Mississippi River within the jurisdiction of the City,�rf Sain Pa;ja the following firms WHEREAS, to aid and help the Bureau of Police of the Department of Public Safety in controlling and patrolling the river traffic on the Mississippi River within the jurisdiction of the City of Saint Paul, the following firms have offered to give and donate the equipment hereinafter mentioned to the said Bureau of Police for temporary use, without charge, during the summer,period of 1958, to -wit: The Alumna Craft Boat Company to furnish for use, an 18 foot aluminum boat; The Scott - Atwater Manufacturing Company for furnish a 40 horse -power outboard motor for use on said boat; The C & F Machine'Works of Saint Paul to furnish a suit- able trailer fitted for said boat; and WHEREAS, the traffic on the Mississippi River within the boundaries of the City has increased in volume in an amount necessitating greater patrolling efforts on the part of this City Department, and WHEREAS, it is recognized that the offer made by these concerns of this equipment for use during the limited period of the summer of 1958 will be of invaluable aid to the Department, now therefore be it RESOLVED; 1. That the Bureau of Police is hereby author- ized to accept the temporary loan of the equip- ment set out hereinabove for the purposes described. 2. That the said concerns are hereby extended thanks by the Council on behalf of the Depart- ment for this temporary loan. Dear Mr. Hurley= April 15, 1958 13`{6 Res Our File No. AW "tio Own Due to the expanded interest in boating particularly on the Mississippi River, it has become necessary to extend the control and man -power of the Police Harbor Patrol. Our interest is to control this water traffic within the city of St. Paul for the safety of our citizens who are engaged in this pastime. Further, we wish to be prepared for any emergency or water rescue operation, As our budget does not include funds for necessary Harbor Patrol equipment at this time, we have been assured by the following companies the loan and use of their equipment, free of charge, to be used in the control and patrolling of river traffic in our area. 1 The Aluma Craft Boat Company will furnish the Police Department with an 18 foot aluminum boat; The Scott - Atwater Manufacturing Company will furnish a 40 H.P. outboard motor; and the C & F Machine Works of St.`Paul will furnish a suitable trailer fitted for this boat. t It is agreed by these three companies that they will assume only the liability of wear fromthe use of this equipment by the Police Department. Any damage to this equipment due to accident, or property damage caused by this equipment, will be assumed by the City of St. Paul, Mr. Marshalli F. Hurley, Corporation Counsel, April 15, 1958, Page. two It is further agreed that this equipment will be used exclusively by the St. Paul Police Harbor Patrol on official police duty from April 5, 1958, until October l5, 1958, at which time this property, will' be returned to the respective owners. -It is re esteU7hat we receive an opinion as to the legality of the acceptance, use, and liability of this equipment. As we have no known water craft equipment and operation safety ordinance, we have been advised by Mr. Arthur Kruse, Rear Commodore of the local Coast Guard Auxiliary, that such a safety ordinance can be enacted by the City of St. Paul in co- ordination with existing federal regulations affecting water craft equipment, and operation on navigable waters within the St. Paul city limits. It is further requested that we receive an opinion concerning a proposed water - safety enforcement ordinance. Attached is a copy of a letter recently received from F. P. Vetterick, Commander, U.S. Coast Guard, St. Louls, Missouri, who was misinformed and believes St. Paul already has enacted a water - safety ordinance. Also attached is a clipping from an editorial in the St. Paul Dispatch of April 10, 1958. We have installed two signs, one at the Harriet Island boat ramp, and one at Hidden Falls boat ramp. Both signs explain general rules of safety concerning equipment and operation of boats. Photos of the sign, boat, motor, and trailer are enclosed.
