and did a walk-thru of the building as they were
interested in purchasing it as an inveshnent property. Once they saw the interiar of the house, they
determined it needed too much work and were not interested in it. She said that since the property
was a corner lot, if the building were demolished, it would not be good for the neighborhood;
however, she did not believe it should remain a blight on the neighborhood either.
Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a one-
story, wood frame, single-family dwelling on a lot of 4,792 square feet and had been vacant since
March 29, 2008. A code compliance inspection had been done on January 22, 2009, the vacant
building registration fees in the amount of $1,000 went to assessment on August 21, 2008 and on
Apri129, 2009, and the $5,000 performance bond had not been posted. On December 16, 2008, an
inspection of the building was done and a list of deficiencies which constitute a nuisance condition
was developed. An order to abate a nuisance building was posted on January 27, 2009 with a
compliance date of February 26, 2009. To date, the property remained in a condition which
comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the
market value of the land to be approximately $56,400 and the building to be $37,500. Real estate
taa�es were current. Code Enforcement estimates the cost to repair the building to be approximately
$60,000 to $80,000. The cost far demolition was estimated to be approximately $8,500 to $10,500.
There had also been five summary abatements issued to this property since 2008, tl�ree of which
went to work arder: remove garbage/rubbish, cut tall grass and weeds, and remove snow and ice.
Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner
presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was a 1926
cottage which was not on the Sanborn map, was not on a contiguous block and was not in context
with the neighborhood. She did not believe dexnolition would have and adverse effect.
Ms. Moermond recommended the building be removed within 15 days with no option for repair.
