ICI ,i.�l,ll� Dear Mr. Dillon; Two weeks ago I attended a meeting of the City Zoning Board at which a petition concerning the rezoning of our block was discussed and voted upon. My name is Herbert M. Schoenecker, Jr. and I live at 820 Lincoln Avenue. I bought this.house;one:year.ago to accomo date my increasing gamily and to get close to schools and church. Oneof the most appealing things about the house is its location in this beautiful residential district. In the year we have lived here we have found the area clean, pleasant and quiet and considered ourselves fortunate to find these surroundings in which to raise our children. So you can see our concern and why we signed this petition on finding that one of the large residences, number 815, dir- ectly across the street from ours was to be commercialized and made into a rooming house. We all know that this type'of business can rapidly deteri- orate any residential area not to mention the particular bur- den it will place on our parking facilities and the lessen- ing of our property talues. I beg of you, Mr. Mayor, to consider the loss did all of ` us for the benefit of one. Allow us to rezone our block to Class "Ali which for all practical purposes it has been since 1928, and keep our neighborhood for which it was intended - family living. Sincerely, Herbert M. This property is described as Lots :l to'14 Incl. Block 16, and Lots 15 - 28 incl. Block 17, Summit Park Addition., The property under consideration has been zoned "B`r Residence since the adoption of the Zoning Ordinance in 1922. The .owners of 36 out of 46, or 78% of the several descriptions located within 100' of the area sought to be re- classified, have consented to this petition, and approximately 8110 of the frontage involved within the area sought to be re- classified have signed this petition. The property under consideration is completely developed. The land uses are as follows: 13 single family homes, 4 two family homes, 2 four unit structures and one ten unit apartment building. The attached map illustrates the present use of the property in the area in relationship to those owners whose names appear on the petition. When the Zoning Board considered this matter, several of the owners of property in the block to be rezoned appeared in favor of this petition, and a Mrs. Ethel Mayeron, one of the owners of 815 Lincoln, with her attorney, appeared in opposition to the proposed zoning reclassification. Mr. Firestone, attorney for Mrs. Mayeron, told the Board that his client . objected to the rezoning of this property on the grounds that the recent purchase of this property at 815 Lincoln was made only after an,intensive examination of the records in the Building Department and the Planning Board, which research showed that his client would be permitted to conduct a group type facility for girls'(rooming house) who are attending the University, or a College, or a Business or Professional school, and which use could be prohibited if the Council grants the pending petition. Mrs.;Mayeron advised the Zoning Board that the proposed occupancy of this home would be for 8 girls., There have been two families living in this structure for the past several years. The proponents of the rezoning petition felt that the rezoning of this property was needed at this time to retain the basic single family char- acter of the neighborhood, and thereby protect the use of the homes in the area for family dwellings. Furthermore, this rezoning would prevent the neighborhood from rapidly deteriorating, which, in their opinion, would occur by permitting uses similar to the use proposed by Mrs. Maye on at 815 Lincoln. Paul, Minnesota Gentlemen: I am. writing you regarding a petition calling for the rezoning of our block - 800 Block of Lincoln Avenue Summit Park Addition 07205, Lot 9, Block 16) from Zone B ..to A. It is my understanding,that the Rezoning Board has - recommended the disapproval of this request. I feel that the decision is unjust because leaving our property in Zone B, and thereby permitting rooming houses and other type of residential development, would have a deteriorating effect on our investment. I further feel that because of precluding circumstances this area so defined.above should originally have been zoned_a's Class A. It appears to me on the surface at least, that some unethical practices are taking place and partisanship is being shown on behalf of special minority interests. I feed that our Zoning Board and our City Council should con - tinue to act on behalf of the citizens as a whole. N 1 Murdock Donohue - 2 The Zoning Board, with the benefit of the testimony of the interested parties involved on both sides of this issue, are of the opinion that the "B" Residence classification should'be retained in this instance, on the grounds that the owners of 815 Lincoln who, before the recent purchase of this property, checked the public records and.determined that the proposed use of a group type facility for 8 young women was proper in "B" residence, and purchased the property on this basis. The Board further felt that the proposed use of the property at 815 Lincoln for 8 persons would not be detrimental to the adjoining pro- perty, and would not increase the population density of this-area since, if this petition is granted, the size of the property at 815 Lincoln would legally permit two family occupancy. Therefore, the Zoning Board recommends that this. petition to re- classify from-"B" Residence to "A" Residence both sides of Lincoln Avenue be- tween Avon and Victoria be denied.
