1 WHEREAS, adverse action was taken against the Day Caze Food — Limited license application
2 submitted by At the Summit Preschool, Inc. d/b/a At the Summit Preschool (License ID#20080003496) for
3 the premises located at 1524 Summit Avenue in Saint Paul, by Notice of Intent to Deny License dated
4 April 3, 2009, alleging licensee failed to submit a copy of the executed/signed lease agreement, a letter of
5 permission from the landlord or proof of ownership for that location in order to complete the application
6 process; and
WHEREAS, the licensee did not respond to the Notice of Intent to Deny License to submit the
required documents, request a public hearing or withdraw her license application; and

11 WHEREAS, the Notice of Intent to Deny License stated that if the licensee failed to submit Che
12 required documents, request a public hearing or withdraw her license application by April 13, 2009, that
13 the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be

16 RESOLVED, that the Day Caze Food— Limited license application submitted by At the Summit
17 Preschool, Inc. d/b/a At the Summit Preschool is hereby denied.

Dear Ms. Miller:
The Department of Safety and Inspections (DSn has recommended denial of the Day Care Food -
Liznited license application submitted by At The Surrunit Preschool, Inc. d/b/a At The Summit Preschool
for the premises located at 1524 Summit Avenue in Saint Paul. The basis for the recommendation is as
follows:
On January 13, 2009 and again on February ?A, 2009, you were sent a letters
from the Department of Safety and Inspecdons (DSI) stating that your license
application was pending until the following requirement was met: Submit a
copy of the executedlsigned lease agreement, a letter of permission from the
landlord allowing this type of business operation or proof of ownership for the
location at 1524 Summit Avenue. You were given until March 9, 2009 to submit
the requested information. As of today's date the information has not been
received.
At this time you have three options on how to proceed:
1. You may submit a copy of the lease agreement, letter of pernussion or proof of ownership. If this
is your choice, you should send the information directly to the Department of Safety and
Inspections at 375 Jackson Street, Ste. 220, St. Paul, MN 55101-1806 no later than Monday,
April 13, 2009. Information should be directed to the attention of Christine Rozek. A self-
addressed envelope is enclosed for your convenience. Submission of the requested infotmation
will be considered to be a waiver of the hearing to which you aze entitled.

2. If you wish to admit the facts but contest the penalty, you may have a public hearing before the
Saint Paul City Council, you will need to send me a letter with a statement admitting the facts and
requesang a public hearing. We will need to receive your letter by Monday, April 13, 2009. The
matter will [hen be scheduled before [he City Council for a public hearing to detemiine whether
to deny your license. You will have an opportunity to appeaz before the Council and make a
statement on your own behalf.
3. You may withdraw your license application. Send a written statement to that effect to the
Departrnent of Safety and Inspections, 375 Jackson Street, Ste 220, St. Paul, Minnesota 55101-
1806 no later than Monday, April 13, 2009. Information should be directed to the attention of
Christine Rozek. Any request for a refund of the license applica[ion fee must also be made in
writing to DSI.
If I have not heard from you by that date, I will assume that you do not contest the denial of
your license. In that case, the matter wil] be placed on the Council's Consent Agenda for approval
of the recommended penalty.
