RESOLVED, that -upon appeal of The Board of Christian
Service, from the decision of the Commissioner of Parks, Play-
grounds and Public Buildings, .a 15 foot building line is hereby
established for Lots 1, 2 and 3, Block 12, Brewster's Addition,
situated on the east side of Capitol Boulevard between the
north line of Charles Avenue and the south line of Como Avenue,
except that commencing at a point in the east line of said
Capitol Boulevard 80 feet north of said north line of Clarles
Avenue, thence running north along said east line of said
Capitol Boulevard a distance of 7 feet to a point, said building
line shall be coincident with said east line of said Capitol
Boulevard for said distance of 7 feet, as shown on the attached
plan of said Block; that accordingly, the building line applicable
to said lots, comprising the entire frontage in said Block on
the east side of said Capitol Boulevard, shall represent a line
15 feet distant from and parall @l to said east line of said
Capitol Boulevard except that the same shall be coincident with
said east line of said.Capitol Boulevard for the distance of 7
feet, aforesaid, commencing in said east line of said Capitol
Boulevard at a point 80 feet north of'the north line of said
Charles Avenue"" thence running north along said east line a
distance of 7 feet to a point.

Dear Sir:,
This is in the matter of the appeal of the Board of Christian Services to
establish a building line on a portion of their property located adjacent
to the northeast corner of Capitol Boulevard and Charles Avenue in connection
with the construction of an infirmary. The property under consideration is
described, as-lots 1, 2 and 3, Block 12, Brewsters' Addition. Briefly. tY�
The applicant is the owner of all the property on the east side of Capitol ,
Boulevard between Charles Avenue and Como Avenue. In addition to the proposed
infirmary,, there is a nurses' home located in the north one- half.of the block.
In consideration of this fact, the Zoning Board finds that the- applicant'rs
proposal is not a radical one from the standpoint of its' effect on adjoining .
property uses, or visual appearance.
In consideration of these factors, the Zoning Board recommends this appeal be
granted in accordance with applicant's petition dated April 28, 1958, subject,
however, to the council granting permission to construct the proposed infirmary.

The undersigned, owner of all of the real estate hereinafter
described and constituting all of the properties in the subject block,
to -wit: ,
Lots One (1), Two (2), Three (3), Four (4), Five (5)
and Six (6), Block Twelve (12) of Brewster's Addition
to St. Paul, according to the plat thereof on file and
of record in the office of the Registerrof Deeds of •
Ramsey County, Minnesota;
hereby petitions your Honorable Body for the establishment of a building
line in that block, which building line differs from that which would
otherwise be established by Ordinance No. 5540, as amended, Zoning Code,
City of Saint Paul Legislative Code, Chapter 60 to 64 inclusive. The
establishment of such building line at variance-with that which otherwise
would be established by said Zoning Code, is necessary for the requirements
of the now proposed Bethesda Lutheran Infirmary to be constructed, maintained,
and operated by your petitioner on its following described real estate, to =wit:
Lots One (1), Two (2), and Three (3), Block Twelve -(12)
of said Brewsterts Addition to St. Paul.
Such variance is required to accommodate the construction, main-
tenance, and use of a canopy as shown by the site plan submitted by Messrs.
Magney, Tusler & Setter, Architects, to the City of Saint Paul Zoning Board
on or about April 4, 1955; and which site plan is hereby incorporated herein
by reference and made part and parcel of this petition. There is hereto
annexed a sketch of the subject block upon which is diagrammed, by this
petitioner, the building line of the buildings existing izm said block on
August 22, 1922,, and which are in existence at the time of this petition;
the building line proposed by this petitioner hereunder, and the building
line ast' established by the provisions by the provisions of said Chapter 62, all
�Imeasurements being to the nearest foot.
