Laid over Summary Abatement Assessments: J0901 C Demolition of vacant buildings during Tanuary 2008 719 Case Avenue (J0901C) Sui Lui Fung, property owner appeazed with Leong Hiu. Ms. Moermond reviewed the letter translated from Chinese into English by Mr. Fung which was presented at the March 17 hearing. A copy of said letter is attached and made a part of these minutes. Ms. Moermond stated that the City was not in violation of deanolishing the building and she recommended approval of the assessment. She told Ms. Fung that if they wished to attend the Council Public Hearing on April 15, a Chinese interpreter would be present at the hearing. �, 1 ��,?(% St. Paul City: I am Ken Du Fung and am the owner of 719 Case Avenue, St. Paul MN 55105, the ownership change was executed on June 4, 2008 and title was officially transferred on July 3Q [2008]. At the time of sale, the real estate agent and the seller did not advise me that the property was to be torn down after hearing. I did not learn of that unril I received a letter from the City demanding repair of the property. I went to the City to learn more information on July 25, 2008. On the same day I obtained a permit for repairs. 1. A deposit in the amount of $5,000 was made on July 25, 2008. #590689. 2. A building permit was obtained on July 25, 2008 at a cost of $36420. Permit number was 2008/21309. 3. I paid $533 as appraisal fee on July 31. Payment # 591332. The repair appraisal was received on September 22. 4. I paid $1,000 as vacancy fee on September 25. 5. I paid the real estate taxes in the amount of $1,692 on September 23. 6. On September 26, I signed an agreement with Discount Home Center Inc. for heating and water repairs. '7. During the two months between obtaining building permit on July 25 and September 27, my wife and I hired Mr. Chen for the interior repair, which was 70% complete. S. On July 22, we attended the hearing in Room 330 of the City and agreed to do what the City required. 9. We went to Room 330 of the City at 5:3� pm on August 20 and presented our repair funding plan and repair plan. 10. We went again to Room 330 of the City at 10:00 am on September 9 and presented again our repair and funding plans. I 1. We went to Room 33� of the City on October 6, 2008 and delivered our funding letter ftom the bank and the agreement with Discount Home Center Tnc. to the official. 12. I prepared the above docuznents and explained that I would do as planned after my trip to China from September 25 to November 18. 13. However, the City notified us on October 20, 2008 that 719 Case Avenue was to be torn down. 14. We wrote the City on October 31, 2008 asking the demolition plan be cancelled so as to give us the opportunity to repair. 15. Our attorney wrote to the City on November 26 requesting the demolition plan be abandoned but to no avail. 16. On December 2 we discovered that the demolition had started and again asked our attomey to negoliate with the City but again to no avail. 17. On Mazch 2, 2009 we received the letter from the City asking us to pay flie demolition cost of $23,034.88, which was not reasonable. We did not agree to pay because the City was in violation of law for demolishing my property. I have been objecting to such act. I hereby request that the City compensate me for ffie loss of 719 Case Avenue. Otherwise, I expect to sell 719 Case Avenue to the City at the same price it was purchased. Thank you. I am on a business trip to China starting September 29, 2008 and retuming on November 18, 2008. With respect to the repair and plans on 719 Case Avenue, St. Paul, MN 55106: L I have attended four hearings in Room 303 of the City and have made repa'u plans accoxding to your suggesrion and have partially completed the interior repairs. 2. I paid a deposit of $5,000 in August 2008 and subsequently paid over $800 on two occasions to obtain the building permit. Interior repairs have already started. 3. I have made arrangements for the heating, water and other repair plans and have entered into agreements for such repairs. According to the agreements, a11 work will start upon my return on November 18 and will be completed within two months thereafter. 4. On October 6, a friend on my behalf delivered my bank statements and repair agreements to Room 3Q3 of the City. 5. While I am away from the United States, I have not completed and submitted the plan but I have made the plans on seeezal occasions. I have also paid the deposit and obtained the building permit pursuant to your plans. Now that not even half a yeaz has passed, why are you notifying me of your intent to tear down the property? This is not fair or reasonable. I do not agree with your plan to demolish the property. Why is it not possible for me to complete the repair and start a business? I am asking the City to cancel the plan to demolish. Thank you.
