This property is legally described as follows, to wit: FAIRVIEW ADDITION LOT 2 BLK 16 WHEREAS, based upon the records in the Ramsey County Recorder's Off ce and information obtained by Deparhnent of Safety and Inspections on or before November 3, 2008, the following are the now lrnown interested or responsible parties for the Subject Property: Benjamin Raymond, 5529 Winding Way, Apt L, Columbus, OH 43220; Ben T Morgan, 5928 Morgan Ave S, Minneapolis, MN 55419; Countrywid Bank, NA, Countrywide Home Loans, 803 Bielenberg Dr, Ste 101, Woodbury, MN 55125; Nina Avila, Countrywide Field Services, 301 E. Vanderbilt Way, Ste 350, San Bernadino, CA 92408; Payne Phalen Disri 5 Planning Council. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 WHEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated January 26, 2009; and WHEREAS, this order informed the then lrnown interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the shucture located on the Subj ect Property by February 25, 2009; and WHEREAS, the enforcement officer has posted a placard on the Subj ect Property declaring this building(s) to constitute a nuisance condition; subj ect to demolition; and WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WIIEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislarive Code, of the time, date, place and purpose of the public hearings; and WI3EREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, May 12 and May 26, 2009 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the 09-606 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 interested or responsible parties to make the Subject Properry safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this sYructure in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within fdteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, June 3, 2009 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 967 EDGERTON STREET. 1. 2. 3. Q Q 7 That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). That the deficiencies causing this nuisance condition have not been corrected. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Deparhnent of Safety and Inspections, Vacant/Nuisance Buildings. The rehabilitarion or demolition and removal of the structure must be completed within fifteen (15) days after the date of the Council Hearing. If the above corrective action is not completed within this period of time Department of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and chazge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. According to our files, it has been a vacant building since December 9, 2008. The current property owner is Benjamin Raymond, per AMANDA and Ramsey County property records. The city has had to boazd this building to secure it from trespass. There have been four (4) SLJMMARY ABATEMENT NOTICES since 2008. There have been four (4) WORK ORDERS issued for: - Removal of improperly stored refuse, garbage and misc debris - Boarding - Removal of snow and ice On December 8, 2008, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on January 26, 2009 with a compliance date of February 25, 2009. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. Taxation has placed an estimated market value of $19,400 on the land and $124,300 on the building. As of May 11, 2009, a Code Compliance inspection has not been completed. Provide proper window and doar screens for all openable windows and doars. Screens must be tight-fitting and securely fastened to the frames. 4. The windows and/or storm windows are in a state of disrepair. Replace all missing or broken window glass. Make all necessary repairs to frames, sashes, hardware and associated trim in a professional manner. Pexxnit may be required. 5. The eaves and soffits are in a state of disrepair or deterioration. Repair a11 defects, holes, breaks, loose or rotting boards, to a professional state of maintenance. Permit may be required. Interior 6. The interior ceilings are defective. Repair all ceiling defects and finish in a professional manner. 7. The interior walls are defective. Repair all wall defects and finish in a professional manner. 8. The stairs have missing or defective handrails. Provide all interior and exterior stairways and steps of more that three (3) risers with handrails which are grippable and installed 34" to 38" above the nose of the stair treads. 9. The bathroom floor covering is deteriorated or inadequate. Provide floor covering which is impervious to water and easily cleanable throughout the bathroom and seal around the edges and fixtures. 10. There is evidence of improper wiring and/or damaged outlets and fixtures. Have a licensed electrical coniractar make all necessary repairs and certify system integrity. 11. FURI3ACE: Have a licensed heating contractar service and clean the furnace or boiler and make any necessary repairs. Perform a GO test on the heating plant. Then, send the attached form back to the Inspector. Repair of gas fired appliances requires a permit. 13. The floorboards on both levels are severely sagging and lacking in support. Repair. 14. There is evidence of improper plumbing and damage to fixtures. Have a licensed plumbing contractor make all necessary repairs and certify system integrity. 15. Smoke Detector: Lack of properly installed and operable smoke detectar. As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by February 25, 2009 the Depariment of Safety and Inspections, Division of Code Enforcement, will begin a substanfial abatement process to demolish and remove the building(s). The costs of this action, including administrative costs and demolition costs will be assessed against the property taaces as a special assessment in accordance with law. As first remedial action, a Code Compliance Inspection Report must be obtained from the Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-9090. This inspection will identify specific defects, necessary repairs and legal requirements to correct this nuisance condition. If this building is located in a historic district or site (noted above, just below the property address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for the repairs required by this order and compliance with preservation guidelines. Copies of the guidelines and design review application and forms are available from the Department of Safety and Inspections web site (see letterhead) and from the HPC staff. No permits will be issued without HPC review and approval. HPC staff also can be reached by calling 651-266-9078. As an owner or responsible party, you are required by law to provide full and complete disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or responsibility for this property, you must within seven ('7) days, notify the Enforcement Officer with the names and addresses of any new owners or responsible parties. The Bnforcement Officer is required by law to post a placard on this property which declares it to be a"nuisance condirion", subject to demolition and removal by the City. This placard shall not be removed without the written authority of the Department of Safety and Inspections, Division of Code Enforcement. The City Clerk will then schedule dates for Public Hearings before the City Council at which time testimony will be heard from interested parties. After this hearing the City Council will adopt a resolution stating what action if any, it deems appropriate. If the resolution calls for abatement action the Council may either order the City to take the abatement action or fix a time within which this nuisance must be abated in accardance with the provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action is not taken within the specified time, the City shall abate this nuisance. The costs of this action, including administrarive costs will be assessed against the property as a special assessment in accordance with law. Caitlin Dowling, attorney with Wilford & Geske, appeazed and stated that she represented Countrywide Bank who was the loan servicer for MERS. She said the sheriff sale was scheduled for June 11, 2009 and her client had ordered the code compliance inspection. She said once the inspection was done, her client would make the determination whether it would go forward to repair the building, in which case they would shorten the redemption period, or whether the house should be demolished. She was requesting mare time for her client to make a determinarion on the property. Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a two- story, wood frame, duplex on a lot of 4,792 square feet and had been vacant since December 9, 2008. A code compliance inspection had not been done, the vacant building registration fees were current, and the $5,000 performance bond had not been posted. On December 8, 2008, an inspection of the building was done and a list of deficiencies which consritute a nuisance condition was developed. An arder to abate a nuisance building was posted on January 26, 2009 with a compliance date of February 25, 2009. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $19,400 and the building to be $124,300. Real estate taates were current. Code Enforcement estimates the cost to repair the building to be approximately $60,000 to $70,000. The cost for demolition was estimated to be approximately $10,000 to $12,OOQ. There had also been four summary abatements issued to this property since 2008, four of which went to work order: to secure the building and the City had to board the building to secure it from trespass, remove improperly stored refuse and debris, boarding, and remove snow and ice. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1889 and was a Victorian-era building. She said the integrity was fair with the windows being intact; the block face was contiguous with a strong rhythin of houses on the block. She said this house was not in any historic district and did not warrant designation on its own_ Ms. Moermond asked about the status of the building being a duplex. Ms. Spong responded that she would need to look at the permit card to determine whether it was built as a single-family or duplex. Ms. Moermond stated that given the size of the lot, the building would need to be de- converted to a single-family home unless it was originally built as a duplex. Mr. Manger stated that the zoning was listed as Ra which was single family and in order to be able to rehab the building as a duplex, it would be necessary to file an appeal to the Board of Zoning Appeals for a determination. The property was in foreclosure and the sale was set for June 11. The code compliance inspection had not been done yet as they did not have keys to the pmperty which they now had. He asked Ms. Moermond to continue the hearirtg to 7une 9 so that they would be able to complete the code compliance inspection and make a determination on what they wanted to do with the property. Ms. Spong etated that they were unable to get into the archive room at the Ramsey County Historical Society as they locks had been changed and they did not have a key. Mr. Magner stated that this matter was laid over from the May 26 Legislative Hearing in order for Mr. Geske to apply for the code compliance and so his client could decide what they wanted to do with the property. To date, a code compliance inspection has not been applied for. Ms. Moermond stated that she had not heard from Wilford & Geske as to their client's intention. Therefare, she recommended the building be removed or repair within 1 S days.
