Whereas, Frank Zusan, an employe
the Department f "ublic Works of
WHEREAS, Frank Zusan, an employe of the Department
of Public Works of the City of Saint Paul, was injured on
July 2, 1956, in a third party accident, while engaged in the
performance of his duties for the Department of Public Works;
and
WHEREAS, the total amount of compensation and medical
expenses paid and to be paid on behalf of said employe by the
City is in the amount of $641.75, and the City vehicle involved
in said accident was damaged to the extent of $672.01; and
WHEREAS, the firm of Robins, Davis & Lyons, who
represent the employe Frank Zusan, have negotiated a settlement
on his behalf for personal injuries in the amount of $5,000; and
WHEREAS, the office of the Corporation Counsel is
in receipt of a draft of the Shelby Mutual Insurance Company of
Shelby, Ohio, insurer of Casanova Beverage Company, the third
party involved in said accident, in the amount of $672.01,
payable to the City of Saint Paul and Robins, Davis & Lyons,
which has been endorsed by that firm, and a check of Robins,
Davis & Lyons in the amount of $313.31, in settlement of the
City's subrogation interest, they having previously deducted
the sum of $328.44 as attorney's fees due them in connection
with the preparation of settlement of the case. From the
latter amount, the firm of robins, Davis & Lyons has agreed
to pay outstanding medical expenses in the amount of $12 to
Drs. Smith, Pearson & Wolff and $15 representing the balance
of medical expense due Dr. John Beer; now, therefore, be it
RESOLVED, That the proper City officers are authorized
to accept the two drafts, in the amount of $672.01 and the amount
of $313.31, in full, final and complete settlement of the subroga-
tion -rights of the City to the personal injury claim of Frank
Zusan, and the property damage to the City vehicle involved in
said accident; and that the amount of $672.01 be credited to
