An ordinance granting permission to Willard Linder
Contracting; Inc. to grade Conway Street from Hazelwood
Street to Birmingham Street, Birmingham Stret from East
Third Steet to Conway Street, Barclay Street from Conway
Street to Wilson Avenue, and Wilson Avenue from the
westerly line of Lot 7, Block 8, Willard Linder Addition
No. 2 to the west line of Lot 13, Block 6, Willard Linder
Addition No. 2. This is an`emergency ordinance rendered
necessary -;•for the preservation of the public peace, health
and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That permission and authority are hereby
given to Willard Linder Contracting, Inc. to grade Conway
Street from Hazelwood Street to Birmingham Street, Birmingham
Street from East Third Street to Conway Street, Barclay Street
from Conway Street to Wilson Avenue, and Wilson Avenue from
the westerly line of Lot 7, Block 8, Willard Linder Addition
No.,2 to the west line of Lot 13, Block 6, Willard Linder
Addition No.2; and the Commissioner of Public Works is hereby
authorized to issue a permit therefor to said Willard Linder
Contracting,. Inc. upon its compliance with the following
conditions, viz:_
1. Said permittee shall grade said streets
entirely at its own cost and expense, and to the
satisfaction and under the supervision_ of the _
Commissioner of Public Works, and in accordance
with plans and specifications approved by the
Chief Engineer of the City of Saint Paul.
2. Said permittee shall pay the cost of

3. Before entering upon or doing any of

saidlwork, said permittee shall procure from

the abutting owners'. such easements in and to

the abutting property as may be necessary fort
slopes, cuts and fills, and shall obtain a

written release, releasing and discharging the

City from any and all damages by reason of the

grading of said streets.
4. Said permittee, after the inception
of said work, shall prosecute the same con -
tinuously, with diligence,'and complete said
work on or before July 1, 1959.

conditioned to comply with all the terms and
conditions of this ordinance,,and to indemnify
and save the City harmless from any and all

after the publication of this ordinance, file

Street from East Third Street to Conway Street, Barclay Street
from Conway Street to Nilson Avenue, and Wilson Avenue from,
the westerly line of Lot 70 Block 8, Millard Linder Addition
No. 2 to the west line of Lot 13, Block 6, Willard Linder
Addition No.,2; and the Commissioner of Public Works is hereby
authorized to issue a permit therefor to said Dillard Linder
Contracting, Inc. upon its compliance with the following
conditions., viz:
1. Said permittee shall grade said streets
entirely at its own cost and expense,, and to the
satisfaction and under the supervision of the
Commissioner of Public Works, and in accordance
with plans and specifications approved by the
Chief Engineer of the City of Saint Paul.
2. Said permittee shall pay the cost of
