Moore, Contract Nb. 57- G- 1179, "for the grading of Iowa Avenue from,,Soo Line Plat to Rice Street; Park Street from Montana.., 'to Wheelock; Montana Avenue from Sylvan Street.to Rice Street; Hoyt Aver% from Sylvan Street to Rice Street; and Sylvan Street from Montana Avenue to Hoyt Avenue; also construction of the Park -Iowa Sewer System; and WHEREAS, the Public Works Department of the City of Saint Paul has been requested to lower the grade at Montana Avenue an average of one foot from a point 260 feet west of Park Street to Sylvan Street; and WHEREAS, the aforementioned request was made by the owners of abutting properly, namely, W. C. Schloze.r. President of City Dairy, Inc., by Gerald E. Frisch and Olin Hermain, Vice President and Secretary, respectively, of the Twin Plaza Company, and by James Wyatt, President of the James Invest- ment Company; and WHEREAS, all of the above firms have signed slope releases giving to the City the right of additional slopes as needed in making the aforemen- tioned additional change in grade from that established in the contract - hereinbefore referred to; and. w> WHEREAS,, such change would be mutually.advantageous to the afore- mentioned abutting property owners as well as to the contractor, Robert W. Moore, who is desirous of proceeding with the modified grade, since it would provide him with additional fill material.and obviate the necessity of hauling such materials from greater distances, and to the City of Saint Paul, since the Public Works Department feels that the modification in grade would result in providing the Citywith a more desirable street; now, there- fore, be it RESOLVED, that the proper City officers are hereby authorized and directed to execute aniggreement with said Contractor to provide for said change in grade, on behalf of the City of Saint Paul, a copy of such Agree- ment being,. attached hereto and made a part hereof.# by reference.
