1 WI�REAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repaiz or wrecking

WHEREAS, based upon the records an the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before August 18, 2008, the
following are the now known interested or responsible parties for the Subj ect Property: Melvin
L Freeman/Sharon L Freeman, 731 Heron Ave N, Oakdale, MN 55128; Peterson, Fram &
Bergman, 55 E 5` St, Suite #800, St. Paul, MN 55101; InterSavings Bank, FSB, 6545 France
Ave S, #130, Edina, MN 55435; District 6 Plamiing Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter AS of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated November 24, 2008; and
WHEREAS, this order informed the then lrnown interested or responsible parties that the
shucture located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by December 24, 20�8; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the pubiic hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, March 10, 2009 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to arder the interested

or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfaze and remove its blighting influence on the community by demolishing
and removing the structure in accardance with all applicable codes and ordinances. The
demolition of the structure to be completed within fdteen (15) days after the date of the Council
Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
April 1, 2U09 and the tesrimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 127 FRONT AVENUE.
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five tbousas�d dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declazes it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

It is further ordered, that a copy of this xesolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

accordance with all applicable codes and ordinances, or in the altemative by demolishing

rehabilitarion or demolition and removal of the structure must be completed within
fifteen (15) days after the date of the Council Hearing.
If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, ail
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Pau1 shall remove and dispose of such property as provided by law.

The Department of Safery and Inspections has declazed this building{s} to constitute a"nuisance"
as defined by Legislative Code, Chapter 45. The Depariment of Safety and Inspections has
issued an order Yo the then known responsible parties to eliminate this nuisance condition by

The property was re-inspected on January 5, 2009. There was no compliance and the nuisance
condition remains unabated, the community continues to suffer the hlighting influence of this
property. It is the recommendation of the Deparhnent of Safety and Inspections that the Ciry
Council pass a resolution ordering the responsible parties to either repair, or demolish and
remove this building in a timely manner, and failing that, authorize the Depamnent of Safety and
Inspecrions to proceed to demolition and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taxes.

The building is a two-story, brick, four-plex dwelling, on a lot of 12,197 square feet.
According to our files, it has been a vacant building since June 11, 2007.
The current property owners are Melvin and Sharon Preeman, per AMANDA and Ramsey
county property records.
The city has had to board this building to secure it from trespass.
There have been five (5) SUMMARY ABATEMENT NOTICES since 2007.
There have been four (4) WORK ORDERS issued for:
- Boarding
- Removal of improperly stored refuse
- Removal of tal] grass and weeds
On November 7, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on November 24, 2008 with a compliance date
of December 24, 2008. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid. (Assessed 8/21/O8, Good thru 6/11/09.)
Taxation has placed an estimated market value of $60,000 on the land and $230,000 on the
building.
As of March 9, 2009, a Code Compliance inspection has not been completed.
As of March 9, 2009, the $5,000.00 performance bond has not been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cosY to repair Yhis structure is $80,000 to $90,000. The
estimated cost to Demolish is $10,900 to $14,900.
DSI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this sYructure within fifteen (15) days, if not the resolution authorizes
the Division of Code Enforcement to demolish and assess the costs to the property.

Two story, wood from, (4) unit building, all brick exterior.
EXTERIOR
l. The exterior walls and/or trim of the house and/or garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
2. The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
3. The windows and/or storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardwaze and associated trim in a professional manner. Pennit may be
required.
4. The raof is deteriorated, defective, or in a state of disrepair. Repair or replace
the roof covering to a sound, tigl�t and water impervious condiuon. Permit
may be required.
5. The eaves and soffits are in a state of disrepair or deteriorafion. Repair ali
defeets, holes, breaks, loose or xotting boards, to a professional state of
maintenance. Permit may be required.
INTERIOR
6. The interior walls are defective. Repair all wall defects and finish in a
professional manner.
7. The interior ceiiings aze defective. Repair all ceiling defects and finish in a
professional manner.
8. T he bathroom floor covering is deteriorated ar inadequate. Provide floor
covering which is impervious to water and easily cleanable throughout the
bathroom and seal around the edges and fixtures.

e 9. Evidence of improper electrical wiring and damaged outlets/fixtures. Have a

licensed contractor make a11 necessary repairs and certify system integrity.
Provide documentation to this depariment.
10. Smoke Detector: Lack of properly installed and operable smoke detector.
11. Ft3R1�3ACE: Have a licensed heating contractor service and clean the fumace
or boiler and make any necessary repairs. Perform a C/O test on the heating
plant. Then, send the attached forsn back to the Inspector. Repair of gas fired
appliances requires a pernut.
12. Evidence of improper/damaged plumbing and associated fixtures. Have a
licensed contsactor make all necessary repairs and certify system integrity.
Provide documentation to this deparhnent.
13. Xcel Energy has reported that electric andior gas service has been terminated.
l4. Lack of water service.
15. The stairs have missing or defective handrails. Provide all interior and
exterior stairways and steps of more that three (3) risers with handrails which
are grippable and installed 34" to 38" above the nose of the stair treads.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not conected by December 24, 2008 the Department of Safety
and Inspec6ons, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial acrion, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Secrion, 375 Jackson Street, Suite 220, (651)266-9090. This
inspection will iden6fy specific defects, necessary repairs and legal requirements to correct this
nuisance condition.
ALT 1: If this building is located 'm a historic district or site (noted above, just below the
property address) contact Heritage Preservation (HPC) staff at 651-266-9078 to discuss your
proposal to comply with the design review guideline while making the required repairs. Copies
of the guidelines and design review application and forms are all available from the Department
of Safety and Inspections web site and from the HPC staff. A building permit will not be issued
without HPC review and approval.
ALT 2: If this building is located in a historic district or site (noted above, just below the
property address) then you rnust contact Heritage Preservarion (HPC) staff to discuss youx
proposal far the repairs required by this order and compliance with preservation guidelines.
Copies of the guidelines and design review application and forms are available from the
Department of Safety and Inspecfions web site (see letterhead) and from the HPC staff. No
permits will be issued without HPC review and approval. HPC staff also can be reached by
calling 651-266-9078.

As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Ordet to Abate" to all interested parties, all present or subsequent xenters and� ��
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is tequired by law to post a placard on this property which declares it
to be a"nuisance condition", subj ect to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of ttus °Order
to Abate" with the City Clerk's Office.
Tf corrective action is not taken within the time specified in this ordex, the Enforcement Officer
will notify the City Council that abatement acfion is necessary. The City Clerk will then
schedule dates for Public Hearings befare the City Council at which time testimony will be
heazd from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
Tf the resolurion calls far abatement acrion the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisaons of Chapter 33 of the Saint Paul Legislative Code and provide that if correcrive action
is not taken within the specified time, the City shatl abate this nuisance. The costs of this
action, including adsninistrarive costs will be assessed against the property as a special
assessinent in accordance with law.

Ordering the owner to remove or repair the building(s) at 127 Front Avenue within fifteen
(15) days from adoption of resolution.
The property owner of recard, Melvin and Sharon Freeman, did not appear. No other parties of
interest appeazed.
Mr. Magner stated the building was a two-story, brick, four-plex dwelling on a lot of 12,197 square
feet and had been vacant since June 11, 2007. A code compliance inspection had not been done, the
vacant building registration fees in the amount of $1,000 were paid by assessment on August 21,
2008, and the $5,000 performance bond had not been posted. On November 7, 2008, an inspection
of the building was done and a list of deficiencies which constitute a nuisance condition was
developed. An order to abate a nuisance building was posted on November 24, 2008 with a
compliance date of December 24, 2008. To date, the property remained in a condition which
comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the
market value of the land to be approximately $60,000 and the building to be $230,000. Real estate
taxes were current. Code Enfarcement estimates the cost to repair the building to be approximately
$80,000 to $90,000. The cost for demolition was estimated to be approximately $10,900 to
$14,900. There had also been five summary abatements issued to this property since 2007, four of
which went to work order: to secure the building and the City had to board the building to secure it
from trespass, remove improperly stored refuse and debris, boarding, and cut tall grass and weeds.
Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner
presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1896 and was a Queen Anne style building. This building had been inventoried in 1983 and the
architect was listed as E. Strassburger and the builder was listed as Thoene. Although the exterior
of the building had been altered and the integrity had been compromised, she believed it was a
potential historic resource to the neighborhood. She noted that it was the last house on Front before
the commercial buildings on Rice and acted as a buffer for the residential neighborhood on Fmnt.
Ms. Moermond recommended the building be removed within 15 days with no option for repair;
however, she noted its potential as a historic resource to the neighborhood.
