1 BE IT RESOLVED, that, upon the petition of the St. Paul Port Authority ("Petitioner") as
2 documented in Office of Financial Services Vacation File Number O1-2009, the public property
3 described in the attached Exhibit A is hereby vacated and discontinued as public property and, subject
4 to the following conditions, the easements within said public property are hereby released:

1. An easement shall be retained on behalf of the City of Saint Paul, Department of Public
Works, for its existing facilities.
a. The petitioner, its successors and assigns shall only vacate Seminary Avenue and
Hubbazd Street rights-of-way.
b. The petitioner shall be responsible for all expenses to eliminate the appeazance of
public right-of-way on both vacated streets. This shall include, but not be limited to
the reconstruction and(or construction of new curb, gutter, sidewalk, boulevazd,
storm sewer facilifies and sign changes, all to the satisfaction of the Departments of
Public Works, Police and Fire & Safety Services.
c. The petitioner shall be responsible for, at its cost, the construction and dedication of
a new cul-de-sac on the west end of vacated Seminary, to the satisfaction of the City
of Saint Paul, Deparhnents of Public Works, Police and Fire & Safety Services, said
conshuction will be done under a permit issued by Public Works Street
Engineering. Said cul-de-sac shall be dedicated to the City of Saint Paul with at
least 10 feet of right-of-way beyond the new curb for boulevard azea.
d. If relocation of the facilities is"required, the petitioner, its successors or assigns,
sha11 assume all costs of relocation and shall provide new easements for said
relocated facilities, and shall meet the following requirements of the City of Saint
Paul to the satisfaction of the Department of Public Works.
2. An easement shall be retained on, over and across the vacated area on behalf of the Board of
Water Commissioners of the City of Saint Paul to reserve the right of the Board to maintain
and operate any water facility in or upon said easement, and to enter upon said easement, or
any portion thereof, at any time and from time to time for the purposes of future construction,
reconshuction, inspection, maintenance or repair of the same; or any part thereof. Said
easement shall be subject to the following requirements:
a. No buildings, structures, trees or any temporary structure, material storage, fixture,
or any other objects which may prohibit norxnal access to water facilifies for
maintenance purposes will be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the
Boazd from exercising it reserved rights may be allowed by obtaining written

pemussion from Saint Paul Regional Water Services with the understanding that the
restoration and costs of such improvements shall be the sole responsibility of the
petirioner, its successors and assigns in the event the Board exercises its reserved
easement rights.
c. Should it be necessary that the peritioner's works or improvements be removed or
daxnaged as a result of Saint Paul Regional Water Services operations, all removal,
replacement or modification costs shall be borne solely by the petitioner.

f. The petitioner, its successors and assigns shall fully indemnify, defend, and save
harmless the Board of Water Commissioners of the City of Saint Paul, its officers,
agents, employees, and servants from all suits, actions or claims which sha11 arise
from any injuries or damages received or sustained by any break in any service pipe,
water main, or connection in said reserved easement, arising out of or resulting from
any action or negligence of the petitioner, its employees, agents or business invitees.
3. An easement sha11 be retained on behalf of Northern States Power Company, dba Xcel Energy
(Gas), for its existing gas distribution facilities. If relocation of the facilities is required, the
petitioner, its successors or assigns, shall assume all costs of relocation and shall provide new
easements for said relocated facilities.
4. An easement sha11 be retained on behalf of Northern States Power Company, dba Xcel Energy
(Electric), for its existing electrical facilities, which are over under and across the southerly 20
feet of vacated Hubbard Avenue. If relocation of the facilities is required, the petitioner, its
successors or assigns, sha11 assume all costs of relocation and shall provide new easements for
said relocated facilities.
5. An easement shall be retained on behalf of Comcast for its existing facilities. If relocation of
the facilities is required, the petitioner, its successors or assigns, shall assume all costs of
relocation and shall provide new easements for said relocated facilities.
6. This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1,
1981, of the Saint Paul Legislarive Code as amended.
The petitioner, its successors and assigns shall pay $1,200.00 to the City of Saint Paul as an
administrative fee for this vacation which is due and payable within 60 days of the effective
date of tlus resolution.

8. The petirioner, its successors and assigns shall, within 60 days of the effective date of this
resolution, file with the Office of Financial Services/Real Estate Section, an acceptance in
writing of the conditions of this resolution and shall, within the period specified in the terms
and conditions of this resolution, comply in all respects with these terms and conditions.
9. The petifioner, its successors and assi�s agree to indemnify, defend and save hazmless the
City of Saint Paul, its officers and employees from all suits, actions or claims of any character
broug�t as a result of injuries or damages received or sustained by any person, persons or
ptoperry on account of this vacation, or the petitioner's use of this property, including but not
limited to, a claim brought because of any act of omission, neglect, or misconduct of said
petitioners or because of any claims or liability arising from any violation of any law or
regulation made in accordance with the law, whether by the petitioner or any of its agents or
employees.

development. The City's Real Estate fund will receive $1,200 in fee revenue for this

I recommend a public hearing before the City Council be held on MaY 6, 2009 to
consider the petition of the Saint Paul Port Authority.
This petition is to vacate part of Hubbard Street between Chatsworth Street and
Pierce Butler Route, and to vacate part of Seminary Avenue east of Chatsworth
Street and west of Pierce Butler Route.
The purpose of this vacation is to for petitioner to assemble abutting properties and
re-develop the area.
This property is located in City Council Ward 1, Planning District 7.

Paul, respectfully states and alleges that it is the fee owner of record of the real
estate abutting those portions of streets and right of way to be vacated pursuant

would normally accrue to the Port Authority and will facilitate the orderly

The Port Authority believes that vacating the eastern portion of Hubbazd Street between
Chatsworth and Pierce Butler and the eastern half of Seminary Avenue between
Chatsworth and Milton Street will serve to promote better land use and zoning objectives
both generally and most specifically for its property and, upon information and belief,
will also serve to promote safer and better traffic flow as we11.
Like with much of Saint Paul, the neighborhood's public roads have been platted on a
straight north/south and easUwest configuration creating strict geometric rectangular
blocks of property between the public roadways for development. In the immediate
vicinity, however, Pierce Butler, a ma}or arterial route, cuts across on a northwestf
southeast diagonal creating some problematic traffic flows, access matters, and property
configurations.
Pierce Butler's diagonal slice of Chatsworth and Hubbard has resulted in two very close
access points. Both Chatsworth and Hubbard Street connect to Pierce Butler, separated
by about 200 feet, due to their intersection approximately 100 feet south. As a result,
Hubbazd Street is a very short portion of road providing no access benefits to the
contiguous properties or the neighborhood. On the contrary, due to its short stretch,
Hubbard Street serves as a poor connection to Pierce Butler. In addition this short stretch
of Hubbazd Street slices off and creates a small triangle of property immediately to its
north, bounded by Chatsworth Street to the west, Hubbard Street to the south, and Pierce
Butler to the northeast. This smail triangle is non-buildable and has no other potential
uses due its small size and configuration. Vacating Hubbard Street east of Chatsworth
wil] relieve the City of maintenance responsibilities and return this property to good use,
as well as the small triangular property to the north, and better support the Port
Authority's use of its properiy to the south.
Seminary Avenue is the first easUwest street south of Pierce Butler. Given its closeness
to Plerce Butler, Seminary Avenue is not an appropriate thoroughfare and is a poor
divider of properiy. Furthermore, it is understood by the Port Authority that an
immediate left hand turn by a vehicle exiting Pierce Butler onto Seminary Avenue or a
turn by a vehicle from Seminary to Milton onto Pierce Butler is one of the worst designed
traffic flows possible. Thus, vacation of this portion of Seminary Avenue would benefit
the public, the neighborhood, and the surrounding property.

We will approve the vacation of oniy Seminary and Hubbard Street Right
of Way.
The petitioners shall be responsible for the removal or reconstruction of the street to
eliminate the appearance of public right-of-way. This shall include, but not be limited
to, reconstruction and/or construction of storm sewer structures, curb, gutter,
sidewalk, and boulevard, to the satisfaction of the City of Saint Paul Department of
Public Works. Any costr for removal of street signs and streets lights shall be the
responsibility af the petitioner.
The peUtioners shall be responsible for the construction of a cul-de-sac on the west
end of vacated Seminary, to the satisfaction of the Department of Public Works (and
emergency services) under a permit issued by Pubiic Works Street Engineering.
The new cul-de-sac will need to be dedicated to the City with at least 10 feet of right-

east of Chatsworth.
The purpose of this vacation is to allow the developer/owner to remediate soil, as needed, on the property prior to sale for future
