RESOLVED, by the Council of the City of Saint Paul,
that the issuance of a permit, pursuant to a written applica-
tion of Northern States Power Company, in the premises, to
said Company, by the Commissioner of Public Works, under
and subject to all of the provisions,- terms, and conditions
of City of Saint Paul Ordinance No. 93149 as amended, be and
the same hereby is approved and authorized and that the same
shall constitute permission to,said Company, as the permittee,
under said Ordinance No. 9314, as amended, to use the public
streets and other public property within the corporate limits
of the City of Saint Paul, as the same shall be transversed
by the line hereinafter described, for the purpose of erecting,
laying, constructing, installing, maintaining, and operating
a High Voltage Tower Electric Transmission Line, with the
towers, structures, poles, crossarms, cables, wires, guys,
supports, fixtures, and devices used or useful in the opera-
tion and maintenance of said High Voltage Tower Electric
Transmission Line, through, over, and upon those certain tracts
or parcels of land owned by the City of Saint Paul, situate in
the City of Saint Paul, County of Ramsey, and State of Minnesota,
described-as follows:
"A parcel of land in the Northwest Quarter (NWA4) of
the Southwest Quarter SWI41 of Section Eleven (11),
Township Twenty -eight M) North, Range Twenty -two
(22) West, described as follows:
"Beginning at the West 1/4 corner of Section Eleven
(11), Township Twenty -eight (28) North, Range Twenty -
two (22) West; thence Southeasterly to a point on
the South 1/16 line Four Hundred Eighty -six and
One Tenth (486.1) feet West of the West 1/16 line;
thence West along the South 1/16 line to the West
section line; thence north to the place of beginning;
and

east Quarter (NVA) lying Westerly of a line drawn
as follows:
"From the Northwest corner of the Southeast Quarter
(SEi) ,of-the Northeast Quarter (NE44) to the East
Quarter (81/4) corner of Section t6n (10), Township
Twenty -eight (28), Range Twenty -two (22),"
and through, over and upon that certain route, one hundred and
twenty five (125) feet in width, the center line * ereof is
described as follows:
*Beginning at a point on the South line of above
described property, said point being Eight Hundred
Forty -s -ix (846) feet, more or less, West of the
West 1/16 line, Section Eleven (11), Township
Twenty -eight (28) North, Range Twenty -two (22)
West; thence Northwesterly to a point of turning,
said point being Three'Hundred Eighty -two (382)
feet West of the East`l /4 corner, Section Ten (10),
Township Twenty -eight (28) North, Range Twenty -Two
(22) West and Sixty Five (65) feet north of the
East West 1/4 section line; thence deflecting to
the left at an angle of 220 5,2' and proceeding to
a point on the North 1/16 line Eight Hundred Thirty
830) feet West of the East 1/16 line, Section Ten
10), Township Twenty Eight (28) North, Range Twenty
Two (22) West, said point being on the North line of
the above described property."
RESOLVED, FURTHER, That such
Company to use the public streets and otl

within such corporate limits shall authorize the aforesaid
use upon and along said route as shall be necessary for the
erecting, laying, constructing, installing, maintaining, and
operating of the aforesaid High Voltage Tower Electric Trans-
mission Line and appurtenances by said Company as such per -
mittee under said Ordinance No. 9314, as amended, in conducting,
distributing, and supplying electric energy for public and
private use and for the purpose of conducting such electric

energy to and through said City, provided that such High
Voltage Tower Electric Transmission Line and appurtenances
shall be so located as not to interfere with the safety or
convenience of ordinary travel along and over said public
streets and public property and so as not to interfere with
any other public use of the same.
RESOLVED, FURTHER, That, among other conditions
pertaining to such permission under such permit, said Company,
in the installation, maintenance, and operation of said High
Voltage Tower Electric Transmission Line and appurtenances,
shall be subject to such reasonable regulations as may be
imposed by this Council from time to time by ordinance or
resolution, and further that if it shall become necessary,
in the furtherance of any public improvement or at the in-
stance of said Company, to remove or relocate the physical
property of said Company represented in said High Voltage
Tower Electric Transmission Line and appurtenances, said
Company shall remove and relocate the same without cost to
said City and shall place all public streets and public
property affected, in the same condition as that which
pertained to the same immediately prior to such removal
or relocation, and that said Company shall, as one of the
consideratians and conditions - hereof, fully indemnify and
save said Gity whole and harmless from any and all claims
for injury'or damage to persons; or property occasioned by
or arising out of the construction, maintenance, operation,
repair, removal, or relocation of said High Voltage Tower
Electric Transmission Line and appurtenances by said Company
hereunder.
RESOLVED, FURTHER, That said High Voltage Tower
Electric Transmission Line and appurtenances shall be erected,
maintained, and operated through, over, and upon said route;
that, among other things, as a condition to the granting of
such permission under said permit to said Company, the location.,
erection, construction, maintenance, operation, repair, removal,
and relocation of said High Voltage Tower Electric Transmission
Line and appurtenances by Braid Company, shall be subject to
the supervision and direction, conformable to this resolution,
by the Commissioner of 'Public'Works and the Commissioner of
Public Utilities of said City, and to such minor deviations
in the subject route and minor changes of tower locations
as shall be directed by the concurrent action of said Commis-
sioners of Public Works and Public Utilities in the interest

of the involved public service; that said High Voltage Tower
Electric Transmission Line and appurtenances, as installed,
maintained, and operated, shall be of the same status as
other public utility installations of said Company and permitted
on public streets and other public property of said City under
said Ordinance No. 9314, as amended, and shall likewise be
subject to applicable provisions, terms, and conditions of
said ordinance, as amended, without delimitation; that said
Company shall file its written acceptance of this resolution
within sixty days next after the publication of the same,
in the office of the City Clerk; and that nothing hereunder
nor by virtue of said permit shall be deemed to grant any
right in any premises transversed by the hereinabove
described route, which shall represent private, as distin-
guished from public property, and which shall be neither
owned nor controlled by the said City.

Dear Ccamissioner Winkel:
I an attaching hereto copies of two resolutions based upon requests
of the Northern States Power Company for permission to cross tax forfeited
property now owned by the City of St. Paul in the Pigs 1�ro lake District.
These are oompaaion resolutions to Resolution Council File 184886 approved
October 16, 1957. The location of the land as described has been approved
by the undersigned and by Mr. Leonard C. Sooner, Assistant Land Ce■missiamner,
and is located so as not to interfere with any future industrial iai-bor
development. The resolutions have been drafted by Mr. Louis P. Sheaban,
Special Assistant Corporation Counsel.
The previous resolution was introduced by Commissioner Rosen as
Camissiouer of Utilities. In as much as the Ca■missioners of both
departments are referred to in the resolution, it should possibly be intro-
duced jointly.
