- RESOLVED, that the controverted claim asserted by Wm. H.
Ziegler Co., Inc., against the City of Saint Paul for the recovery of
$1305, as the equivalent of the then market value of 3 Model DD
,Hi Jay 'Spreaders, furnished and delivered by said Company to said City,
at the latter's instance, on November 22, 1955, then required therefor
and used by said City to meet an emergency wherein its failure to have
acted promptly would have resulted in injury to said City and its property
and which equipment has since been retained and used by said City,' exclu-
sively for municipal purposes with resultant benefit to said City in
amount equal to $450 per year for the first and second years of such use
and $300 per year for the additional thi:6d year -A£ such use, such annual
sums being in each case equal to-the market rental value of said equipment,
shall be fully settled and compromised, as now proposed, by the payment
of $1200 by said City to said Company, as and for rent for such use of
said equipment for said three consecutive annual periods provided that
thereby said City shall be granted by said Company the privilege to retain
and use said equipment -rent free thereafter without limitation and the
option to demand and receive from said Company a bill of sale of said
equipment without further charge or consideration, free of incumbrance;
RESOLVED FURTHER, that such settlement and compromise are
deemed necessary to provide against injustice and inequity and the con-
sequences of inadvertence in respect of strict requirements for prior
procedures in the premises. .
