An ordinance granting permission to Sifo Company
to construct, maintain and operate a dust collector over and
across the alley running from Wacouta Street to Rosabel Street
between Fourth and Fifth Streets, to be placed approximately
fifteen feet westerly of the existing turn - around in the block.
This is an emergency ordinance rendered necessary for the
preservation of the public peace, health and safety.

THE COUNCIL OF THE CITY OF SAINT PAUL DOES CR DAIN:
Section 1. That permission is hereby given to Sifo
Company to construct, maintain and operate a dust collector
over and across the alley running from Wacouta Street to Rosabel
Street between Fourth and Fifth Streets, to be placed approximately
fifteen feet westerly of the existing turn- around in the block,
not less than fifteen feet above the alley and supported on steel
beams; and the Commissioner of Public Works is hereby authorized
to issue a permit to said Sifo Company for the,-construction,
maintenance and operation of said dust collector upon its com-
pliance with the following conditions, viz:
1. Said permittee shall construct said dust
collector at its own expense, under the suipe,rvision
and to the satisfaction of the Commissioner of
Public Woxk4 and the Commissioner of Parks, Play-
grounds and Public Buildings, and in accordance
with plans and specifications approved by them; that•
among other requirements of the same, said plans
and specifications shall provide for poured con-
crete footings of said structure and for the exten-
sion of the same to a depth below the frost line.
2. Permittee shall furnish a bond of $10,000.00
to the City of Saint Paul, conditioned to save said
City harmless from any and all liability, judgments,
suits, costs, damages or expense accruing to person
or property, arising out of the installation,
maintenance, Lase, presence or removal of said dust
collector. Said bond shall be satisfactory to the
Commissioner of Finance as to surety, to the Corpor-
ation Counsel as to form and execution, and shall be
filed with the City Comptroller. Said permittee,
its successors and assigns shall have the absolute
obligation to fully indemnify and hold harmless said
City of Saint Paul against all liability, without
limitation, on account of injury to person or property
resultant from the installation, maintenance and /or
removal of said dust collector:, -.

3. Said permittee shall pay the cost of
engineering and inspection, and also the cost
of publication of this ordinance.
4. Said permittee shall, within ten days
after the passage and publication of this
ordinance, file a written acceptance thereof
with the Cit y.Clerk.
5. This permit may be revoked by the Council
at any time, and thereupon permittee shall remove
said dust collector.
Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation
of the public peace, health and safety.
-Section 3. This ordinance shall take effect and be in
force upon its passage, approval and publication.
Section 4. This ordinance shall be deemed apart of the
Saint Paul Legislative Code, and shall be incorporated therein
and given an appropriate chpater number at the time• of the
next revision of said Legislative Code.
