1 WIIEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a two story, wood frame duplex located on property hereinafter referred to as the
4 "Subject Property" and commonly lrnown as 565 VAN BUREN AVENUE. This property is
5 legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or before October 20, 2008,
the following are the now known interested ar responsible parties for the Subject Property:
Mortgage Elec Reg Systems Inc/Co Gmac Mortgage Coxporation, 500 Enterprise Rd, #150, PO
Box 963, Horsham, PA 19044; Rod Amland, Keller Williams Integrity Realty, 8599 Point
Douglas Rd, #100, Cottage Grove, MN 55016; Trinh Nguyen, 2525 Beth Court, Maplewood,
MN 55119; Thomas Dale District 7 Planning Council.
WHEREAS, Department of Safety and Inspections has served in accardance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated January 26, 2009; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested ar responsible parties that they must repair
or demolish the structure located on the Subject Property by February 25, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s} to constitute a nuisance condition; subject to demolition; and
WIIEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, May 12, 2009 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfaze and remove its blighting influence on the community by rehabilitating
this structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, June
3, 2009 and the testimony and evidence including the action taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 565 VAN BUREN AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Aousing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to conect the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Deparhnent of Safety and Inspections has posted a placard on the Subject
Properiy which declares it to be a nuisance condition subj ect to demolition.
That this building has been routinely monitared by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
That the lmown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by rehabilitaring this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the altemative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolirion and removal of the structure must be completed within
r`�2��-.�,�` one hundred-eight (180) days after the date of the Council Aearing.
2. If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authozized to take whatever steps are necessary to
demolish and remove this structure, fill the site and chazge the costs incurred against the
Subj ect Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

remove this building in a fimely manner, and failing that, authorize the Department of Safety and

The building is a two story, wood frame duplex, on a lot of 4,792 square feet.
According to our files, it has been a vacant building since November 9, 2007.
The current property owner is Trinh Nguyen, per AMANDA and Ramsey County property
records.
There have been seven (7) Si.J1VIMARY ABATEMENT NOTICES since 2007.
There have been seven (7) WORK ORDERS issued for:
- Removal of improperly stored refuse, garbage and misc debris
- Removal of tall grass and weeds
Removal of snow and ice
On December 30, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taketi. An ORDER TO
ABATE A NiJISANCE BUILDING was posted on January 26, 2009 with a compliance date of
Februazy 25, 2009. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid. (Assessed 12/19/D8)
Tasation has placed an estimated market value of $20,000 on the land and $61,200 on the
building.
As of March 3, 2009, a Code Compliance inspection has been completed.
As of May 11, 2009, the $5,000.00 performance bond has not been posted.

The Vacant/Nuisance Buildings Unit, Department of the Department of 5afety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:

and legally described as follows, to wit:

to comprise a nuisance condition in violation of the Saint Paul Legislafive Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On December 30, 2008, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Foarth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.

This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a two story, wood frame duplex.
1. Looking through window — there is water damaged ceiling; damaged ceiling
light fixture.
2. The front and rear porches have rot damaged framing and other members.
3. There is a missing dead bolt lock.
4. There are deteriorated, missing, or broken siding.
5. There is a damaged exterior ramp, hand rail and balustrade.
6. There is chipped/peeling paint.
7. One (1) electric meter is yellow tagged off.
8. One (1) gas meter is locked off.
9. There are boarded basement windows.
10. There are damaged storm windows.
11. There is deteriorated foundation; hole in foundation at the south west corner —
cats viewed entering and exiting through this hole.
12. The Certificate of Occupancy for this property was revoked. See notice of
revocarion for deficiency 1ist.
ORDER:
Repair the structure to a habitable condition.
This structure is a registered vacant building that must have a Code Compliance
Cerrificate before the structure may be occupied. Obtain a Code Compliance
Certificate from the Department of Safety and Inspections. You may contact Jim
Seeger at D.S.I., 651-266-9016, for a code compliance inspection, permits, and
issuance of the Code Compliance Certificate. Under Chapter 33.03 of he Saint
Paul Legislative Code, failure to obtain a Code Compliance Certificate before
occupying the structure may result in issuance of criminal summonses.
As owner, agent or responsible party, you are hereby nofified that if these deficiencies and the
resulting nuisance condition is not corrected by February 25, 2009 the Deparhnent of Safety

and Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property tases as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-9090. This
inspecrion will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condition.
If this building is located in a historic district or site (noted above, just below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for
the repairs required by this order and compliance with preservation guidelines. Copies of the
guidelines and design review application and forms are available from the Deparhnent of Safety
and Inspections web site (see letterhead) and from the HPC staff. No permits will be issued
without HPC review and approval. HPC staff also can be reached by calling 651-266-9078.
As an owner ar responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placazd shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The deparhnent is fizrther required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either arder the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified rime, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

The following is the Code Compliance report you requested on February 23, 2009.
Please be advised that this report is accurate and correct as of the date of this letter. All
deficiencies identified by the City after this date must also be corrected and all codes and
ordinances must be complied with. This report is valid for 365 days from this daxe. This report
may be used in lieu of a Truth in Housing Report required in St Paul Legislative Code 189. This
building must be properly secured and the property maintained at ali times.
In order to sell or reoccupy this property the following deficiencies must be corrected:
BUILDING
1. Replace siding.
2. Install front and east side steps to code.
3. Insulate a11 open exterior walls and have inspected before covering.
4. Repair or remove fence.
5. Install concrete floor in cellar.
6. Install vapor barrier in crawl space.
7. Insure cellar stairs have uniform rise and run.
8. Install handrails and guardrails at all stairways, including basement stairways, per
attachment.
9. Strap or support top of stair stringers,
10. Tuck Point interior/exterior of foundation.
1 i. Install floor covering in the bathroom and kitchen that is impervious to water.
12. Maintain one-hour fire-separation between dwelling units and between units and common
areas.
13. Relocate Z floor electrical panel to 2 floor unit or to common area or protect panel
with 1-hour fire- rated enclosure.
14. Tnstall 20-minute fire-rated doors, with self-closing device, between common areas and
individual units.

BUILDING
15. Provide thumb type dead bolts for all entry doors. Remove any surface bolts.
16. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty etc.
as necessary.
17. Provide fire block construction as necessary.
18. Where wall and ceiling covering is removed install full-thickness or code-specified
insulation.
19. Prepare and paint interior and exterior as necessary. Observe necessary abatement
procedure if lead base paint is present (See St. Paul Legislative Code, Chap. 34 for
additional information).
20. Any framing members that do not meet code (where wall and ceiling covering is
removed, members that are over-spanned, over-spaced, not being carried properly, door
and window openings that are not headered, etc.) are to be reconstructed as per code.
21. Provide general clean-up of premise.
22. Provide smoke detectors per the Minnesota Building Code and carbon monoxide
detectors per State law.
23. Provide weather-sealed, air-sealed, and vermin-sealed exterior.
24. Provide proper drainage around house to direct water away from foundation.
25. Repair or replace damaged doocs and frames as necessary, including storm doors.
26. Weather-seal exterior doors.
27. Air-seal and insulate attic access door in an approved manner.
28. Dry out basement and eliminate source of moisture.

Trinh Nguyen, property owner, appeared. Patty Lammers, Greater Frogtown Community
Development Corporation also appeared. Ms. Lammers stated that she needed to do an inspection
of the property and would then put together a financial package towards the rehabilitation of the
property.
Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a two-
story, wood frame, duplex on a lot of 4,792 square feet and had been vacant since November 9,
2007. A code compliance inspection had been done on March 3, 2009, the vacant building
registration fees in the amount of $1,000 went to assessment on December 19, 2008, and the �5,000
performance bond had not been posted. On December 30, 2008, an inspection of the building was
done and a list of deficiencies which consritute a nuisance condition was developed. An order to
abate a nuisance building was posted on January 26, 2009, 2009 with a compliance date of February
25, 2009. To date, the property remained in a condition which comprised a nuisance as defined by
the Legislative Code. Ramsey County Taxation estimated the mazket value of the land to be
approximately $20,000 and the building to be $61,200. Real estate taxes were cunent. Code
Enforcement estimates the cost to repair the building to be approximately $60,000 to $80,000. The
cost far demolition was estimated to be approximately $10,000 fo $12,000. There had also been
seven suuunary abatements issued to this property since 2007, seven of which went to work order:
remove improperly stored refuse and debris, cut tall grass and weeds, and remove snow and ice.
Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner
presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that she could not find the
original permit index card for this property; however, she believed it was built in the 1880s or
1890s. She said the property was located in the potential Frogtown Historic District and was
located next to the historic Van Buren Hotel. She encouraged rehab of the building.
Ms. Nguyen stated that she had purchased the property at auction on November 16, 2008 and the
closing did not occur until January 9, 2009. She said she was not told this was a category 3 vacant
building at the time of the closing.
Mr. Magner stated that the vacant building status changed from a category 2 to category 3 in
January, 2009 so at the time of the purcl�ase agreement, the sale was legal; however, he noted that
there had not been a truth-in-sale-of-housing inspection done on the property.
Ms. Moermond asked Ms. Nguyen whether she planned to live at the property and if so, if anyone
else would be living with her. Ms. Nguyen responded that she was going to live at the property and
her brother was going to move in with her. Ms. Moermond stated that given the lot size, the
building would need to be de-converted from a duplex to a single-family dwelling.
Ms. Moermond recommended continuing the Legislarive Hearing to June 24 and the Council Public
Hearing to July 1.

Trinh ATguyen, property owner, appeazed. Patty Lanuners, Greater Frogtown Community
Development Corporation (Greater Frogtown CDC), appeared after the hearing began.
Mr. Magner stated that at the legislative hearing on May 12, this matter was continued to allow time
for the Greater Frogtown CDC to put together the fmancials for the rehab of the property. The
property is zoned R4 and was a non-conforming use. He believed Ms. Nguyen indicated that her
brotl�er was going to be living with her and the recommendation was to de-convert the building to a
single-family dwelling.
Ms. Nguyen stated that she had posted the performance bond and was awaiting the results of the
lead test inspection before she could proceed.
Ms. Lammers stated that Ms. Nguyen was approved for $80,000 in financing; however, she
believed tYie rehab would cost less. She said they were waiting for the lead test results to come back
before they could proceed to put the work out ta bid; however, she believed the test results should
be back within the next couple of weeks. She said she did not believe they could close on the loan
until the end of July.
Ms. Moermond stated that the following conditions must be met by July 27: 1) a work plan; 2)
contractor bids; 3) loan documentation; and 4) the property must be maintained. She recommended
continuing the Council Public Hearing to August 5.
