6. State specifically what is being appealed and why (Use an attachment if necessarv)
Appeat is tak� from each of the listed deficiencies, Nos. 1-8, in the Inspection Report
made by Jackie Girling, Fire Inspector, dated Mazch 11, 2009. (See attachment). Said
appeal is taken, because there was no reasonable period allowed to make any corrections.
The owner of the property is located in Sacramento, and did not receive said Inspection
Report until March 16, 2009, because it was sent by U. S. Mail, First Class. Said property
had been previously inspected and approved, also by Jackie Girling, and a Certificate of
Occupancy was issued on December 29, 2008. Appeal is also taken because the
purported deficiencies are vague and ambiguous and not particularly specified. Appeal is
taken as to items 2 and 3, because puiported rats and rodents were previously treated and
controlled by Orkin in accordance with Ms. Girling's earlier inspection report and proof
of treahnent was provided to Ms. Girling, who refused to honor it. Appeal is also taken as
to listed items 1-4, because the holes requested to be patched were previously done in
accordance with Ms. Girling's earlier inspection report, but was removed by the Inspector
while she re-inspected (per her re-inspection reports which requested holes to be
unpatched for pest control company). Appeal is also taken as to listed item 7, because the
leaking tub was fixed with no leaks, tested by contractor Dang Yang and a licensed
plumber, who verified no leaks. Appeal is also taken, because there was insufficient time
to corrected the listed items between the time of the re-inspections on Mazch 3 and 11,
2009.Appeal is also take as to listed items 1-4, because Ms. Girling failed to specify and
document and did not provide any proof of any holes that were requested to be patched.
Appeal is also taken, because Ms. Girling asserted that the properiy will be put into
vacant building list, category 2, even though the properly is still under lease with the
tenants, who have relocated while property is being repaired.

Dear Property Representative:
Your building was inspected on March 11, 2009.
The building was found to be unsafe, unfit for human habitation, a public nuisance, a hazard to the public
welfare or otherwise dangerous to human life. A Condemnation Placard has been posted on the building.
The following deficiency list must be completed immediately or the building vacated.
A re-insuection to determine vacancv will be made on March 16 2009 after 9•00 am.
CONDEMNATION OF THE BUILDING REVOKES THE FIRE CERTIFICATE OF OCCUPANCY.
Failure to complete the corrections may result in a criminal citation. The Saint Paul Legislative Code requires
that no building be occupied without a Fire Certificate of Occupancy.
DEFICIENCY LIST
SPLC 34.09 (1) a, 34.32 (1) a- Provide and maintain foundation elements to adequately support this
building at all points.-Patch all areas in foundation of house where rats and other rodents can gain entry.
SPLC 34.23, MSFC 110.1 - This occupancy is condemned as unfit for human habitation. This
occupancy must not be used until re-inspected and approved by this office.-Due to the severity of the rat
and mouse infestation, as well as the number of holes throughout the house and foundation, this property
has been condemned. All work must be completed and house must be free of all rodents by March 11 or
this house will be ordered vacated. Submitted documentation from exterminator stating that this property
is free of all rodents will be acceptable for compliance of this condemnation.
3. SPLC 34.10 (6), 34.33 (5) - Bxterminate and control insects, rodents or other pests. Provide
documentation of extermination.-Professionally exterminate entire property for rats and mice. Holes
that were patched during the last extermination may have to be uncovered so that professional
exterminator can lay poison. Re-patch once poison is laid. Submit documentation to inspector. �F� �z
4. SPLC 34.10 (7), 3433 (6) - Repair and maintain the walls in an approved manner.-Properly patch all
holes in walls throughout house, specifically in attic, upper level, and basement where rats can gain
entry to house.
5. SPLC 34.10 (7), 3433 (6) - Repair and maintain the ceiling in an approved manner.-Repair the ceiling
in main floor bedroom where there is recent water damage.
6. SPLC 34.11 (6), 3434 (3) - Provide service o£heating facility by a licensed contractor which must
include a carbon monoxide test. Submit a completed copy of the Saint Paul Fire Marshal's Existing Fuel
Burcung Equipment Safety Test Report to this office.
7. SPLC 3411, SBC 2902.1, SPLC 34.17, MPC 415.0220 - Repair or replace and maintain the plumbing
fixture to an operational condition.-Have licensed professional check all water pipes/plumbing pipes for
any leaks. This may mean that the wall in main floor bathroom that was recently repaired prior to the
plumber checking these pipes per previous orders may have to be removed for this inspection. Submit
documentation to inspector.
8. SPLC 39.02(c) - Complete and sign the provided smoke detector affidavit and retum it to this office.
You have the right to appeal these orders to the Legislative Hearing OfFicer. Applications for appeals may be

f went and verify where the leak came &om, and I did aotice that the tub drain is not all the way tight,
:ook it out and inspect it Whoever had instailed the tub before didn't put the right gasket I repiaced
he gasket and re-tight the drain back to let the water run fiill pressure. The leak did stop. I aLso check
'or other leaks but I didn't notice any at the locaxion.

i check the lealcage problems at the property and send a zeport after the observation. FJhen I go there
i check the plumbing fixhues, I norice that the tub drain was not all the way tight and �ass fbai,
it might be the leakage problem
Whoever installed the tub before dida't put the right gasket so, I regiaced the gasket and re-
ht the drain back aud hope that it wouid solve the leak. After Pve replac� Yhe gaskec we tumed on
; water to retest it. It seemed l�e ruhber gasket did stop the leak at the tub drain_ D"� � the
anging of the gasket I notice that the shoe of the wasfe and overtlow wasn't the right one either bat

However the iaspection sheet require me to fook at the plumbing piping system for all the
ssible leaks. F didn't have t�e chance to do so, because there was no access panel behind the tub or
=ning anywhere. It looked like sourebody already sheet rock over azed painted them
I had the susgicion that someone might did �me work, and try to lude it with the shezt rocks.

:re, and I expected to see some plimmbing piping exposed or water stains on the walls and I didn't get

nes back he or she might want to have the walls open for me to check on the pipes. He didn't say
rthing to me about going ahead and cuY them walls, so to me, if he wanfs to gamble; it's his choice.

ever since she has been having problems with the landlord. Vang said she has until 11/24/08 to vacate the
property Vang said when she arrived home today she found a notice on her front door from the landlord saying
there �vo��+d be an elecirician ai the resiaence on 11/19/08 and that the tenant would have to be home to let the
electrician in.

4. Appeal of Vytas Rimas, on behalf of Kenny Vang (the Keng F. and Ying V. Yang Family
Limited Partnership), to a Certificate of Occupancy Deficiency List, which includes
Condemnation, for property at 204 Acker Street East.
7ackie Girling, DSI-Fire Prevention Inspector and Leanna Shaff, DSI-Fire Prevention Inspector
Supervisor appeared on behalf oFthe department. Vytas Rimas, attorney at law, appeared on behalf
of the appellant, Kenny Vang.
Ms. Moermond refened to an appeal of a deficiency list that had been filed on November 21, 2008,
with a hearing date on December 16, 2008, concerning this property which Mr. Rimas had
withdrawn as being resolved. She asked Mr. Rimas if this was correct. Mr. Rimas responded that
this was conect as there was a hearing scheduled in Housing Court on December 19 and believed
all issues would be resolved in court. Ms. Moermond asked for a report from Inspector Girling.
Inspector Girling stated that she had received a complaint of rat infestation at the property in
October 2008 and had issued orders on November 12, 2008 threatening condemnation if the
property was not brought into compliance. She said that she had not followed through on issuing
the condemnation order because the owner had promised to hire an exterminator to take caze of the
rat infestation and to bring the property into compliance. She said that the tenants had consulted
with Cassandra Netzke, SMRLS, to bring a Housing Court action against the owner foz failure to
make the necessary repairs to the building which the tenants themselves were having to pay to do
and as a result, were escrowing their rent money. The Housing Court hearing was held in mid-
December and the judge ordered that the rent being held in escrow be split in half between the
owner and the tenants. She received a complaint again on January 26, 2009 of rat infestation as the
owner had failed to continue the extermination treahnents as recommended by Orkin. She re-
inspected the property on February 10, 2009 and the Orkin exterminator was there. They found
three to four lazge holes behind the stove where the rats were coming tlu Because of the size
of the rats, the Orkin exterminatoz did not haue enough traps that were big enough and had to
reschedule another time to go back to the property. She also found that there was water damage to
the main floor bedroom and bathroom ceilings as well as the bathroom wall from a possible leaking
pipes. She sent orders to the owner to have Orkin provide documentation of extermination as well
as arders to have a licensed, professional plumber send documentation that the pipes in the main
floor bathroom, as well as in the main floor bedroom, were inspected for any leaks. On March 3,
2009, she went to the property and talked to the tenant who indicated that they had caught a rat and
were keeping it alive far her to see. She was also informed that a plumber came out to inspect the
water damage but did not do any wark. She said the landlord had instructed whoever warked £or
him that the holes and water damaged azeas be sheet rocked over. The rats then created new holes
so they could escape and there was evidence that the pipes were still leaking. She said she then
talked to Xay at Rhinex Plumbing regarding his report after inspecting the plumbing. He indicated
that he replaced a rubber gasket in the tub drain and that he didn't believe the waste and overflow
was correct; however, he was unable to look at the pipes as there was no access panel and
everything had been newly sheet rocked. She sent orders on March 3, 2009 to Mr. and Mrs. Vang
instructing them to uncover the holes so that the rats could be properly externunated and to remove
the wall in the bathroom so that the plumber could check the pipes far leaks and to provide
documentation by the licensed contractors of the work that was done. She gave a re-inspection date
of March 11, 2009 indicating that if the property was not in compliance, the certificate of
occupancy would be revoked, the property would be condemned and ardered vacated with a
vacation date of Mazch 16, 2009. She said the property would then be referred to the Vacant

Buildings Program as a category 2 vacant building which would require a code compliance
inspection and the property would need to be brought up to code before it could be ze-occupied.
Since the property was not in compliance on March 16, 2009, she condemned the building and the
tenants moved out on March 1 b. She referred the building to the V acant Building Proa am and a
category 2 vacant building file was opened on Mazch 24. Ms. Girling presented photos of the
violations (including the barely alive rat), the report from the Orkin exterminator, a report from
Rhinex Plumbing, and notes from Amanda.
Ms. Moermond asked Inspector Girling whether ttie referral to the Vacant Building Program had
been pulled. Ms. Girling responded that it had not. Ms. Moermond stated that it should have been
pulled since an appeal was filed.
Mr. Rimas stated that Mr. Vang was a conscientious property owner who lived in Califomia and
had difficulty obtauung information from the inspector. He said he had never seen the photos that
the inspector was referring to (of the alleged rat), had repeatedly asked the inspector to provide
documentation and she has refused to comply with his request. He believed the severity of the
problems did not justify condemnation of the building. He said the tenants moved into the property
in 3uly 2008 and had a one year lease. The tenants had placed their November and December rent
in escrow and in Housing Court, the judge ordered half of the rent be paid to the landlord and the
other half be returned to the tenants foz the repairs they had made to the building. He said he had
ordered a transcript of the court proceeding; however, he did not have a copy to provide at the
hearing. He said the tenants had stopped paying rent and owed for the months of January, February
and March. He said these were "problem tenants" in that they wanted to break their lease and as a
means of doing so, they would call the inspector on complaints. He said that while the tenants were
living there, it was difficult to schedule contractors to make repairs as a 24-hour notice was required
before anyone could go to the property. Now that the tenants had moved out of the building, the
owner would like the condemnation lifted so they could make the necessary repairs and have the C
of O re-instated and re-rent the building.
Inspector Girling responded that she did not consider the tenants to be "problem tenants" as she
always found the house clean, no scattered toys, no dirty dishes in the sink, and there were eight
children in the family. She said the reason 24 hours' notice was required was because on one
occasion, the tenant was in the bathtub when wark people entered the house and she called the
police as she assumed they were intruders (a police report was filed). She said she inspected many
properties where the owners lived out of town which did not create problems as most had a property
manager to deal with issues. She said she had repeatedly asked Mr. and Mrs. Vang for an e-mail
address so she could contact them in a more timely manner, and all they would provide her was
their phone number. Sending orders by USPS caused a delay for them receiving orders that were
issued. She said she had received some documentation from Orkin (which was mostly illegible)
and Rhinex; however, she still had not received proof that the extermination had been completed
and that the plumbing had been completely inspected and repaired.
Mr. Rimas responded that the owners were "faithfully" trying to comply with the orders and should
not be penalized because they live out of state and should not be required to have a property
manager to manage the property.
Ms. Moermond noted that Household Industrial Finance Co was listed on the orders as a party of
interest. She asked Mr. Rimas whether the house was in foreclosure. Mr. Rimas responded that he

did not believe so. He said that he believed Mr. and Mrs. Vang purchased the property in May or
June 2008 and may have financed the property through Household Industrial. Ms. Moermond
asked Mr. Rimas how many properties Mr. and Mrs. Vang own in the city of St. PauL Mr. Rimas
responded that he did not know.
Ms. Moermond asked Inspector Girling what the principle violations were on the orders that were
issued on November 12, 2008 which would have lead to the property being condemned. Inspector
Girling responded that the principle violations were as follows: there was exposed wiring in the
attic which was being held together with tape; there was a foul odor throughout the house, rodent
infestation; there was a hole in the concrete floor in the basement near the water pipes which had
standing water; there was no electrical service in the bathroom; there were loose and/or hanging
light fixtures throughout the house; tl�e phone jack in the dining room was hanging loose; there was
an illegal fifth bedroom on the upper level; and operable smoke detectors needed to be placed
outside each sleeping room.
Ms. Moermond requested Mr. Rimas provide her with all of the Housing Court documents by April
15. She said that she would review the documents and make a recommendation by Apri129. If she
determined another hearing was required, she would contact the parties. This matter will be
scheduled for a public hearing before the Council on May 6. In the meantime, the property is to
remain unoccupied.
On Apri129, 2009, Ms. Moermond reviewed all of the docuxnentation in the file in addition to the
new documentation submitted by Mr. Rimas on Apri129, 2009. Said documents submitted by Mr.
Rimas on Apri129 are attached and made a part of these minutes (with the exception of the Orkin
Reports which were illegible). Based on a review of the file, Ms. Moermond recommended
denying the appeal on the condemnation and order to vacate as the conditions justified the
enforcement action. As a result of this determination, the property does meet the definition of a
vacant building in Legislative Code Chaptex 43.02(7) and needs to be registered as such. It should
be noted that the building will need a code compliance certificate prior to reoccupation.

In accordance with your request made at the Legislarive Heaiing on Apri17, 2Q09 and the
letter dated April 9, 2009 from your office, and to address the statements made at the
hearing by the fire inspector, please find the further statements made in this letter and the
attachments hereto, which the owner of the 204 Acker St. E. property requests to be made
of xecord and considered in this proceeding, which include:
1. Statement of Mary Yang (representative of owner and previously known as
Ying Vang);
2. Orkin Reports;
3. Statement of Xay Chyanghee (hired licensed plumber);
4. Email from Ying Vang (Mary Yang) copies to Jacqueline Girling; and
5. Facsimile from Mary Yang to Jackie Girling.
In response to you queries during the hearing, the 204 Acker St. E. property is the only
rental property of the owner in Minnesota. Also, the property was purchased from an agent
and was the owner's understanding that it was not foreclosed property. The cunent
financing for the property does not require notice to the financing parties.
It is the position of the owner of the 204 Acker St. E. property that the statements made by
Jackie Girling, the fire inspector at the Legislative Hearing on Apri17, 2009 were simply
untrue. Mary Yang, one of the principals of the owner has prepared a statement that
addresses the efforts of the owner to correct the deficiencies listed in the inspecrion letters
dated February 10 and March 11, 2009 far the 204 Acker St. E. property and the fire
inspector's responses and actions to the owner's efforts, which is attached hereto.

Contrary to the inspector Guling's statements, the inspector always had unrestricted
communication access with the owner's representatives, including Ms. Yang by telephone,
facsimile and email, in addition to U.S. Mail. Examples of this were the facsimiles of the
Orkin pest reports that Ms. Yang provided to Ms. Girling and being copied on emails. (See
attachments). Ms. Girling aclmowledged receiving the Orkin reports at the hearing, but
complained for the first rime at the hearing that they were not sufficiently legible and
refused to consider them, even though she never previously brought this to the attenrion of
the owner.
The fire inspector improperly condemned the 204 Acker St. E. property based on a tenant
showing the inspector a live baby rat purportedly found on the properiy, which Ms. Girling
refused to disclose to either the owner's representatives or counsel before the April 7
hearing. However, the inspector refused to consider the efforts and statements of the owner
and the Orkin pest reports, even though the inspector stated that the owner had used a
pxopex and pxofessional pest control service in her view. According to the Oikin reports
made on February 10 and 17, March 31 and April 13, 2009, including those presented
during the hearing and attached hereto, there was no rodent infestation. (See attachments).
According to Orkin, no rodent activity was detected on February 10 and 17, which Orkin
findings were approved by the tenant Jennifer Vang, who signed the two Orkin statements
that indicated her approval on both occasions. (See attachments). The Orkin report made
on March 31, 2009 stated that the "house was a lot cleaner than previous treatments",
which report was made after the tenants had vacated the house. (See attached).
In late February 2009, Mr. Xay Chuyangheu, a]icensed plumber, went to the property to
inspect the leaks cited in the inspection report. (See attached statement of Xay
Chuyangheu). Upon completing his work the plumber communicated to Ms. Girling that
there were no leaks. Fire inspectar Girling asked Mr. Chuyangheu to re-check his work.
Ms. Girling also threatened the plumber that his license was on the line and that it was OK
to tell her if the home owner or somebody helped him. When the plumber went back to the
property, Ms. Girling stopped by without norice and indicated to the plumber that she had
previously seen the pipes behind the wal] when it was opened. However, the pipes behind
the wall had never been open to view, because they were behind the original sheetrock in
the house and had been installed by a previous owner. The fire inspectar threatened the
plumber that if he did not open up the walls and inspect the plumbing fixtures that she
would make sure he lost his license. After the inspecrion, the plumber called the inspector,
who demanded that he write his report in the next 20 minutes or else. The plumber was
confused as to why the inspector was so mad at him. The questionable behavior of the
inspector was repeated and conrinued on a subsequent occasion as described in the
plumber's statement.
The above-described statements and eazlier pattern of questionable circumstances have left
the owner's representatives with the belief that the statements and actions of the fire

inspector Girling were influenced by her discrimination against the owner/landlord,
contractor and plumber, who were all of Asian heritage.
The undersigned attomey had stated at the hearing that inspector Girling had refused m
provide him with any pictures or other puiported evidence that Ms. Girling had apparently
collected and angrily stated that she was throwing the book at the property owner. Even
before the April 7` hearing, Ms. Girling at the behest of her supervisor, declined to discuss
any pictures or other items, which they later presented at the hearing.
The owner welcomes any further oppoztunity to address the matters addressed in this letter
to the Hearing Officer's satisfaction, for its appeal to be granted, and far an order to show
cause why Ms. Girling's statements and actions in connection with the property should not
be deemed unethical, unprofessiona] and discriminatory.

�nspector, the doors were not focked. Jackie's conversation on March 16, 2D09 had
indicated that she was there and make sure the tenants are out and property secured so
tenants cau(d not re-Gccess property for re-occupying.

Conclusion
Based on what Jackie had done to the property u°iih all her deficiencies, she had
already determined to vacate the #enants and put the house into the vacant building
list initialiy. Therefore, whether thare were rats or not, she claimed without
evidence. Our repaired of the deficiencies were never to her satisfaction without
explanations. When we hire the license plumber ta do the job as requested, she
then forced hizn to write and da ti�hat she wanted to hear by threatening }ais license.
Evei� with �1ie previous �eficiency lists befa�•e the occupancy permit, man5r of the
works were not to her satisfaction with no soiid anstivers nar explanations,
therefore, prolonging the time to fiilisl� up the repair. In turn, i# ga�; e the tenants
their benefits of living in the property for twa months free. Jackie sided with the
tenas�ts to create prohlems for their own gain. Jackie also did not approve the work
done by not aven inspecting tl�emn, but based on what she c��anted ta say and what
the tenants said. 3ackie created ai1 the probl�ms and refused to accept the work
done d�e to her oz��n judgrnent and discrisnination towards the landlard, its
contractor, a�1d hired licensed pl�zmber due tb race. Because of the raee issues,
Jackie can go beyond her duty and threatened a iicense plumher to do what she
wa,�ted him ta do by putting his license onthe 1ine. With al1 these, it clearty
showeci that Jackie is duing it becase of discrimination against us, being Asian
minarity owner, eontractor, and plumber. 7ackie's 13�ing excuse af no� having our
e-mail address and fa� number cannot make her �ava us insufficiebt time. Jackie
cannot vacate the tenanfs aad put aar hause into vacant building lis2 if we are
working �vith her or the Fire Dept on correctzng issues per inspector fram City of
