(See attached map).' The property is described "as follows: "Commencing at a point on the North line of the Northwest Quarter of:.Section 27., Township 29, Range 22, 139.47 feet West of the Northeast corner of the Northwest Quarter of the Northwest Quarter of said Section 27; thence South 00081 East 423 feet to the point of beginning of the land to be described: thence South along last described line 893.58 feet to the South line of said Northwest Quarter'of the'Northwest Quarter;, thence West along said South line of the "Northwest Quarter of the Northwest Quarter 488.51 feet to a point which is 33 feet East of the West line of East 1/2, of the Northwest Quarter of Northwest Quarter of said Section 27; thence North along a line 33 feet East of the West line of the East 1/2 of said NW'Quarter of the NW Quarter 782.18 feet to its intersection with the Easterly Line of Prosperity Avenue; thence Northeasterly along the Easterly line of Prosperity Ave. 136 feet, thence' East parallel with the Northerly line of said NW Quarter 411.89 feet to the point of beginning, according to the United States Government Survey thereof, except the South 100 feet thereof, and except the East 100 feet thereof. " The Department of Finance reports that thirty-eight, out of a possible forty -one, or 9, of the owners of the several descriptions within 100 ft. of the area to,be reclassified have consented to this petition. On May 22, 1958, the Department of Finance reported as sufficient, a petition to rezone certain property at this location. Subsequently, on July 23, 1958, this petition was reported insufficient. On July 30, 1958' the applicant filed the present petition which is- before the City Council and which was reported sufficient by the Department of Finance on August 29, 1958. This second rezoning petition covers the same area as the first petition except for a reduction of 100 ft. along the east property line. The property under consideratinn was zoned "Heavy industry1t when the Zoning Ordinance was adopted in 1922. In December of 1947, in order to prevent the construction of a filling station adjacent to the A. 0 City Clerk - re:I. Rein - 9/18/58 -2- northwest corner of Maryland and Birmingham, this property, as part of a much larger area, was rezoned to "A" residence. The property under consideration has a frontage of 682.18' along Clar- ence Avenue and extends easterly a distance of some 388.51 ft. It has an area of approximately 6.96 acres. This property is presently vacant. The surrounding area is primarily vacant with residential and single - family homes and a filling station to the north between the applicant's property on Maryland Avenue. To the .south of this area, a strip of land 100 ft. in depth fronting Magnolia Avenue will remain in an "A" . residence district. Vacant property is on the east and west. The applicants propose to establish a neighborhood shopping center on this property. The Board of Zoning has reviewed the proposed land use based on the smaller area of the present petition and find that no sub- stantial change in the development of this property would occur over the previous development because the applicant owns property across Clarence Avenue to the west which is zoned "light industry'' and which property will be used for off - street parking in place of the-,property removed from the area to be re- classified as found in the first petition. Therefore, the Board of Zoning wishes to re- affirm its previous re- commendation contained in a letter dated July 2, 1958, that this is a proper location for a neighborhood shopping center and, therefore, the Board of Zoning recommends that this petition to re -zone this property to commercial be granted.
