Presented
WHEREAS, Department of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a one story, wood frame, single family dwelling located on property hereinafter
referred to as the "Subject Property" and commonly known as 1384 ASBURY STREET. This
property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Depariment of Safety and Inspections on or before October 20, 2008,
the following are the now known interested or responsible parties for the Subject Property: Lake
Community Bank, PO Box 636, Long Lake, ZMN 55356; Benjamin Tourville, 733 Hidden
Valley Lane S, Cottage Grove, MN 55016; Chris Cowner, 44A Iglehart Ave, St. Paul, MN
55103; Standke, Green & Greenstein, 17717 Highway 7, Minnetonka, MN 55345; District 10
Como Community Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated January 6, 2009; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by February 5, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, April 14, 2009 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighting influence on the community by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
demolition of the structure to be completed within Pifteen (IS) days after the date of the Council
Aearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, May
6, 2009 and the testimony and evidence including the action taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT I2ESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1384 ASBURY STREET.

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. ThaY an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

86 accordance with all applicable codes and ordinances. The demolition and removal of the
87 structure must be completed within fifteen (15) days after the date of the Council
88 Hearing.

90 2. If the above corrective action is not completed within this period of time Deparhnent of
91 Safety and Inspections is hereby authorized to take whatever steps aze necessary to
92 demolish and remove this structure, fill the site and chazge the costs incurred against the
93 Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative

3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind wkuch interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul sha11 remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

as defined by Lagislative Cade, Chapter 45. The Department of Safety and Inspections has
issued an ozder to the then lmown responsibfe parties to eliminate this nuisance condition by
correcting the deficiencies or by razing and removing #his building(s}.
The property was re-inspected on February 5, 2009. 'Phere was no compliance and the nuisance
condirion remains unabated, the community continues to suffer the blighting influence of this
property. It is the recommendation of the Department of Safety and Inspections that the City
Council pass a resoludon ordering the responsible parties to either repair, or demolish and
remove this building in a timely manner, and failing that, authorize the Department of Safety and
Inspections to proceed to demolition and removal, and to assess the costs incurred against the
real estafe as a special assessment to be collected in the same manner as taxes.

The building is a one story, wood-frame, single-family dwelling, on a lot of 5,227 squaze feet.
According to our files, it has been a vacant building since June 30, 2008.

The current property owner is Lake Community Bank, per AMANDA and Ramsey county property
records.
There have been three (3) SUMMARY ABATEMENT NOTICES since 2008.
There had been one (1) WORK ORDER issued to board the building and secure it from trespass.
On November 10, 2008, an inspection of the building was conducted, a list of defaciencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on January 6, 2009 with a compliance date of
Februazy 5, 2009. As of tlus date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees are paid. (Good thru 7/3/09.)

The Vacant/Nuisance Buildings Unit, Department of the Department of Safety and
Inspecrions, Division of Code Enforcement, hereby declares the premises located at:

and legally described as follows, to wit:

to comprise a nuisance condirion in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 4511.
On November 10, 2008, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspecdon and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.

This building(s) is subject to the reshictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a one story, wood frame, single family dwelling.
Below is a summary of a recently completed Code Compliance Inspection by James
Seeger dated September 3, 2008.
BUILDING
1. Replace damaged or missing siding; weather seal and air seal exterior.
2. Remove exterior storage.
3. Install floor covering in the bathroom and kitchen that is impervious to water.
4. Provide thumb type dead bolts for all entry doors. Remove any surface bolts.
5. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty
etc. as necessary.
6. Provide storms and screens complete and in good repair for all door and window
openings.
7. Repair walls and ceilings throughout as necessary.
8. Provide hand and guardrails on all stairways and steps as per attachment.
9. Prepare and paint interior and exterior as necessary (take the necessary precautions if
lead base paint is present).
10. Any framing members that do not meet code (where wail and ceiling covering is
removed, members that are over-spanned, over-spaced, not being carried properly,
door and window openings that are not headered, etc.) are to be reconstructed as per
code.
1 l. Provide generai clean-up of premise.
12. Provide smoke detectors as per the Minnesota State Building Code.
13. Repair soffit, fascia trim, etc. as necessary.
14. Provide proper drainage around house to direct water away from foundation.
15. Replace house roof covering and vent to code.
ELECTRICAL
1. Install new 100 amp service and raise mast for alley clearance.
2. Bring property to Bulletin 80-1.
3. Ground the electrical service to the water service within 5' of the entrance point of
the water service.
4. Bond azound water meter with a copper wire sized far the electrical service per
Article 250 of the NEC.
5. Provide a complete circuit directory at service panel.
6. Verify/install a separate 20 ampere laundry circuit and a separate 20 ampere kitchen
appliance circuit.
7. Verify that fuse(circuit breaker amperage matches wire size.
8. Close open knockouts in service panel/junction boxes with knockout seals.

19. Install hard-wired, battery backup smoke detectors as specified in Bullerin 80-1 and
other smoke detectors as required by the IRC.
20. Remove and/or rewire all illegal, improper or hazardous wiring in basemenUgarage.
PLUMBING
All plumbing work requires permit(s) and must be done by a plumbing contractox licensed in
Saint Paul.

The range gas shutoff, connector or gas piping is incorrect.

HEATING

1. Install approved lever handle manual gas shutoff valve on fumace.
2. Clean and Orsat test furnace burner. Check all controls for proper operation.
Check fumace heat exchanger for leaks; provide documentation from a licensed
contractar that the heating unit is safe.
3. Install chimney liner.
4. Replace furnace flue venting to code.
5. Connect furnace and water heater venting into chimney liner.
6. Vent clothes dryer to code.
7. Appropriate gas mechanical permits are required for this work.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not cozrected by February 5, 2009 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taYes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Bualding Inspection and Design Section, 375 7ackson Street, Suite 220, (651)266-9090. This
inspection will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condition.
If this building is located in a historic district or site (noted above, just below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for
the repairs required by this order and compliance with preservation guidelines. Copies of the
guidelines and design review application and forms are available from the Department of Safety
and Inspecfions web site (see letterhead) and from the HPC staff. No permits will be issued
without HPC review and approval. HPC staff also can be reached by calling 651-266-9078.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, a11 present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declazes it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk`s Office.

If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement acrion is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Couneil at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what acrion if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified tnne, the City shall abate this nuisance. The costs of tlus
acrion, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

3. Install chimney liner.
4. Replace furnace flue venting to code.
5. Connect furnace and water heater venting into chimney liner.
6. Vent clothes dryer to code.
7. Appropriate gas mechanical permits are required for this work.

3. Ordering the owner to remove or repair the building(s) at 1384 Asburv Street within fifteen
(15) days from adoption ofresolution.
The property owner of recard, Lake Community Bank, did not appear. No other parties of interest
appeared.
Mr. Magner stated the building was a one-story, wood frame, single-family dwelling on a lot of
5,227 square feet and had been vacant since June 30, 2008. A code compliance inspection had been
done on September 3, 2008, the vacant building registration fees were current, and the $5,000
performance bond had not been posted. On November 10, 2008, an inspection of the building was
done and a list of deficiencies which constitute a nuisance condition was developed. An order to
abate a nuisance building was posted on 7anuary 6, 2009 with a compliance date of February 5,
2009. To date, the property remained in a condition which comprised a nuisance as defined by the
Legislative Code. Ramsey County Taxation estimated the market value of the land to be
approximately $69,900 and the building to be $1,800. Real estate taxes were current. Code
Enforcement estimates the cost to repair the building to be approximately $50,000 to $60,000. The
cost for demolition was estimated to be approximately $10,500 to $14,500. There had also been
three summary abatements issued to this property since 2008, one of which went to wark order: to
secure the building and the City had to board the building to secure it from trespass. Code
Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner
presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1938; however, according to the Sanbom Map, it appeared that there may have been a house
constructed on the front of the lot given the faz set back of the current house. She said she did not
believe demolition would haue an adverse effect on the neighborhood.
Ms. Moermond recommended the building be removed within 15 days with no option for repair.
