WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order idenrified as an"Order to Abate Nuisance Building(s)" dated January 27, 2009; and WHEREAS, this arder informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested ar responsible parties that they must repair or demolish the structure located on the Subject Property by February 26, 2009; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested thaf the Cify Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, May 12, 2009 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested 09-605 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 or responsible parties to make the Subject Property safe and not detrimental to the public peace, health, safety and welfaze and remove its blighting influence on the community by demolishing and removing the shucture in accordance with all applicable codes and ordinances. The demolition of the structure to be completed within fifteen (1� days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, June 3, 2009 and the tesrimony and evidence including the acrion taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 886 DUCHESS STREET. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown responsible parties to correct the deficiencies or to demolish and remove the building(s). � 7 That the deficiencies causing this nuisance condition have not been corrected. That Deparhnent of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buildings. That the lmown interested parties and owners are as previously stated in this resolution and that tl�e notification requirements of Chapter 45 have been fulfilled. �•� ' The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its �q - t� i, 85 86 87 88 89 90 2. 91 92 93 94 95 96 3. 97 98 99 100 101 102 4. 103 blightin� influence on the community by demolishing and removing the structure in accordance with all applicable codes and ordinances. If the above correcrive action is not completed within this period of time Deparhnent of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. According to our files, it has been a vacant building since September 5, 2008. The current property owner is Federal National Mortgage Assn., per AMt1NDA and Ramsey County properiy records. The city has had to board this building to secure it from trespass. There have been four (4) S[ JMMARY ABATEMENT NOTICES since 2008. There have been four (4) WORK ORDERS issued for: - Removal of improperly stored refuse, garbage and misc debris - Boarding - Removal of snow and ice On December 16, 2008, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on January 27, 2009 with a compliance date of February 26, 2009. Provide floor covering which is impervious to water and easily cleanable throughout the bathroom and seal around the edges and fixtures. 2. Lack of Electricity. Immediately restore electrical service. Failure to provide proper electrical service will result in these premises being declazed Unfit for Human Habitation and ordered vacated for lack of this basic facility. Use of candles, fuel operated lighting or extension cord wiring is not permitted while the power is off. 3. FURNACE: Have a licensed heating contractor service and clean the fiunace or boiler and make any necessary repairs. Perform a C/O test on the heating plant. Then, send the attached form back to the Inspector. Repair of gas fired appliances requires a permit. 4. G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Permit May Be Required. 5. Lack of Natural Gas Service. Immediately restore natural gas service. Failure to provide natural gas service will result in these premises being declared Unfit for Human Habitation and ordered vacated for lack of this basic facility. 6. The interior ceilings are defective. Repair all ceiling defects and finish in a professional manner. 7. The interior walls are defective. Repair all wall defects and finish in a professional manner. 8. There is evidence of a rodent infestation. Immediately exterminate and eliminate all rodents from the entire building. Remove rodent harborages in the yard areas. Tuckpoint the foundation if necessary to rodent-proof the building to prevent re-infestation. Immediately remove any dead rodents from the premises. 9. SANITATION: Immediately remove improperly stored or accumulated refuse including; garbage, rubbish, junk, vehicle parts, wood, metal, recycling January 27, 2009 886 DUCHESS ST page 3 1' �I� materials, household items, building materials, rubble, tires, etc., from yard. The Saint Paul I.egislative Code requires all exterior property areas to be maintained in a clean and sanitary condition. Usable matezials must be stored in an approved manner, so as not to constitute a nuisance. 10. Smoke Detector: Lack of properly installed and operable smoke detector. Provide functioning smoke detectors in accordance with the attached requirement, within 24 hours. I1. Lack of Water Service. Immediately restore water service. Failure to provide water service will result in these premises being declared Unfit for Human Habitation and ordered vacated for lack of this basic facility. 12. Lacking window locks. Provide operable window locks for all windows except third floor and above. Exterior 13. The chimney is defective, deteriorated or in a state of disrepair. Replace all missing or defective bricks, tuckpoint as needed to restore the chimney to a professional state of maintenance and repair. Permit may be required. 14. The eaves and soffits are in a state of disxepair or deteriorarion. Repair all defects, holes, breaks, loose or rotting boards, to a professional state of maintenance. Permit may be required. 15. The exterior walls and/or trim of the house and/or garage has defective, peeled, flaked, scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint to effect a sound condition in a professional manner. 16. The foundation is deteriarated, defective or in a state of disrepair. Repair a11 foundation defects in a professional manner to a weather-tight, water-tight and rodent-proof condition. Permit may be required. 17. There aze missing or defective guardrails. Provide all stairways, porches, decks or steps which are more than 30" high with guardrails and intermediate rails with openings in the guardrail no more than four (4) inches apart and in accordance with tha State Building Code. 18. The stairs have missing or defective handrails. Provide all interior and exterior stairways and steps of more that three (3) risers with handrails which are grippable and installed 34" to 38" above the nose of the stair treads. 19. The exterior walls of the house andlor garage are defective. Repair all holes, breaks, loose or rotting siding, to a professional state of maintenance. Provide proper window and door screens for all openable windows and doors. Screens must be ti�t-fitting and securely fastened to the frames. 21. There are burst pipes. As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by February 26, 2009 the Department of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the building(s). The costs of this action, including administrative costs and demolirion costs will be assessed against the property tases as a special assessment in accordance with law. As first remedial action, a Code Compliance Inspection Report must be obtained from the Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-9090. This inspection will idenrify specific defects, necessary repairs and legal requirements to correct this nuisance condition. If this building is located in a historic district or site (noted above, just below the property address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for the repairs required by this order and compliance with preservation guidelines. Copies of the guidelines and design review application and forms are available from the Department of Safety and Inspections web site (see letterhead) and from the HPC staff. No permits will be issued without HPC review and approval. HPC staff also can be reached by calling 651-266-9078. As an owner or responsible party, you aze required by law to provide full and complete disclosure of this "Order to Abate" to all interested parties, all present ar subsequent renters and any subsequent owners. 1f you sell, transfer, or convey in any manner, the ownership or responsibility for this property, you must within seven (7) days, notify the En£orcexnent Officer with the names and addresses of any new owners ar responsible parties. The Enforcement Officer is required by law to post a placard on this property which declares it to be a"nuisance condition", subject to demolirion and removal by the City. This placard shall not be removed without the written authority of the Department of Safety and Inspections, Division of Code Enforcement. The deparirnent is further required to file a copy of this "Order to Abate" with the City Clerk's Office. If conective ac6on is not taken within the time specified in this order, the Enforcement Officer will notify the City Council that abatement action is necessary. The City Clerk will then schedule dates for Public Hearings before the City Council at which time testimony will be heard from interested parties. After this hearing the City Council will adopt a resolution stating what action if any, it deems appropriate. If the resolution calls £or abatement action the Council may either order the City to take the abatement action or fix a time within which this nuisance must be abated in accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective acrion is not taken within the specified rime, the City shall abate this nuisance. Ordering the owner to remove or repair the building(s) at 886 Duchess Street within fifteen (15) days from adoption of resolution. The property owner of record, Federal National Mortgage Assn., did not appear. No other parties of interest appeared. Mr. Magner stated the building was a one and one-half story, wood frame, single-family dwelling on a lot of 8,276 square feet and had been vacant since September 5, 2008. A code compliance inspection had not been done, the vacant building registrarion fees in the amount of $1,000 went to assessment on December 19, 2008, and the $5,000 performance bond had not been posted. On December 16, 2008, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on January 27, 2009 with a compliance date of February 26, 2009. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $25,300 and the building to be $86,700. Real estate tases were current. Code Enforcement estimates the cost to repair the building to be approximately $40,000 to $SQ000. The cost for demolition was estunated to be approximately $8,000 to $11,000. There had also been four summary abatements issued to this property since 2008, four of which went to work arder. to secure the building and the City had to board the building to secure it from trespass, remove improperly stored refuse and debris, boarding, and remove snow and ice. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1900 and was a Victorian-style building. She said that it had been surveyed in 1983; however, she did not believe there was any potential for designation on its own. She said there was no context of the houses in the neighborhood and she did not believe demolition would have an adverse effect. She said that the brick on the house appeared to be in good condition and suggested it be salvaged prior to demolition to be used as replacement on other similar brick dwellings. Ms. Moermond asked Mr. Magner whether there was a way the brick could be salvaged. Mr. Magner responded that he would need to write a new demolition spec and submitted for bid again. The brick would then need to be removed prior to the demolition of the remainder of the building and that there would need to be an identified outlet for the retention of the brick. Ms. Spong suggested contacting an architectural salvage company or a masonry company to see if they would be interested in the brick. Ms. Moermond recommended the building be removed within 15 days with no option for repair and requested that the brick on the exterior of the building be salvaged prior to demolition.
