Whereas, A contract was entered into

WHEREAS, a contract was entered into between the City
of Saint Paul and the Gangl Excavating & Grading Company', Inc.,
Contract No. 58 -G -1015, for the grading of Iowa Avenue from
Payne'.Avenue to Arcade Street; Idaho Avenue from Parkway Drive to
Arcade Street; Greenbrier Street from Montana Avenue to Parkway
Drive; Walsh Street from Montanai:Avenue to Iowa Avenue, and
Weide Street from Montana Avenue to Idaho Avenue, said contract
also providing for construction of .a storm sewer in Weide Street
from 4T.owa Avenue to Idaho Avenue; and
WHEREAS, a request has been made to raise the grade of
Weide Street approximately one and one -half feet from the south
line of Lot$ 1, Block 3, Phalen View, to the south line of Idaho
Avenue, and on Iowa Avenue from approximately 125 feet west of
Weide Street to approximately 100 feet east of Weide Street,
which,request was made by the owner of the abutting property,
the Parkview Development Company, through its President, Lpuis
P•. Gilbert; and
_ WHEREAS, said owner has signed the Department of Public
,,Works slopes releases granting to the City the additional slopes
r needed in making the change of grade; and
WHEREAS, this change will be mutually beneficial to the
abutting property owners and to the Gangl Excavating & Grading
Company,.Inc. and will be and can be accomplished without addi-
tional compensation;and
WHEREAS, the Department of Public Works recommends the
aforementioned change, now, therefore, be it
RESOLVED, That the Council of the City of Saint Paul
hereby authorizes the aforementioned change upon acceptance in
writing, filed with the Public Works Department and the Parkview
Development Company, of the Gangl Excavating & Grading Co., Inc.
of the terms and conditions of this.Resolution.
