An ordinance amending the Zoning Code, Chapters
60 to 64 inclusive, of the Saint Paul Legislative
Code, pertaining to the Zoning Code, Use Districts,
and Rezoning of certain properties in the City of
Saint Paul. This is an emergency ordinance
rendered necessary for the preservation of the
public peace, health, and safety.
THE COUNCIL OF THE CITY'OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 647•inclusive,
of the Saint Paul Legislative Code, pertaining to the Zoning Code,
Use Districts, and Rezoning of certain properties in the City of
Saint Paul,,as amended, be and the same is hereby further amended
so as to rezone the following described property from Class 11C11
Residence to Commercial District:
Lot 1, Block 5, Brewster's Addition to
St. Paul, except the' Et ly 40 ft. and the
Wily 50 ft. of said lot, and except that
part of Sherburne Avenue vacated adjoining,
said property being located on the north
side of Sherburne Avenue between Capitol
Boulevard and Cedar Street.

emergency ordinance rendered necessary for the preservation of the
public peace, health, and safety.
Section 3. This ordinance shall take effect and be in

Dear Sir:
This is in the matter of the application of the Minnesota Education Association
to rezone'.from "C" Residence to Commercial property located on the north -side
of Sherburne Avenue between Capitol Boulevard and Cedar Street-. This property
is described as Lot 1, Block 5, Brewster's Addition to St. Paul, except the
easterly 40 feet and the westerly 50•feet of said lot, together with that portion
of Sherburne Avenue as accrued to the above described premises by virtue of a
vacation of a portion of the said - Sherburne Avenue, being a'strip of land 20.feet
more or less in width lying between the south line of the above described part
of the said Lot 1, and the north line of Sherburne Avenue as now improved. Nine
out of,a possAle eleven, or 81 per cent of the owners of the several descriptions
of real estate situated within 100 feet have acquiesced to this proposed reclassi-
fication.
This tract.has a frontage of 60 feet on Sherburne Avenue and extends northerly•a
distance of 70 feet. At present there is'a residence on this property. In 1954
the City Council granted a rezoning of the property to the east to permit the
Minnesota Education Association to construct its home office on that site. This
proposed rezoning is for the purpose of providing additional off-street parking
.facilities in connection with this office operation. The Board of Zoning re-
cognizes the need for providing additional off- street parking in connection with
the existing office bui.lding,., and A notes further that the proposed use and develop-
ment of this property would not be .detrimental to the area; and, therefore, finds
that the proposed rezoning would be,proper.
In consideration 'of the above factors, the Board of- Zoning recommends that this
petition.to reclassify from "C "• Residence to Commercial for off-street parking
purposes be granted,,

We herewith present to you the petition for the rezoning
of the property at 55 Sherburne Avenue owned by the Minnesota Education
Association from a "Off Residence District to a Commercial District. .
The purpose of the petition is to obtain a rezoning which
will enable the Minnesota Education Association to use the property
as a private parking lot for its employees working in its adjacent
office building at 41 Sherburne Avenue and patrons who come to the
building.
It is the intention of the Association to wreck the old
dwelling house now on the property and level and landscape it for
parking lot purposes.
The Association desires to convert the premises to a
parking lot for the convenience of its employees and patrons and
to alleviate the on- street parking in this area. Being in the
vicinity of the State Capitol, there is considerable parking on
the streets in the neighborhood. Moreover, parking is now prohibited
on the south side of Sherburne Avenue and the west side of Cedar Street
adjacent to the Association's office building.
The Association has no plans to ever use the property for
anything but a parking lot. However, it is possible that some time in
the rather distant future it might conceivably want to erect a part of
an addition to its present office building on these premises. But it
is believed that if this is ever done, it will be a long time from now.
The present building is not fully occupied by its employees, leaving
floor space for expansion of its staff without requiring new construction.
If in the future it finds it necessary to add to its building, its pre-
sent idea is to erect an extra story on top of the existing structure.
It is believed that the demolition of the old and unsightly
dwelling house now on the premises and the conversion of the property
to an attractively landscaped and fenced parking lot will contribute
to the improvement of this area.

organization of the t4achers of Minnesota. It is a non - profit corpora-
tion, incorporated under the laws'of this state relating to social and
charitable corporations. Its general purposes are to promote educational
interests and advance standards of education and to improve teaching,
and foster professional zeal.
There are nine descriptions of real estate situated within 100
feet of the property, and the petition is signed by all of the owners of
seven of such descriptions. In the case of the remaining two descriptions,
it,is signed by one or two owners in each instance, but it was not practicably
possible to obtain the signatures of the remaining few.
With respect to 528 Capitol Boulevard, Merlin F. Larson signed,
but Eleanor M. Larson was not available. Mr. Larson stated that she has
conveyed her interest in the property to him, but the deed had not yet
been placed of record. We understand that this will be done, however.
In the case of 757 Cedar Street, Harold V. and Dolores M.
Waldvogel signed, but it was not possible to locate Muri B. and Omiel
Upchurch, who were reported to be somewhere in the South. The _Waldvogels°
reported that the Upchurches had transfered their interest in the property
to hem prior to their leaving here, although at the time we obtained the
list of owners from the Department of Finance this transfer did not appear
on its records.
We mention the foregoing to show that the lack of these three
signatures on the petition is not due to any opposition to the project,
of 'which we have heard. none.

seven of such descriptions. In the case of the remaining two descriptions,
it,is signed by one or two owners in each instance, but it was not practicably
possible to obtain the signatures of the remaining few.
With respect to 528 Capitol Boulevard, Merlin F. Larson signed,
but Eleanor M. Larson was not available. Mr. Larson stated that she has
conveyed her interest in the property to him, but the deed had not yet
been placed of record. We understand that this will be done, however.
In the case of 757 Cedar Street, Harold V. and Dolores M.
Waldvogel signed, but it was not possible to locate Muri B. and Omiel
Upchurch, who were reported to be somewhere in the South. The _Waldvogels°
reported that the Upchurches had transfered their interest in the property
to hem prior to their leaving here, although at the time we obtained the
list of owners from the Department of Finance this transfer did not appear
on its records.
We mention the foregoing to show that the lack of these three
signatures on the petition is not due to any opposition to the project,
of 'which we have heard. none.
