Johnson for a permit to establish a new building line on property located adjacent to the northeast corner of Birming- bam Street and York'Avenue. This property is described as the westerly 50' of both lots 13 and•14; Block 2; Fairchild's Rearrangement of Lots 8 15 in- elusive of Block 11, Cruicksbanks Garden Lots.. This property has been zoned 'W' Residence since 1922. The propeity under consideration has a frontage of 50' along York Avenue and 127' *along Birmingham Street. Under the existing platting, the set back requite- ments are 36' from Birmingham Street and 6' from York Avenue. The applicant proposes to construct a single family home on this, property set back 22' from Birmingham Street•and 30' from York Avenue. A petition favorable'to the.,proposed development signed by the one property owner to the north has been filed. The adjacent land uses are as follows: east and adjacent are two single family residences fronting,on York Avenue; to..the south are single family residences one fronting on York Avenue and the other on Birmingham Street; to the north and west is vacant land. The proposed home will be set back in line with the two existing residences the east on York Avenue. The Board of.Zoning finds that the strict application of the present set-back requirements from York Avenue results in practical difficulties in the development of thi's property, and that the proposed.use and change in the building line, if granted, will not be materially detrimental to the adjacent property. In consideration of these factors and the favorable sentiment of the property owner-to the north, the Board of Zoning recommends that a 22' building line on Birmingham Street for lot 13 and the south 101 of Lot 14, and that a 301 building line for Lot 13 along York Avenue be established in accordance with..-. the applicant's letter dated August 15, 1958. The property lies at York St. and Birmingham the North side of York St. I purchased the property intending to set back 30ft. from York St.. and 8ft.. from { Birmingham St.. The building line on York St. is 30ft, back at the present time. The City Code specified a 30ft. set back from the street according to the original plot.. This request is fo1r, a royal according to Article 3, ;Section 16, Appendix paragraph nd I of the Zoning Ordinance. Land in question covers an areal of 6350sq..ft.. I believe the interests of everybody will. be better served if building is allowed here, the land would lie useless otherwise and a loss incurred to me of $1400..00..
