RESOLVED, by the Council of the City of Saint Paul,
that the issuance of a permit, pursuant to a written applica-
tion of Northern States Power Company, in the premises, to
said Company, by the Commissioner of Public Works, under
and subject to all of the provisions, terms, and conditions
of City of Saint Paul Ordinance No. 9314, as amended, be and
the same `hereby is approved and authorized and that the same
shall constitute permission to said Company, as the pprmittee,
under said Ordinance No. 9314, as amended, to use the public
streets and other public property within the corporate limits
of the ;City of Saint Paul, as the same shall be transversed,,,
by the line hereinafter described, for the purpose of erecting,
laying, constructing, installing ;.maintaining, and operating
a High Voltage Tower Electric Transmission Line, with the
towers, structures, poles, crossarms, cables, wires, guys,
supports, fixtures, and devices used 6r useful in the operation
and maintenance of said High Voltage Tower Electric Transmission
Line, through, over, and upon those certain tracts or parcels
of land,owned by the City of Saint Paul, situate in the City
of Saint :Paul, County of Ramsey and State of Minnesota, described

"The Northeast Quarter (NE!) of the Southeast
Quarter (SEA) of the Southwest Quarter (SW AA)
of Section Fourteen (14), Township - Twenty Eight
(28) North, Range Twenty -Two, (22) -West; and the
Northeast Quarter (NE %) of-the Southwest Quarter
(SWV4) of Section Fourteen (14)9 Township Twenty
Eight (28) North, Range Twenty Two (22) West,"
and through, over and upon that certain route, one hundred and
twenty .five (125) feet in width, the center line whereof is
described as follows:

RESOLVED,FURTHER,.That such permission to said
Company to use the public streets and other public property
within such corporate limits shall authorize the aforesaid
use upon and along said route as shall be necessary for the

operating of the aforesaid High Voltage Tower Electric Trans -
mission line and appurtenances by said Company as such permittee
under said Ordinance No. 9314, as amended, in conducting,
distributing, and supplying electric energy for public and
private use and for the purpose of conducting such electric
energy to and through said City, provided that such Hi4iVoltage
Tower Electric Transmission line and appurtenances shall be
so ._located as not to interfere with the safety or convenience
of °ordinary travel .along and over said public streets and '
public property and so as not to interfere, with any other
public use of the same.
RESOLVED,FURTHER, That, among other conditions
pertaining to such permission under such permit, said Company,
in the installation, maintenance, and operation of said Hic
Voltage Tower Electric Transmission line and appurtenances,
shall be subject to such reasonable regulations as may be
imposed by this Council from time to time by ordinance or
resolution, and further that if it shall become necessary,
in the furtherance of any public improvement or at the iris tance
of said Company, to remove or relocate the physical property
of said Company represented in said High Voltage Tower Electric
Transmission line and appurtenances, said Company shall remove
and relocate the same without cost to said City and shall place

all public streets and public property affected, in the same
condition as that which pertained to the same immediately prior
to such removal or relocation, a,nd that said Company shall,
as one of the considerations and conditions hereof;. fully
indemnify and save said City whole and harmless from any and
all claims for injury or damage to persons or property occasioned
by or arising out of the construction, maintenance, operation,
repair; removal, or relocation of said High Voltage Tower
Electric Transmission line and appurtenances by said Company
hereunder.
RESOLVED, FURTHER, That said High Voltage Tower Electric
Transmission line and appurtenances'shall be erected,maintained,
and operated through, over, and upon said route; that, among
other things, as.a condition to the granting of such permission
under said permit to said Company, the location, erection,
construction, maintenance, operation, repair, removal, and
relocation of said High Voltage Tower Electric Transmission
line and appurtenances by said Company, shall be subject to
the supervision and direction, conformable to this resolution,
by the;�Commissioner of Public Works and the Commissioner of
Public',.Ut "l,ities of said City, and to such minor deviations
in the < subj e'ct route and minor changes of tower locations
as sha,ll.be directed by the concurrent action of said Commissioners,
of Public Works and Public Utilities in the interest of the in-
volved public service; that said High Voltage Tower Electric-'
Transmission line and �q)purtenances, as installed, maintained,
and operated, shall be of the same status as other public
utility installations of said Company and permitted on public
streets and other public property of said City under said
Ordinance No. 9314, as amended, and shall likewise be subject
to applicable provisions, terms, and conditions of said ordi-
nance, as amended, without delimitation; that said Company
shall file its written acceptance of this resolution within
sixty days next after the publication of the same, in the office
of the City Clerk; and that nothing hereunder nor by virtue of
said permit shall be deemed to grant any right in any premises

Dear Mr. Sheahan:
This'is pursuant to our meeting of yesterday afternoon in Mr. Seamer's
office concerning the route description for the construction and- maintenance
by the Northern States Power Company of a high voltage tower electric trans-
mission line or lines across certain tax - forfeited properties in the Pig's
Eye Lake'distriet recently acquired by the City of Saint Paul. It seems ad-
visable that a resolution similar to the form of that outlined in resolution
Council File No. 173691, approved June 21, 1955, be followed.
The proposed transmission line will be constructed across three separate
city -owned tracts, which will necessitate a center line description for each
separate tract. Under resolution C. F. No. 173691, plans were filed showing
the general location of the transmission line. In the present case it will
not be necessary that plans be filed inasmuch as the approximate line will
be covered in the description.
I am taking the liberty of suggesting that the description, both of the
area and-of the transmission line, be treated as a separate item in this
manner, beginning with what would be the latter part of the first paragraph
of the resolution: ". . . through, over, and upon the following described
tract of land, being the property of the City of Saint Paul, County of Ramsey,
and State of Minnesota, described as follows:"
"The Northeast Quarter ( ) of the Southeast Quarter (SEJ)
of the Southwest Quarter(SWJ) of Section Fourteen (14),
