from Arcade Street to the west line of Lot 15, Block 18,
Oakville Park; and to construct and install a storm water
sewer at right angles to the north and south lines of said
Lot from the public sewer in Geranium Avenue through the
easterly 4 feet of the west 12. feet of said Lot to the
center line of said public alley. This is an emergency
ordinance rendered necessary for the preservation of the
public peace, health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That permission and authority are hereby .
given to Klein Super Markets „Inc. to grade and surface with
bituminous material the alley in Block 18, Oakville Park,
from Arcade Street to the west line of Lot 15, Block 18, Oak--
ville Park, and to construct and install astorm water sewer=
at right angles'to the north and south lines of said Lot
from the public sewer in Geranium Avenue through the easterly
4 feet of the west 12 feet of said Lot to the center line of
said public alley, and the Commissioner of Public Works is ,.
hereby authorized to issue a permit thexefor to said Klein
Supex,Markets, Inc. upon its compliance with the following con-
ditions, viz: 1
1. Said permittee shall grade and surface said
alley and construct and install said storm.watex
sewer entirely at its own cost and expense, under
the supervision and subject to the direction of the
Commissioner of Public Works, and in accordance with
plans and specifications to be approved by the Chief
Engineer of the City of Saint Paul.

2. Said permittee shall pay unto said City -as
and for full reimbursement, the equivalent of the
Cityts cost of necessary engineering and inspection
hereunder, and the equivalent of the cost of pub-
7 lication of this ordinance.
3. Prior to the inception of the work here-
under, said permittee shall procure from the
abutting owners such easements in and to the
abutting property as may be necessary for slopes,
cuts and fills, and shall obtain a written release,
releasing and discharging the City from any and
all damages by reason of the grading and surfacing
of said alley, such to be done at its own cost and
expense.

4. Said permittee, at its own cost and
expense, by sufficient deed, shall convey or
cause to be conveyed unto said City of Saint
Paul, a perpetual public sewer easement four.
feet in width throughout its course, in, upon,
under and through the - easterly 4 feet of the west
12 feet of Lot 15, Block 18, Oakville Park, for
the maintenance and operation of said storm water
sewer therein, subject to the approval of the
Corporation Counsel, and shall be delivered to t
said City on.or before August 1, 1958.
5. Said permittee shall furnish a bond of
$5,000.00 to the City of Saint Paul, conditioned
to comply with all the terms of this ordinance
and to indemnify and save the City harmless from
any and all loss, liability, judgments, suits,
x costs,':charges, damages or expense that may accrue
to person or property occasioned by the grading
and surfacing of said alley and the construction and
installation of said storm water sewer.
6. Said permittee shall, within ten days
after the publication of this ordinance, file a
written acceptance thereof with the City Clerk,
Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation of
the public peace, health and safety.
Section 3. This ordinance shall take effect and be in
force from and after its passage, approval and publication.

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
