2 ECONOMIC DEVELOP FOR CONTAMINATION INVESTIGATION AND CLEANUP GRANTS
3 FOR THE RENAISSANCE BOX AND PENFIELD SITES

5 WHEREAS, the City has identified environmental investigation and clean-up projects within the City that
6 meet the purposes and criteria of the Contamination Investigation and CZeanup Grant Program of the
7 Department of Employment and Economic Development; and
8
9 WHEREAS, the City finds that the required contamination cleanup will not occur through private or other
lo public investment within the reasonably foreseeable future without DEED'S Contamination Investigation
u and Cleanup Grant ProgNam funding;

t3 NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Saint Paul, Minnesota
14 hereby approves the contamination investigation and cleanup grant applications submitted to the
15 Department of Employment and Economic Development by the City of Saint Paul for the Renaissance Box
16 and Penfield sites; and

�8 BE IT FURTHER RESOLVED, that the City of Saint Paul, Minnesota agrees to act as legal sponsor for
19 the projects contained in the cleanup grant applications submitted to DEED on May 1, 2009 and that the
2o Director of the Department of Planning and Economic Development is hereby authorized to apply to
21 DEED on behalf of the Renaissance Box and Penfield sites; and
22
23 BE IT FURTHER RESOLVED, that the City has the legal authority to apply for financial assistance, and
24 the institutional, managerial and financial capability to ensure adequate project administration; and
25
26 BE IT FURTHER RESOLVED, that the sources and amounts of the local match identified in the
27 applications are committed to the projects identified; and
28
29 BE IT FURTHER RESOLVED, that the City of Saint Paul certifies that it has not violated any Federal,
3o State or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest, or other
31 unlawful or corrupt practice and that it will comply with all applicable laws and regulations as stated in the
32 contract agreements; and

34 BE TT FURTHER RESOLVED, that upon approval of its applications by the Department of Employment
35 and Economic Development the City of Saint Paul may enter into agreements with the State of Minnesota
36 for the above-referenced projects, and that the City of Saint Paul certifies that it will comply with all
37 applicable laws and regulation as stated in all contract agreements; and

39 BE IT FINALLY RESOLVED, that tl�e Mayor and City Clerk of the City of Saint Paul are hereby
4o authorized to execute such agreements as are necessary to implement the projects on behalf of the
41 applicant.
