The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, May 6, 2009 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 700 SHERBURNE AVENUE. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. 3. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violarions at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies ar to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been corrected. 6. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. 7. That this building has been routinely monitared by Department of Safety and Inspections, Vacant/Nuisance Buildings. 8. In the event the building is to be demolished and removed by the City of Saint Paul, all 100 personal property or fixtures of any kind which interfere with the demolition and removal 101 shall be removed from the property by the responsible parties by the end of this time 102 period. SUMMARY FOR PUBLIC HEARING 700 Sherburne Avenue Legislative Hearing — Tuesday, April 14, 2009 City Council — Wednesday, May 6, 2009 The building is a two story wood-frame duplex dwelling, on a lot of 3,920 square feet. According to our files, it has been a vacant building since April 13, 2007. The current property owner is Charlotte Burke, per AMANDA and Ramsey county property records. There has been one (1) SUMMARY ABATEMENT NOTICE since 2007. There have been zero (0) WORK ORDERS issued. On December 2, 2008, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on January 6, 2009 with a compliance date of February 5, 2009. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. (Assessed 8/21/08. The foundation is deteriorated, defective or in a state of disrepair. Itepair all foundation defects in a professional manner to a weather-tight, water-tight and rodent-proof condition. Permit may be required. 7. The interior walls are defective. Repair all wall defects anfl finish in a professional manner. 8. The interior ceilings are defective. Repair all ceiling defects and finish in a professional manner. 9. The bathroom floor covering is deteriorated or inadequate. Provide floor covering which is impervious to water and easily cleanable throughout the bathroom and seal around the edges and fixtures. 10. The plumbing systems are in disrepair{missing components. The stairs have missing or defective handrails. Pro�ide all interior and exterior stairways and steps of more that three (3) risers with handrails which are grippable and instailed 34° to 38" above the nose of the stair treads. 13. The interior flooring is damaged. Repair/replace all damaged and missing flooring throughout dwelling. 14. FURNACE: Have a licensed heating contractor service and clean the fumace or boiler and make any necessary repairs. Perform a C/O test on the heating plant Then, send the attached form back to the Inspector. Repair of gas fired appliances requires a permit. 15. There is a lack of Water Service. 16. There is a lack of Natural Gas Service. 17. There is a lack of Electricity. As owner, agent or responsible party, you aze hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by February 5, 2009 the Department of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the building(s). The costs of this action, including administrative costs and demolition costs will be assessed against the property taxes as a special assessment in accordance with law. As first remedial action, a Code Compliance Inspection Report must be obtained from the Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-9090. Ordering the owner to remove or repair the building(s) at 700 Sherburne Avenue within fifteen (15} days from adoption of resolution. The property owner of record, Charlotte Burke, did not appeaz. Gene Burke appeared and stated that Charlotte was his mother and he was in litigation over ownership of the property. Steve Gauster also appeared with Mr. Burke. Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a two- story, wood frame, duplex on a lot of 3,920 squaze feet and had been vacant since April 13, 2007. A code compliance inspection had been done on February 5, 2Q09, the vacant building registration fees in the amount of $1,000 were paid by assessment on August 21, 2008, and the $5,000 perforxnance bond had not been posted. On December 2, 2008, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed, An order to abate a nuisance building was posted on January 6, 2009 with a compliance date of February 5, 2009. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Tasation estimated the market value of the land to be approximately $14,700 and the building to be $97,000. Real estate taxes for 2007-2008 were delinquent in the amount of $5,822, plus penalty and interest. Code Enforcement estimates the cost to repair the building to be approximately $60,000 to $80,000. The cost for demolition was estimated to be approximately $10,500 to �14,SOQ. There was also one summary abatement issued to this property since 2007 which did not go to work order. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1888 and was a late Victorian, Queen Anne-style building. She said she coi�ld not find an original permit; however, the building appeared to have possibly been built by an architect as it had similar characteristics to other houses built in the Dayton's Bluff neighborhood. It appeared from the photographs that the space built above the porch was not original and a lot of the original detailing had been altered. She said this property was located outside the potential Frogtown Historic District and the block face was contiguous. She did not believe this building contributed as a potentiai historic resource to the neighborhood. Ms. Moermond asked Mr. Burke what his intentions were for the property. Mr. Burke stated that his mother had walked away from the house and he would like to save it as he believed it had been in the family for over 70 years. He said that he was unemployed at the present time and did not have the financial resources to afford the repairs or to pay the taYes. His mother held the title to the property free and cleaz and since his brothers and sisters also held an interest, it was difficult to get all of them together to discuss the future of the property. He also did not want to make a large investment in the repairs if everyone else was also going to continue to hold an interest in it. He said it was his goal to get the title in his name and to obtain a loan to be able to afford the rehab. He said he had been maintaining the property, had ordered the code compliance inspection and believed he could do most of the work himself. Mr. Magner indicated to Mr. Burke that he would need to hire licensed contractors to do the mechanical and the electrical work. He would be able to pull the building permit to do the general work and suggested that he obtain bids from contractors so that he could get an estimate on the cost of the repairs. He also told Mr. Burke that he would need to have the title of the property in his April 14, 2009 Legislative Hearing Minutes name and would be required to post the $5,000 performance bond. 09-494 Page 7 Mr. Burke asked whether he would be able to obtain bids to do the demolition himself. Mr. Magner responded that he would need to have a signed contract with a licensed demolition contractor prior to May 6 when this was scheduled for Council Public Hearing. Ms. Moermond suggested laying this matter over to the April 30 Legislative Hearing. She also recommended the HPC review this property for a recommendation. Mr. Burke must have clear title to the property in order to be recommended a grant of time to repair the building. He will also be required to provide the following: 1) maintain the property; 2) the property taxes must be paid; 3) post the $5,000 performance bond; 4) present a work plan; 5) present bids from licensed contractors; 6) provide financial documentation demonstrating the ability to complete the repairs. The other options to explore is demolishing the building himself and he must have a signed contract with licensed demolition contractor prior to the May 6 City Council Public Hearing. She suggested he may also want to consider donating the property to a non-profit or may contact the HRA on donation of the property. -�.r 09-494 April 30, 2009 Legislative Hearing Minutes Page 3 2. Mr. Burke stated that his siblings had agreed to sign over the title to him and his mother had given him the abstract. He said that his wife worked for a title company and they were working on getting the title changed into his name and anticipated it to be completed by the end of next week. He said he had received a bid for the electrical and was requesting additional time. He also said that he had received a summary abatement order to remove boats that were on trailers in the backyard and he did not believe he should be required to remove them. NIr. Magner stated that since this was a vacant building, the zoning code did not allow exterior storage on a property. A trailered boat would only be allowed on an approved surface, after site plan review, on a property that was occupied. Ms. Moermond stated that the property had been in the family for a very long time, it had historic interest but the character had been lost. She said that since the taYes had not been paid for 2007 and 2008, the property would go taac forfeit soon if they were not paid. Mr. Manger stated that since the property was located in an accelerated area, it was scheduled to go tax forfeit in August 2009. Mr. Burke asked if he could negotiate payment of the back taxes. Mr. Magner responded that he would have to go to the County to discuss his options. Ms. Moermond asked Ms. Boulware when the HPC was scheduled to discuss this property. Ms. Boulware responded that it was scheduled for discussion at the May 14 HPC meeting. Ms. Moeromond stated that Mr. Burke would need to provide financial documentation demonstrating that he had $60,000 to $80,000 in financing available to do the rehab. She suggested he contact the Greater Frogtown CDC to find out if he was eligible for any funding through their organization. Mr. Burke responded that he had contacted the CDC and since his brother was going to be living at the property and not him, he did not qualify for any financing. He also said that he was applying for a grant to convert the property to a rehab facility. He said that finding financing at this time was going to be difficult since he was unemployed. He said that he already had many of the materials available to begin the rehab of the building; however, if it came to the building be bulldozed, he would rather donate the property to a non-profit organization. Ms. Moermond stated that she would recommend laying this matter over the May 26 Legislative Hearing and continuing the Council Public Hearing to June 3. She said she would require Mr. Burke provide the following at the next hearing: 1) plans to de-convert the building from a duplex to single-family home; 2) provide financial documentation indicating the financing in the amount of $60,000 to $80,000 to complete the project; 3) provide a work plan; and 4) the property must be maintained. Ms. Spong stated that there wasn't a quorum present for the meeting on May 14; however, of the five members in attendance, they recommended demolition be delayed to explore other alternatives for the property. She said that she believed the property on its own did not merit eligibility and it was located outside the potential Frogtown historic district. She said the basis for the recommendation was because of the location and the setting of the property. Since the integrity of the building was fair to poor, it did not have a strong relationship in context with the rest of the neighborhood. Mr. Magner stated that the main issues were the title to the property as Mr. Burke did not have clear title and did not have the financial capacity to rehab the building. Ms. Moermond stated that unless Mr. Burke contacted her with a proposal for the property, she would recommend the building be removed within 15 days with no option for repair.
