An ordinance granting permission to Grudem Bros. Company,
Inc.,,,to construct, at its own expense, a public sewer in the
Northern Route from Minnehaha Avenue to approximately 585 feet -;
north of the center line of Minnehaha Avenue, 'for the purpose
of serving the following described properties: Lots 1 through
8 in Block 12, Butterfield Syndicate Addition No. 2; that part
of Block 13, Butterfield Syndicate Addition No. 2 lying between
Dale Street and the Northern Route; that part of Block 16,
Butterfield Syndicate Addition No. 2 lying between Dale Street
and the Northern Route; vacated Seminary Avenue between Dale Street
and the Northern Route; vacated Englewood Avenue between Dale
Street and the Northern Route; the vacated alley in Block 13,
Butterfield Syndicate Addition No. 2 lying between Dale Street
and the Northern Route; and the vacated alley in Block 16,
Butterfield Syndicate Addition No. 2 lying-between Dale Street
and the Northern Route. This is an emergency ordinance rendered
necessary for the preservation of the public peace., health and
safety.

Section 1.' That permission and authority are hereby granted

- 1. Said permittee shall construct said sewer
entirely at its own expense, under the supervision
and`to the satisfaction of the Commissioner of
Public Works and in accordance with the plans and
specifications approved by said Commissioner and
the Chief Engineer.

2. Said permittee shall pay the cost of
engineering and inspection of said work, and
for the publication of this ordinance.
3. Said permittee shall properly protect
all excavations made in the street, both day and
night, so as to avoid all damage or injury to person
or property, and shall properly fill and tamp said
street to avoid settling and shall restore said
street to its original condition.
4. Said permittee, after the inception of
said work, shall prosecute same continuously,
with diligence, and fully complete said work, to
the stisfaction and approval of said Commissioner
on or before September 1, 1958.
5. Said permittee shall furnish a bond to -
the City of Saint Paul in the sum of Ten Thousand
Dollars ($10,000.00), conditioned to comply wish
all- the terms—of—this ordinance and to indemnify and _
save harmless said City from all liability, charges,
loss, judgments, suits, costs or expense that may
accrue to persons or property occasioned by the
making of said improvement or arising out of the same.
6. Said permittee shall, within ten days after
the passage and publication of this ordinance, file
A written acceptance thereof with the City Clerk.

Section 3. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservadon
of the public'peace, health and safety.
Section'4;. This ordinance' shall take effect and be in
force'upon;its� passage, approval and.publication.
