Section 1. That Chapter 60 of the Saint Paul Legis-
lative Code, pertaining to the Zoning Code, Use Districts,
and Rezoning of certain properties in the City of Saint Paul,
as amended, be and the same is hereby further amended so as
to rezone the folloiring described property from "B" Residence
District to Commercial District:
The northerly 49.5 feet'of Lots 21 and
22, together with those portions of
Lots 1, 2, 3 and 4, not presently zoned
Commercial, all in Block 4, E. M. Mackubints
Addition, located on the west side of
Forest Street, between Minnehaha and Reaney.
Section 2. This ordinance is hereby declared to -be
an emergency ordinance rendered necessary for the preservation
of the public peace, health and safety.

force upon its passage, approval and publication.

This is In the matter of the petition of the Wulff Funeral Home to rezone from
i'Bt1 Residence to Commercial property located on the west side of Forest St.
between Minnebaha & Reaney. This is described in applicant's petition as the
northerly 49.5' of Lots 21 & 22, together with those portions of Lots 1,2,3,4,
not presently zoned Commercial, all in Block 4, E. M. Mackubin's Addition. To
remove any doubt as to the extent of the present commercial zoning of appli-
cant's property brought about by a conflict between the a'" ..;:layout on the
ground and the alley layout as shown on the Zoning Map, the applicant has in-
_ eluded in this petition property determined by the City Architect to be presently
zoned Commercial. The remaining property to be rezoned from "BIT Residence to
Commercial adjoins on the south)`6xisting Commercial zoning along Forest St. and
is described as the south 8' of Lots 1 & 2 and the northerly 49.5' of Lots 21 &
22, Block 4, E. M. Mackubin's Addition.
This property has a frontage of 57.5 ft. along Forest Stand extends westerly
.a distance pf 75.1 ft.-,The owners of nine out of ten of the several descriptions
within 100 ft. of the property to be reclassified have signed the petition.

The adjacent land uses are as follows: to the west fronting E. 7th is a
theatre, to the south are one and two family homes, a church is across Forest
Y St. to the east, and the applicant's mortuary is immediately to the north..
The applicant_,is presently operating a mortuary on Lots 1 & 2 and is providing
a private parking lot for visitors on.Lots 3 & 4. The purpose of this rezoning
is to provide an off- street parking area for seven staff cars south of the
present building and with access from Forest St. and in addition to use an exist-
ing building on this site for storage purposes in connection with the mortuary
operation.
In view of the Commercial'character of the area and the southerly extension of
a commercial zone the Zoning Board feels that the use contemplated is appropriate
and further tbat.if this petition is-granted it will not be detrimental to the
interests of adjoining property owners. The off - street parking arrangement as
been ppproved by the Traffic Engineer. Field investigation discloses no obje tion
to either the proposed land use or the rezoning for commercial purposes.
The Zoning Board therefore, recommends this rezoning be granted.

Gentlemen:
The purpose of the attached petition is two -fold and we believe a word
of explanation will be of assistance.
Primarily, the Wulff Funeral Home desires to rezone from B Residence to
Commercial the northerly -49.5 feet of Lots 21 and 22, Block 4, E. M.
Mackubin's Addition to St. Paul; for the purposes of conducting the busi-
ness of a mortuary together with accessory uses thereon, in accordance
with Section 23, Article'V, of the Building-Zone Ordinance. At the pres-
ent time the Wulff Funeral Home has signed an Earnest Money Contract for
the purchase of this land.
As a secondary purpose, the Wulff Funeral Home and its stockholders also
desire to correct an'error in the application of the ordinance in that
the street-layout actually on the ground varies from the street layout as
shown''on the zoning map.
The zoning map shows Block 4 as having an alley where, as a matter of fact,
no alley exists. No alley was dedicated in the original plat and no sub-
sequent condemnation proceedings have ever been brought or apparently have
ever been contemplated. Under,Section 25, Article V, this creates a ques-
tionable situation where Lots 1; 2, 3 and 4+ may be zoned Commercial only
100 feet back from the street line. There can be no doubt but that it was
and continues to be the general intent and purpose of the ordinance that
these lots should have been originally, and should presently be, zoned as
Commercial in their entirety.
Although apparently this latter situation can be corrected under Section 20,
Article V, of the ordinance, in order to save the time of the Council and
the Zoning Board, it is included herewith in one package.
