Dear Sir:
This is in the matter of the appeal of the North Central Construction Inc.
to establish a new building line on Lots 1,2,3, Block 4, Bisanz's Riverwood
Terrace. This property is lo.,ated on the W. side of Colby between Magoffin
and the Ford Motor Co. property. The zocing is "A" Res. The property is
presently vacant and has a frontage of 280.8 ft. on Colby and extends to a
depth of 226.76 ft. along its southerly boundary and 432.38 ft. along its
northerly boundary.
Field investigation discloses that there are two single family homes to
the south set back 40 ft. from Colby and that the property drops quite
rapidly toward the Miss. River Blvd. on the west. The present building
line on these three lots is as follows: Lot 1 - 70 ft., Lots 2 - 50 ft.,
and Lot 3 - 48 ft. The applicant proposes a building line of 40 ft. for
all three lots. The applicant has submitted a consent petition signed by
four adjoining property owners to the south.
The Zoning Board feels that the granting of this appeal will facilitate
the highest and best development of the property for residential purposes
and will be in accordance with the intent and purpose of the Zoning Ord.
in carrying out the public interest. The Zoning Board further finds that
this proposal in no way affects the rights and interests of the adjacent
property owners.
In consideration of these factors, the Zoning Board recommends that this
appeal to establish a 40 ft. building line on Lots 1,2,3, Block 4, Bisanz's
Riverwood Terrace be granted.

The undersigned hereby requests that the building line for Lots
1, 2, and 3 in Block 4, Bisanz Riverwood Terrace be established at
40 feet from the property line facing Colby Street.
This request is made with the intention of erecting four new
homes on line with the existing properties facing Colby Street.
You will note that Lots 1, 2, and 3 are variable depth lots. The
normal requirement of 20% of the average lot depth vault cause a
staggering of the setback line and would also cause the homes to
fall on land that is considerably below the level of Colby Street.
