WHEREAS, on August 6, 2008, the City Council, in C.F. #08-767, granted 120 days for the rehabilitation
or removal of the building(s) at 651 Hawthorne Avenue East; and
4 WHEREAS, the performance deposit required under Legislative Code Chapter 33 was forfeited for lack of
5 progress;and
7 WHEREAS, significant progress has been made in the rehabilitation of the building(s), although the 50%
8 mazk was not met in a timely fashion; and
10 WHEREAS, given this progress, it was advisable to conduct a legislative hearing to review plans for the
ll completion of the rehabilitation under a different project manager; and

13 WHEREAS, acceptable plans for the conclusion of the rehabilitation were reviewed by the Legislative
14 Hearing Officer and Vacant Building Manager; and

WHEREAS, the financial capacity of the property owner to complete the rehabilitation was demonstrated
and an affidavit committing the appropriate funds to this project were submitted and approved by the
Legislative Hearing Officer and Vacant Building Manager; and
WHEREAS, a second performance deposit in the amount of $5,000 was submitted to the City.
NOW THEREFORE, BE IT RESOLVED, that the Saint Paul City Council hereby grants 45 days for
completion ofthis rehabilitation.
