PAUL OFFICE OF THE CITY CLERK C.011Lm RESOLVED, By the Council of matter of condemning, taking and the following described property: 1-89299 COU NO. .Pouncil lu No. 189299 —By Mrs. Donald FORM DeCOw;,l. r:3, By the Covnr,l �s the Ci: I the City of Saint Paul, in the appropriating for roadway purposes That part of Lot 2, Block 1, College Place East Division bounded by the following described lines: Commencing at the southwest corner of said Lot 2, thence north on the west line of said lot a distance of 40 feet to a point; thence in a southeasterly direction on a straight line to a point on the south line of said Lot 2 that is 128 feet east of the aforesaid southwest corner as measured on the south line; thence west on the south line of said Lot 2, Block 1, College Place East Division to the point of beginning; as duly ratified by the Council on May 21, as Council File 1875+1, that the award of $4,300.00 for the taking of the aforesaid hereby is increased so that the same shall - -� of damages in.the amount of $5,100.00; 1958, by Resolution known damages in the sum of property shall be and be and represent an award RESOLVED FURTHER, That the aforesaid increase in respect to the award of damages shall be contingent upon the dismissal of the pending purported appeal to the District Court of Ramsey County, Minnesota by Aagard Building Company, a Minnesota Corporation, by the Order of said District Court to be made and filed therein within twenty days next after.'the date hereof and is provided to be made hereunder pursuant to the recommendation and request of the Department of Public Works of the City of Saint Paul and of the City Valuation Engineer; RESOLVED FURTHER, That the award of damages as so increased, subject to the aforesaid contingencies, shall be payable from the City of Saint Paul Bond Fund 200, Project ST -10 Comptroller's PIR Fund L 5933 -5 or other funds of the City available for the payment of the same.
