An ordinance amending the Zoning Code, Chapters 60
to 64 inclusive, of the Saint Paul Legislative Code,
pertaining to Use Districts, Height Districts and
Rezoning of certain properties in the City of Saint
Paul. This is an emergency ordinance rendered
necessary for the preservation of the public peace,
health and safety.
. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapter 60 to 64
inclusive, of the Saint Paul Legislative Code, pertaining to
Use Districts, Height Districts and Rezoning of certain properties
in the City of Saint Paul, as amended, be and the same is hereby
further amended so as to rezone Lots 1, 2 and 3, Block 12,
Brewster's Addition, located at the northeast corner of Capitol
Boulevard and Charles.Avenue, in Class "C" Residence District,
from Height District I to Height District II.
Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation of
the public peace, health and safety.
Section.3. This ordinance shall take effect and be in force
upon its passage, approval and publication.

Dear Sir:,'-
This is in the matter of the petition of the Board of Christian Services to
change the classification of the Height District prescribed in the Zoning
Ordinanc6as it affects the northeast corner of Capitol Boulevard and Charles
Avenue. This property is described as Lots 1, 2 and 3, BI ' ock 12, Brewsters'
Addition to St•. Paul. The Zoning is "C" residence. This petition has been
acquiesced in by 9 out of 12, or 690 of the property owners within 100'.
The applicant's petition proposes that the above area be reclassified from
Height District I to Height District II. Under the Zoning Ordinance, Height
District I limits the height of a building to 40' excdpt that said building
may be constructed in excess of 40' if the building is set back from the lot
line I' for each additional foot of height in excess of the 401 that is desired.
The architects for the Board of Christian Services have completed working draw-
ings and",plans for a new six story infirmary with a maximum total height of
72' above street grade. This proposed infirmary cannot be constructed under
existing;,Heigbt District I regulations, therefore, they have submitted a'suffi-
cient petition signed,by the adjoinind-property owners asking the Council to
change the Height classification to Height District II which permits a height
up to 75?,. The structure proposed by the applicant would be permitted in Height
DistrictiII. It is the intention of the applicant to build only four stories
at present.and the two additional stories would be added at a later date.
The applicant states that this proposal is one element in their long range plan
for development of the Bethesda Hospital which was commenced since World War II.
A similar petition was granted by the City Council in 1952 for the applicant on
property immediately adjacent on the north to permit the construction of a
nurses' home. The proposed building will complete the development of the
applicant's property on the east side of Capitol Boulevard between Charles
Avenue and Como avenue., In consideration of the fact that the required number
of adja nt property owners have expressed their consent to this reclassification,
and that this change would be in the public interest and would not materially
affect t ' be adjoining property, and that it will improve the applicant's operation
and service that this hospital is rendering to the community, and further, that
the Board of Christian Services will provide satisfactory off-street parking,
not only�for this proposed facility but for their entire development, the Board
of Zoning finds that this petition is a reasonable one, and therefore recommends
that it be granted, subject, however, to the Council granting permission to
construct the proposed infirmary.

In support of petitions for permission to construct and operate
Bethesda, Lutheran Infirmary and to reclassify the real estate upon which
it is to be built from Height District I to Height District II, we respectfully
represent and showy y
1:;�That said Bethesda Lutheran Infirmary is to be built as soon as funds
are available upon the site shown in the site plan submitted herewith.
2. That said building is to be of semi -fire proof construction. Materials
for its construction to be:
I . Reinforced concrete footings and foundation.
b. Structural steel frame, fireproofed as required by code.
c. Interior partitions - nonbearing clay tile, plastered both sides.
d. Exterior materials - Artstone reinforced concrete panels,
aluminam windows and double glazing.
The size of the building is to be 100 by 100 feet with 10,000 square feet
per floor. The floor to floor height will be 12 feet.
The ultimate planned height of the building is 6 stories, with a total
height of 72 feet above grade. Immediate plans call for a four story building
with footings, foundation and structural steel frame sufficient to carry two
additional stories.
The building is to be used for the care of old, infirm, sick or diseased
persons.
We, are planning to begin construction of this building in the summer of 1958.
If any farther information is required, we shall be glad to furnish it.
Messrs. Magney, Tusler & Setter, 303 Roanoke Building, Minneapolis 2, Minnesota,
are the architects, who are planning this building and will supervise its construction.
They will be glad to furnish any additional information relating to the construction
of this building that may be required or desired.
