WHEREAS, the City Council, by Resolution, Council File
186995, approved April 15, 1958, concurred in a resolution
adopted by the Board of Water Commissioners April 10, 1958 for
the letting of a contract between the Board of Water Commissioners
and Intrusion - Prepakt, Incorporated, for certain preliminary
testing work in connection with the stabilization of the east wall
and adjacent sections of the north and south walls of the Snelling
Avenue Reservoir, and I
WHEREAS, the preliminary testing work conducted by
Intrusion- Prepakt, Incorporated, pursuant to the agreement between
the Board of Water Commissioners and said Company for such pre-
liminary testing work has now been completed, and
WHEREAS, the General Manager of the Water Department,
and Toltz, King, Duvall, Anderson and.Associates, Incorporated,
recommend that a contract be let between the Board of Water
Commissioners and Intrusion - Prepakt, Incorporated, for the stabil-
ization of the east wall and adjacent sections of the north and
south walls,.the extent of the walls to be stabilized being
approximately 600 feet, and
WHEREAS, the Board of Water Commissioner's; under "the
terms of the proposed agreement, would pay the contractor,
Intrusion- Prepakt, Incorporated, at the rate of $4.10 per cubic
foot measured on dry volume basis but not to exceed the total
sum of $25,000.00, exclusive of the testing woxk completed under
the previous agreement and exclusive of an option which would
permit the Water Department to require additional test pipes to
be inserted, for the sum of $25.00 per pipe, not exceeding 30 feet
in length, plus all cost of intrusion material required, at the
rate of $3.72 per cubic foot measured in dry volume, and
WHEREAS, the operation of Intrusion- Prepakt, Incorporated,
- involves the use of certain patented processes, and

WHEREAS, further, the work at the Snelling Avenue
Reservoir hereinbefore referred to is urgently required at
the present time, and constitutes an emergency which, if not
accomplished at once, may jeopardize a substantial portion of
the City's water supply, now therefore be it
RESOLVED, that in accordance with the recommendations
of the General Manager of the Water Department of the City of
Saint 'Paul, in letter dated April 30, 1958, directed to Marshall
F. Hurley, Corporation Counsel, letter of Toltz, King, Duvall,
Anderson and Associates, Incorporated, dated April 28, 1958,
addressed to the Board of Water Commissioners of the City of
Saint Paul, and letter of Intrusion - Prepakt, Incorporated, dated
April 28, 1958, addressed to Mr. A. J. Duvall, signed by George
A. Rodin, District Manager of Intrusion - Prepakt, Incorporated,
the Corporation Counsel is hereby authorized and directed to prepare
an agreement between the Board of Water Commissioners and Intrusion -
Prepakt, Incorporated, to effectuate the work of stabilizing the
aforementioned walls, in accordance with the terms and provisions
as set forth in the letters hereinbefore referred to and made a
part hereof by reference; be it
FURTHER RESOLVED, in connection with the existing
emergency, that upon consent by the Mayor and the Comptroller
of the City of Saint Paul, endorsed hereon, the aforementioned
agreement shall be entered into forthwith, without requiring a
call for bids for the work of stabilizing the aforementioned walls.
