An ordinance authorizing the issuance of a permit to
Waldorf Paper Products Company, a corporation, to install,
maintain and operate three 1000 gallon flammable solvent tanks
underground on Myrtle Avenue between Hampden and Pillsbury
Avenues, approximately 292 feet east of the center line of
Hampden Avenue and 14 feet in the clear between tanks and
property line on the south side of Myrtle. s is emergency
ordinance rendered necessary for the preserva iion of the public
peace, health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That upon compliance with the conditions
hereinafter set out, the Commissioner of Public Works is author-
ized to issue a permit to Waldorf Paper Products Company, a
corporation, to install:,. maintain and operate three 1000 gallon
flammable solvent tanks underground on Myrtle Avenue between
Hampden and Pillsbury Avenues, approximately 292 feet east of
the center line of Hampden Avenue and 14 feet in the clear between
tanks and property line on the south side of Myrtle, said tanks
to be bured beneath the tracks of the Minnesota Transfer Railway
Company, will be placed on sand, and have a sand coverying of
about five feet. The conditions are as follows:

1. Permittee shall Furnish a bond of $10,000.00
to the City$ =of Saint Paul, conditioned to---save said

suits, costs, damages or expense accruing to person or
property, arising out of the installation, maintenance,

use, presence or removal of said tanks. Said bond
shall be satisfactory to the Commissioner of Finance as
to surety, to the Corporation Counsel as to form and
execution, and shall be filed with the City Comptroller.
Said permittee, its successors and assigns shall have
the absolute obligation to fully indemnify and hold

harmless said City of Saint Paul against all liability,

without limitation, on account of injury to person or

property resultant frbm the installation, maintenance

and/or removal of said tanks and /or any of the same at
said site.

2. Permittee shall file plans and specifications
for said tanks with the Commissioner of Public Works,
which shall be satisfactory to the Chief Engineex_of
the Department of Public Works and to the Division of
Fire Prevention, and said tanks shall be installed as
they shall direct. Permittee shall pay the cost of
inspection.

3. This permit may be revoked by the Council
at any time, and thereupon permittee shall remove
said tanks.
4. Permittee shall pay the cost of the publication
of this ordinance.
5. Permittee shall, within ten days after the
publication of this ordinance, file a written acceptance
thereof with the City Clerk.
Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation
of the public peace, health and safety.
Section 3. This ordinance shall take effect and be in
force from and after its passage, approval and publication.
Section 4. This ordinance shall be deemed a part of the
Saint Paul Legislative Code, and shall be incorporated therein
and given an approp ;iate chapter number at the time of the
next revision/of the said Legislative Code.

Dear Mr. .Winkel:
In regard to the application of Waldorf Paper Products Company for
permission to install three-1,000 gallon flammable solvent tanks under -
ground on Myrtle Avenue between Hampden and Pillsbury Avenues; these
tanks to be buried beneath the tracks of the Minnesota Transfer Railway
Company and will have an earth cover of five feet.
We have investigated the foregoing and report that these tanks
will be buried beneath the tracks of this dead end spur track which
is very seldom used. Tanks will be installed in accordance with the
regulations of the National Board of Fire Underwriters and the Fire
'Prevention Code.
We,do not think- -that this installation will greatly increase
the fire...hazard in that vicinity.
