WHEREAS, an amended resolurion
Council File 09-301; and

of the Cinco de Mayo sofrball tournament is needed for previous
VTFIEREAS, the Riverview Economic Development Association (REDA) holds a block pariy permit for the Cinco de Mayo
holiday; aad
WHEREAS, Saint Paul Parks and Recreation is assisting in The organization of a two day softball tournament to be held on May
2" and May 3` 2009 m conneaion with the Cinco de Mayo holiday, but sepazate from the block party, to be held at the El Rio
Vista ballfields; and
WHEREAS, REDA has control of the area within the block party permit limits, which includes the ballfields on which the
tournament would take place, and wishes to be indemnified in the event of any claims resulting from the tournament because it
is being held within the block party area; and
WHEREAS, the Saint Paul City Council finds that this athletic event is a legitixnate public pwpose which fosters a stronger
West Side community and acknowledges the Cinco de Mayo holiday; and
RESOLVED, that the Council of ffie City of Saint Paul on behalf of the City of Saint Paul hereby agrees to defend, indemnify,
and hold REDA harmless from any and all suits, claims, actions, or judgments for injuries arising out of the softball tournament;
and
FURTHER RESOLVED, that the foregoing defense and indemnification does not cover any occurrences or events which are not
part of the toumament and which do not occur or take place at the EI Rio Vista ballfields during the course of the tomvament,
nor injuries which arise out of cruninal actions, assaults, batteries or other acts of violence couunitted by any person or person;
and be it
FURTHER RESOLVED, that nothing in the foregoing provisions shall be construed as a waiver of the municipal tort liability
limits set forth in Minn. Stat § 466.01 et seq.

Pazks and Recrearion is assisting in the organization of a two day softball toumament to be held on May 2 and May 3, 2009 in
connection with the Cmco de Mayo holiday, to be held at the El Rio Vista ballfields. REDA (Riverview Economic Development
Association) holds a block par[y permit for the Cinco de Mayo event, which includes the ballfields at EI Rio. REDA wishes to be
indemnified for any claims resulting from the [oumament.
