This is an emergency ordi- nance rendered necessary for the preservation of the public peace, health and.safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That Chapters 60 to 64 inclusive,.of the Saint Paul Legislative Code, pertaining to the Zoning Code, Use Districts, and Rezoning of certain properties_in the City of -'Saint Paul, as amended, be and the'same is hereby further amended so as to rezone the following described property from "B" Residence District to 11Ct1 Residence District: Lots 3, 10, - -11 and 12, Block 8, Edmund Rice's 4th Addition, located on the south side of York Avenue and the north side of Cayuga Street between Arkwright and Westminster Streets. Section 2. This ordinance is hereby declared to bean emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Section 3. This property is described as Lots 3, 10, 11, and 12, Block 8, Edmond Rice's 4th Addition. Seventeen *out of a" possible twenty -five, or 68 per cent of the owners of the several descriptions of real estate situated within 100 feet of the area sought to be reclassified have acquiesced to this petition. The property under consideration is presently vacant, and is an "L" shaped area having a frontage of 121.7 feet along Cayuga Street, 30' along York Avenue and a total area of.17,948 square feet. The applicant proposes to construct. two 2 -story seven unit apartment•buildings-, with one bedroom in each apartment. The adjacent land uses are as follows: north across York Avenue are single family residences fronting on York Avenue; east across an unimproved alley is vacant and undeveloped property;.south.across ungraded Cayuga Street. is vacant land; southwesterly across Cayuga Street is a construction storage yard front ing on Westminster; west across an unimproved alley is a large four -story brick apartment building which:;fronts on Westminster; also there are one and two family residences fronting on both Westminster and York Avenue. -The zoning is this area is as follows: to the north and east the property is zoned "B" residence; to the west and to the south it is zoned light industry. The Traffic Engineer has approved the parking lot layout in connection *with the proposed apartment building. Field investigation discloses that this property under consideration, as well as adjacent property to the west and ex- tending two blocks south to the railroad property, would be desirable for low density and multi- family developments as a transitional use between the single family residences to the north, and the industrial uses to the south. The proposed development is in accordance with the general development plan for this area in terms of proper land use. In consideration of these factors, the Board of Zoning recommends that this petition to rezone from "B" Residence to "C" Residence be granted. Sincerely, Herbert C.
