COUNCIL RESOLUTION— GENERAL FORM

RESOLVED, that Richard Noack and Donald Walseth be per-
mitted to install and operate a used car sales lot at the
southeast corner of West Seventh Street and Sherman Street,
on Lot 9, Block 28, Rice and Irvinets Addition, according to
the plat thereof on file and of record in the office of the
Register of Deeds in and for Ramsey County, Minnesota, in
accordance with applicants' plans approved March 26, 1958, and
subject to the limitation that no more than three cars for sale
be located on the premises at any one time, and subject to the
further condition that sidewalks abutting said premises be kept
clean and free of ice and snow at all times.

The City Council requested that you prepare a resolution granting,the
attached application of Richard Noack and Donald Walseth for permit to
install and ,operate a used car lot at the southeast corner of W. Seventh
St. and Sherman St. on Lot 9, Block 28, Rice and Irvine's Addition,
in accordance with applicants' plans approved March 26, 1958, and subject -'
to the limitation that no more than 3 cars for sale be located on the
property at any one time.

This is in the matter of the application of Richard Noack and Donald
Walseth for a permit to install and operate a used car lot on the pro-
perty located adjacent to the southeast corner of West Seventh and Sher-
man. This property is described as Lot 9, Block 28, Rice and Irvine's
Addition, except that 'part taken for the West Seventh Street widening.
The zoning is Commercial. .
The property under consideration has a frontage of 60' along West Seventh
Street and extends southerly for a distance of 130' along Sherman Street.
The property is presently being used for filling station purposes and the
proposed used car lot will be incidental to the primary filling station
use.
The adjacent land uses are as follows: north across Seventh Street are
various retail uses with apartments on the second floor; south and ad-
joining is a drive -way to the Elk Laundry which business is located
immediately to the east, fronting on West Seventh Street; west and ad-
joining is -tbe intersection of West Seventh, Sherman and Ramsey Streets.
The Field Investigation discloses no basic objection to the proposed use
and the Traffic Engineer has approved the proposed layout and operation.
In consideration of these factors, the Board of Zoning recommends that
this permit be granted in accordance with applicant's plans approved
March 26; 1958, and further, with the limitation that no more than three
cars for sale be located on the property at any time.
