1 WHEREAS, the Council of the City of Saint Paul recognizes the continuing need to eradicate the blighting
2 affect of gang related graffiti and tagging vandalism in the City's neighborhoods; and

4 WHEREAS, the Council also recognizes that there is a continuing need to encourage and support
5 initiatives that can provide benefit to the City's neighboxhoods; and
6
7 WHEREAS, the Council finds that a City policy permitting art murals visible from the public realm will
8 benefit City neighborhoods by creating venues for community members to create art, to increase
9 opportunities for artistic expression by persons of different ages and diverse ethnic, social and cultural
10 backgrounds, and to discourage gang related graffiti and tagging on buildings and structures; and

12 WHEREAS, the Council finds that creating districts where art murals would be permitted as a form of
13 neighborhood-based art is a worthwhile and desirable goal of the City as such districts are likely to reflect
14 a neighborhood's culture, history, vision, and be a source of neighborhood beautification and pride; and

16 WHEREAS, the Council finds that murals created in approved public art mural districts should noY be
17 subject to the City's nuisance abatement powers nor regulated as a Cype of sign under the City's zoning
18 powers; and

WHEREAS, the Council finds that other cities such as Philadelphia and Portland have created public art
mural programs as a means of contributing to the beauty of those cities aesthetic environments and
exposing citizens to art in public places; and
WHEREAS, the Council recognizes from the efforts of these cities that there may be several ways for a
city to promote and regulate public art murals and that the City should undertake a study and analysis of
the various ways to promote and regulate park art murals including through an amendment to the CiTy's
zoning code; NOW, THEREFORE,
BE IT RESOLVED, that the Council of the City of Saint Pau1, pursuant to Minn. Stat. § 462.357, Subd. 4,
requests the Saint Paul Planning Commission to undertake a study and prepare a report evaluating possible
amendments to the City's zoning code to permit and regulate public art murals in the City; and

BE IT FURTHER RESOLVED, that the Planning Commission, in preparing its report and making any
recommendation to amend the zoning code for these purposes, should include in its report, the zones in
which art murals may be permitted, the establishment of general parameters to permit murals including
permitted size, height, and placement of murals, whether murals may be permitted in historic districts or on
historic sites, how to protect existing architectural and other features of construction where a mural is
created, as well as other additional standazds and guidelines deemed necessary and appropriate to classify
and regulate public art murals in a manner that is different from the various types of signs that are
regulated under Chapter 64 of the City's zoning code.
