Dear Sir:
This is in the matter of the appeal of the State of Minnesota to establish a
new building line on the east side of Cedar street and the west side of Vilest
Central Park between Thirteenth and Central '=.venues. The property under
consideration is described as: Sw'ly 112 of vac. alley and turn - around and
part, Ne'ly of Following line: Beginning at a point on Se'ly line of and 28. 97'
Sw'ly from S. E. corner of lot 32, block 3: thence Nw'ly 498.84' more or
less to'a point on N'ly line of lot %, block 2, 12.27' Sw'ly from N. E corner
thereof of lot 2, block 2 and lots 17 through 32, block 3, Central Park Addition.
Also Ne'ly 1/2 of vacated alley and turn - around adjacent and following: Lot 1,
block 2 and lots 1 through 16, block 3, Central Park Pddition. Zoning is
"C" residence.
The applicant is the owner of all of the property in the block bounded by West
Central Park, Central ,?venue, Thirteenth Street and Cedar 6treet and pro-
poses to construct a new State office building. This appeal, if granted, would
allow the construction of a canopy to the property line on Cedar with the main
portion of the building set -back, an average of 28' and the main portion of
the building to be within 6' of West Central Park. The present building line
is 15' from both Cedar ;street and V est Central Park. The present building

will be some 90' in height and the top of the penthouse will be some 14.85'
lower than the roo" of the Historical Building-
Field investigation discloses no objection. It is the opinion of the 7,oning
Board that the needs of the State of Minnesota will be best facilitated by a
relaxation of the set -back requirements. The proposed State office building
is a major element in the civic design of the Capitol - pproach area. In
this connection the State of Minnesota is making provision for adequate off -
street parking to accommodate the needs generated by all State activities
in this area.
In consideration of these factors, the /oning Board finds the purpose and in-
tent of the "Zoning Ordinance would be substantially achieved under these cir-
cumstances and, therefore, recommends the establishment of a new building
line in accordance with the applicant's plans approved October 3, 1957.

COUNCIL OF THE CITY OF ST. PAUL FOR RE140VAL
OF SET -BACK RELATING TO SITE AND STRUCTURE
OF PROPOSED STATE OFFICE BUILDING.
TO THE HONORABLE COUNCIL OF THE CITY OF ST. EkUL, MINNESOTA;
The State of Minnesota, by Arthur Naftalin, Commissioner
of Administration, respectfully petitions your Honorable Body for
removal of the set -back and height restrictions pertaining to the
construction of the proposed new state office building upon the land
site situated in the City of St. Paul, Minnesota, and described
as follows;
Lot 1, Block 2, and Lots 1 to 16, inclusive, Block
3, together with a vacated alley and cul -de -sac
located within said Blocks 2 and 3, all in Central
Park Addition, Ramsey County, Minnesota.
The plans and specifications for the new state office build-
ing provide for construction to the property line and for a maximum
height of 90 feet, which appear to be inconsistent with the provi-
sions of Building Zone Ordinance No. 5840, as amended, Art. II, aec.
11, and Art. III, Sec. 16.
The legislature by L. 1955, c. 855, § 9, appropriated
$4,494,480 for the construction of the new state office building
and acquisition of land therefor; that this appropriation was sup-
plemented by L. 1957 Ex. Sess., c. 29 s 2, Subd. 33, appropriating
$4,005,158 for an addition to the new state office building.
On July 5, 1956, and on several occasions subsequent thereto,
the Commissioner of Parks, Playgrounds and Public Buildings, by the
City Architect of St. Paul, advised the State of Minnesota that be-
cause the nrope^ty above described is zoned as Class "C" Residential,
he had determined that a ten percent set -back would be required,
and that the height requirements of the zoning ordinance, Art. II,
Sec. 119 would govern, unless the strict application of the ordinance)
providing therefor was relaxed by the council. However, such a set -v
back or any set -back and height restrictions would.prevent construc-
tion of the building in accordance with the plans and specifications
therefor., would render the site too confining and impractical for
state purposes as authorized by the legislature, and would cause
practical difficulties and peculiar hardships to the state.
Accordingly, the State of Minnesota appeals to the City
Council from the determination of the Commissioner of Parks, Play-
grounds and Public Buildings, pursuant to Sec. 20 of the zoning
ordinance, in accordance with paragraph i thereof, and applies for
a variance from the strict application of the provisions of the zoning
ordinance, based upon "practical difficulties or peculiar hardships
in the way of carrying out the strict letter of this ordinance so
that the public health, safety and general welfare may be secured
and substantial justice done ", to the end that the council .remove
the set -back and height restrictions in the ordinance contained as
applied to the aforesaid site and proposed construction of the new
State Office Building.
