Mr. Joseph Okoneski City Clerk Building, Dear Sir: February 21, 1958 This is in the matter of the appeal of Solomon and Jennie Berde for the City Council to relax'tbe strict application of Section 2 of the Zoning Ordinance for a permit.to erect a 20 unit'apartment building in accordance with the.provisions of Section 20, paragraph "'1 -(2)" of the Zoning ordi- nance which authorizes the Council to grant a permit for an apartment building,in an 'W' residence district on a tract of land embracing three platted lots and immediately adjoining a commercial district.. This pro - perty is'located 100 feet south of Jefferson on the East side of Snelling Avenue and is described as lots 3, 4, and 5, Block 12, Sylvan Park. This propertyrhas been classified as, "AY °`residence since 1922 when the Zoning ordinance was adopted. The property under consideration bas. a frontage of 150' along Snelling Avenue and extends easterly to a depth of 122.5'. Briefly, the applicant proposes to sell this property for the purpose of a prospective owner constructing a two story 20 unit apartment building with 8 units on the first and second floor each, and four units in the basement. Each apart - ment will have a'living room, bedroom and kitchen- dinette. The proposed apartment building will be set back 12' from Snelling Avenue and will have a frontage of 130' along Snelling Avenue and a depth of 52 li". The site plans also call for a parking area for 20 cars with access from two driveways on the 15'-N. -S. alley adjoining on the East. These details are outlined in 'letter of, applicant filed December 6, 1957, and plans filed February 7, '1958. The Traffic Engineer has approved the proposed parking arrangement and operation. The adjacent land uses are as follows: a bicycle shop and grocery store are to the North; 3 single family homes immediately to the South; single family homes are across Snelling Avenue to the East and front on Brimhall and single family homes are across Snelling Avenue to the West. The Field investigation discloses that the three single family homes in the block are set back 31' from Snelling Avenue and the commercial stores are built to the property line. This results in a 12' building 'line for this block, as the structures were constructed prior to the adoption of the Zoning Ordinance. Page 2 Berde The Zoning Board compared the proposed development with the standards recommended by the American Public Health Association relative to three characteristics, namely: (1). A percentage of land covered by the building. (2). The ratio of total-floor area to the total area of the site. (3). The maximum number of dwelling units that should be provided on a site of this size and found the proposed development to be in sub- stantial agreement. The basic difference between the American Public Health Association Standards and the applicant's proposed development is that the standards recommended no more than 17 units for this size property, whereas the applicant proposes 20 units. By virtue of the existing commercial land uses in the area, the commercial characteristics of Snelling Avenue, the substantial compliance with recommended standards of the American Public Health Association as to proper site develop- ment, the compliance with existing laws as to yard areas and off-street parking requirements, the Zoning Board finds that the proposed development is consistent with the existing and likely future development of the area. r In consideration of these factors, the Zoning Board recommends this appeal to construct a 20 unit apartment building in accordance with plans filed February 7, '1958 be granted. This also applies to the installing and operating a parking lot on same properties. The original zoning of this district was meant to be for strictly a home residential area. To rezone, at this time, the properties in question, to permit a commercial structure of this or any other type would be a flagrant violation Of our rights. Thi's structure could only mean a lowering of the values of our properties. I also have been told that this could mean a raise in our, Real Estate Assessment which in my opinion would be outrageous. I know that the majority of the home owners affected feel the same way. I also know that in similar cases in the past, the ruling has been in favor of a few instead of the majority'. I have not undertaken the obligation of hiring an attorney to argue this matter as I hope the honesty and good judgement of our present cormnissioners will prevail.
