1 WHEREAS, D�iail;lnext of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a one and one half story, wood frame, single family dwelling located on property
4 hereinafter referred to as the "Subject Property" and commonly known as 717 MERCER
5 STREET. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before October 20, 2008,
the following are the now known interested or responsible parties far the Subject Property:
Bristol Properties LLC, 339 Taronto St, St. Paul, MN 55102; Collier Financial, Inc, 3432
Denmark Ave, #184, Eagan, MN 55123; West Seventh/Fort Road Federation.
WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an arder identified as an"Order to
Abate Nuisance Building(s)" dated January 5, 2009; and
WHEREAS, this order informed the then lrnown interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by February 5, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been conected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, April 14, 2009 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

or responsible parties to make the Subject Property safe and not detrimental to the public peace,
heaith, safety and welfaze and remove its blighting influence on the community by rehabilitating
this structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolirion of the structure to be completed within fifteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, May
6, 2009 and the testimony and evidence including the action taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 717 MERCER STREET.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition suUject to demolition.
7. That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 ha�e been fulfilled.

and removing the structure in accordance with all applicable codes and ordinances. The

2. If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property ar fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a one and one-half story, woodframe single-family dwelling, on a lot of 4,792
square feet.
According to our files, it has been a vacant building since January 29, 2008.
The current property owner is Bristol Properties, LLC, per AMANDA and Ramsey county
property records.
The city has had to board this building to secure it from trespass.
There have been three (3) SiJMMARY ABATEMENT NOTICES since 2008.
There have been two (2) WORK ORDERS issued for:
- Removal of improperly stored refuse and misc debris
On December 9, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NLTISANCE BUILDING was posted on January 5, 2009 with a compliance date of
February 5, 2009. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees aa paid. (Assessed 3/27/09, pending 90 days — 6/25/09.)
Taxation has placed an estimated market value of $3Q000 on the land and $54,100 on the
building.
As of February 3, 2009, a Code Compliance inspection has been completed.

may also be required to post a five thousand dollar ($5,000.00) performance

Repair the structure to a habitable condition.
This structure is a registered vacant building that must have a Code Compliance
Certificate befare the structure may be occupied. Obtain a Code Compliance
Certi�cate from the Department of Safety and Inspections. You may contact Jim
Seeger at D.S.I., 651-266-9016, for a code compliance inspection, permits, and
issuance of the Code Compliance Certificate. Under Chapter 33.03 of he Saint
Paul Legislative Code, failure to obtain a Code Compliance Certificate before
occupying the structure may result in issuance of criminal summonses.
As owner, agent ar responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by February 5, 2009 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-9090. This
inspection will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condition.
Tf this building is located in a historic district or site (noted above, just below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for
the repairs required by this order and compliance with preservation guidelines. Copies of the
guidelines and design review application and forms are available from the Department of Safety
and Inspections web site (see letterhead) and from the HPC staff. No permits will be issued
without HPC review and approvaL HPC staff also can be reached by calling 651-266-9078.
As an owner ar responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and

any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The deparhnent is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accardance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
acrion, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

procedure if lead base paint is present (See St. Paul Legislative Code, Chap. 34 for

ELECTRICAL
1. Ground the electrical service to the water service with a copper conductor within 5' of the

4. Verify/install a separate 20 ampere laundry circuit & a separate 20 ampere kitchen

Hendrie Grant, Bristol Properties, LLC, appeared. No other parties of interest�appeazed.
Ms. Moermond asked for a report from Mr. Magner. Mr. Maener stated the building was a one and
one-half story, wood frame, single-family dwelling on a lot of 4,792 square feet and had been
vacant since January 29, 2008. A code compliance inspection had been done on February 3, 2009,
the vacant building registration fees in the amount of $1,000 went to assessment on March 27, 2009,
and the $5,000 performance bond had not been posted. On December 9, 2008, an inspection of the
building was done and a list of deficiencies which constitute a nuisance condition was developed.
An order to abate a nuisance building was posted on Tanuary 5, 2009 with a compliance date of
February 5, 2009. To date, the property remained in a condition which comprised a nuisance as
defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land
to be approximately $30,000 and the building to be $54,100. Real estate taxes were. Code
Enforcement estimates the cost to repair the building to be approximately $100,000 to $125,000.
The cost for demolition was estimated to be approximately $10,500 to $14,500. There had also
been three summary abatements issued to this property since 2008, two of which went to work
order: to secure the building and the City had to board the building to secure it from trespass, and
remove improperly stored refuse and debria Code Enforcement recommends the building be
repaired or removed within 15 days. Mr. Magner presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was a circa
1890, brick worker's cottage-style building that had been inventoried; however, she was not sure if
it was done as part of the survey work in 1983. She said she would need to request the inventory
form from the Ramsey County Historical Society. She said this area had been significantly altered
in that Mercer used to be a through street to West Seventh and was now a cul-de-sac. She said she
was wavering between recommending rehabilitation or demolition.
Ms. Moermond asked Mr. Hendrie what his plans were for the property. Mr. Hendrie responded
that he had purchased the property in May 2008 and had attempted to rent it out. He now had it
listed for sale; however, the real estate market was so down, he hadn't found anyone interested in
purchasing it. He said that now that it was a category 3 vacant building, he wasn't sure what he
wanted to do. He said he was not interested in doing the rehabilitation himself as he did not believe
it was economically feasible to do so.
Ms. Moermond told Mr. Hendrie that he would need to make some decisions on what he intended to
do with the property. He had several options: he could find someone interested in doing the rehab
to the building in exchange for title to the property; he could allow the City to demolish the
building, in which case the cost would become an assessment against the property; he could donate
the property to the W est Seventh/Fort Road Federation; or donate the property to the HRA.
Ms. Mcermond recommended laying this matter over to April 3� in order for Mr. Hendrie to
determine what to do with the property.

Mr. Magner stated that at the last hearing, Mr. Grant was not clear on what he wanted to do with the
properiy. Ms. Moermond reviewed the letter that Ms. Vang had sent outlining the conditions.
Mr. Grant stated that he had expected the HPC to contact him concerning the historical significance
of the property before he would make a decision on what he wanted to do. Since he did not hear
from the HPC, he had received one bid to do the rehabilitation in the amount of $97,100 and was
waiting to receive another bid.
Ms. Boulware stated that the building was not historically designated and would not require HPC
review for any exterior repairs to the building. She provided Mr. Grant with a copy of the inventory
form.
Mr. Grant stated that he had realtors go through the house who said that once the building was
rehabbed, they believed it could be marketed far $160,000. He said he currently he owed $4Q000
on the mortgage and it made sense to him to proceed with rehabilitation plans; however, he would
need more time.
Ms. Moermond stated that he would need to provide proof of financing in the amount of $100,000
to $125,000 which was what staff had estimated the cost of the rehabilitation to be.
Mr. Grant responded that he did not currently haue the money available as it was tied up in a project
that he was doing in Minneapolis which he believed would be completed by July. Once that project
was completed and the property was sold, and he believed it would sell, he would have the
financing available to complete this project. He said he did not haue any other financing options
available to him.
Ms. Moermond stated that she could not recommend a grant of time contingent upon financing that
may become available after a project was completed sometime in July. She said she would require
Mr. Crrant provide the following: 1) post the $5,000 performance bond; 2) provide a wark plan
outlining the rehab to be completed within six months; 3) provide financial documentation in the
amount of $100,000, which could be in the form of a construction loan or line of credit; 4) provide
an affidavit dedicating the funds to this project; and 5) the property must be maintained. Ms.
Moermond said that the $5,000 performance bond and the proof of $100,000 in available financing
would need to be provided by the close of business on Friday, May 1. If Mr. Grant did not meet
these conditions, she would not recommend a grant of time.
Mr. Magner stated that the inspector was at the property on Apri121 and issued orders to secure the
front door. He did not know if the property was in compliance as the inspector had not been back to
re-inspect the property. Mr. Hendrie responded that as soon as he received the order, he went to the
property that day and secured the door. He said that there was no history of abatements at flie
property as he was maintaining it himself.
