WHEREAS, adverse action was initiated against the Massage Center — B(Home Location) license
held by Jill Alyssa Mimier d/b/a CM Massage (License ID #20070003297) for the premises located at 740
Mississippi River Boulevazd South, Apt. 22D in Saint Paul, by Notice of Intent to Suspend License dated
December 10, 2008, alleging licensee failed to pay delinquent license and late fees in the amount of
$130.00 and submit a list of massage practitioners currently operating on site; and
7 WHEREAS, licensee did not respond to the Notice of Intent to Suspend License to contest the
8 allegation or pay delinquent license and late fees and submit the required information; and

10 WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to contest the
11 allegation or pay the delinquent license and late fees and submit the required information by December 19,
12 2008, that the matter would be placed on the consent agenda to impose the recommended penalty; now,
13 therefore, be it

15 RESOLVED, that the Massage Center — B(Home Locarion) license held by Jill Alyssa Mimier

CM Massage for the premises located at 740 Mississippi River Blvd. So., in Saint Paul
License ID # 20070003297

The Deparkment of Safety and Inspections (DSI) has recommended suspension of the
Massage Center — B(Home Location) license held by Jill Alyssa Mimier d/b/a CM Massage for
the premises located at 740 Mississippi River Blvd. So., in Saint Paul. The basis for the
recommendation is as follows:
On November 21, 2008, you were sent a RENEWAL INVOICE from the
Department of Safety and Inspections indicating that your license had
expired effective July 23, 2008, and your license fees were delinquent.
The total amount now due is $130.00 ($87.00 in license fees and $43.00 in
late fees). As of today's date that payment has not been received.
You were also asked to submit a list of massage practitioners currently
operating on site. As of today's date that information has not been
received.
At this time, you have three options on how to proceed;
You can pay the license and late fees of $130.00. If this is your choice, you should make
payment directly to the Department of Safety and Inspections, at 375 Jackson Street, Ste. 220, St.
Paul, Minnesota 55101-1806 no later than Friday, December 19, 2008. Information should be
directed to the attention of Christine Rozek. A self-addressed envelope is enclosed for your
convenience. Payment of the license and late fees will be considered to be a waiver of the
hearing to which you aze entifled.

2. If you wish to admit the facts but contest the penalty, you may have a public hearing before the
Saint Paul City Council, you will need to send me a letter with a statement admitting the facts
and requesting a public hearing. We will need to receive your letter by Friday, December 19,
2008. The matter will then be scheduled before the Ciry Council for a public hearing to
determine whether to impose the license suspension. You will have an opportunity to appeaz
before the Council and make a statement on your own behalf.
If you dispute the above facts, you can request a heazing before an Administrative Law Judge. At
that hearing both you and the City will be able to appear and present witnesses, evidence and
cross-examine the other's witnesses. The St. Paul City Council will ultimately decide the case. If
this is your choice, please let me know by Friday, December 19, 2008, and I will take the
necessary steps to schedule the administrative hearing.
If I have not heard from you by that date, I will assume that you do not contest the
suspension o1'your Massage—B (Home Location) license. In that case, the matter will be placed
on the Council's Consent Agenda for approval of the recommended penalty.
