An ordinance amending the Zoning Code, Chapters
60 to 64 inclusive, of the Saint Paul Legislative
Code, pertaining to the Zoning Code, Use Districts,
and Rezoning of certain properties in the City of
Saint Paul. This is an emergency ordinance
rendered necessary for the preservation of the
public peace, health, and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64,
inclusive, of the Saint Paul Legislative Code, pertaining to the
Zoning.Code, Use Districts, and Rezoning of certain properties
in the. City of Saint Paul, as amended, be and the same is hereby
further amended so as to rezone the following described property
from Class "B" Residence District to Class "C" Residence District:
Lots 1 and 2, Block 3, Woodbury and Case's
Addition, except the southerly 113.74 ft. and
adjoining alley, situated on the west side of
Mt. Hope Street between Prescott Street and
the bluff to the north.
Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation of the
public peace, health, and safety.,
Section 3. This ordinance shall take effect and be in
force upon its passage, approval and publication.

This is in the matter of' the petition of the Riverview Memorial Hospital to rezone
from "B" residence to ",C" residence property located on the west side of Mt. Hope
Street between Prescott Street and•the bluff to the north. This property is described
as Lots 1,and 2, B�ock,.3',,•Woodbury and Case's Addition to St. Paul, Minnesota, ex-
cept the southerly 113.74 feet And adjoining alley.
Eleven out of thirtderk descriptions, or 85 per cent of tbe.property owners within
100 feet of the area-to be•reclassified, have acquiesced in this petition. The
property is presently vacant and has a frontage of 94 feet,more or less, along Mt.
Hope Street and extends westerly a distance of 118.5 feet,tiaking a total area of
12,087 square feet, more or less., The Applicant proposes to develop this site for
off-street parking purposes in connection with the Riverview Memorial Hospital
which is across Mt. Hope, Str-eet' 6 the east..
The adjacent; land uses are as follows: south across an alley are two single family
residences.f'ronting on. Prescott Street; east across Mt. Hope Street are the hospital
grounds and an existing ,parking,lot; west and adjacent is vacant land; north and
adjoining is'4,,a very steep slope extending down to Concord Street.
Field investigation discloses that the proposed parking area can be developed to
meet existing,standards for off-street parking facilities. Acceptable off-street
parking standards for hospitals,.w6uld require 42 spaces for this facility. The
existing parking lot has a capacity of.-i9 cars and the 'proposed. lot would provide'
approximately 30 additional spaces, making a,total of 49.

By virtue of t" existing 'land uses in this area and the general desirability of
permitting hospitals to expand their services to the community in a manner consis-
tent with the public interest and need, -the Board ol,Zoning finds that the proposed
development wound be proper in this location, although it does result in a "spot"
zone.
In consideration,of the above factors, the Board of Zoning'recommends thgt this
petition be granted.

MEMORANDUM ON PETITION,TO REZONE BOTH-. ;SIDES OT LINWOOA AVENUE BETWEEN AVON
AND VICTORIA, ST. PAUL, ...MINNESOT
The Crocus Hill area has long been a choice'•neighborhood with relatively '
stable property values. Few communities'of• over ar nillion,.as the Twin Cities,
now is, have pleasant residential neighborhoods' so convenient to business and
activities as in St.'Paul and Minneapolis: - Bluff 'Udge yiew is a unique asset
of this neighborhood. Maintenance of a desirable residential character here
is'essential to the maintenance of property values in the city'and is essential
to give..the city responsible public spirited citizens. In many communities,
most of those who would actually contribute.to community leadership have moved
to Suburbs..
Marty years ago;.in 1915 to be exact, - Ordinance No. 3534 was enacted
designating the property bounded by.Victoria, Grotto, Osceola and St. Clair
as ,a residence district as authorized by- Chapter 98, -Laws of Minnesota for
1913 ". This - ordinance provided that after'its enactment "only buildings for
residences',may,be hereafter enacted•or maintained, including duplex houses
and double,houses and.that the erection and maintenance of hotels, stores,
factories,-;warehouses, tenements, .dry cleaning plants, public garages or
stables and apartment houses are hereby prohibited."
Unbrtunately while this.ordinance has never been expressly - repealed,
and is probably still legally in force, the 1913 zoning law received rather
restrictive interpretations by the courts'and was for all practical purposes,
supplanted.by Chapter 21.7, Laws of•1921 under -which the present comprehensive
building zone ordinance of St. Paul No. 5840 was adopted in•1922, At that
time the zoning commission apparently ignoring entirely the 1915'ordinance,
while zoning Linwood from Grotto to ,Avon as a C1ass.A residence district,
zoned the -North side of 'Linwood -from .,von to Victoria._as Class B and the South
side between the same streets as Class.0 residence district, presumably because

Victoria, respectively.,;As a result,'city officials, including the assessor,
the valuation engineer and the'City`Council, -have generally considered these,
block's on Linwood as "B" and PC" residence districts: -and have considered-that
the and has the value for.ta and assessment purposes on thei basis of its being
available for construction of 'apartments and .tenements`.
.:;The whole matter has been'brought. -to --a head by the recent filing under
Section 8ee< of a petition. for the establ- ishment of a rest home at 841St. Clair.
Such a use is permitted only in ClasssC:oi lower districts. It is absolutely,
prohibited in a Class 'A district.
A number of the property owners in this.neighborhood feel that to permit
the permanent establishment of such a rest home might, in the words of the
zoning ordinance "be'detrimental to the health, safety, order,'convenience,
prosperity and general welfare" of the neighborhood. They also feel that in'. -.,
fairness to the parties petitioning for' the establishment of the rest home they
should petition now for reclassification of the neighborhood into a Class A
district_.be'fore. plans for the rest home are filed or expenses incurred in
- .•reliance- on',the- present apparent Class C classification.
The step proposed for rezoning is in line with similar upgrading actions
recently taken'in other parts'of this neighborhood, namely on Lincoln Avenue
The reclassification of the area to "A should not,, it is believed,
increase taxes or assessments. In fact, taxes and assessments are often higher_
on apartment and commercial properties than on. "A" residential properties.
The rezoning to Class A.will not affect the present apartment houses at
Avon and Victoria. They -will be allowed to remain just as they are as non-
conforming usesu,,under Section 8 of the Building Zone Ordinance. In fact,
interior reconstruction and alteration is expressly permitted up to fifty per cent.

This is in the matter of the application of Samuel Morgan et al to rezone from
"B" residence and "C" Residence to Residence Res ""
• property fronting on both sides
of Linwood Avenue and the north side of St.Clair Avenue between Victoria and Avon
Streets. 'This property is described as Blocks 2 and 3; Evergreen Place. The
owners of,17 out of a possible 23, or 73.99'0 of the several descriptions located
within 100 feet of•the area sought to be reclassified have consented to this petition.
A'll'of the property owners within the area to be rezoned except the owner of one
80 foot parcel on St.Clair Avenue have signed the petition in favor of this reclassi-
fication.i
The property under consideration has been so zoned since the ordinance was adopted '
in 1922,and is developed with thirteen single•family homes, two duplexes and four
multi - family structures. The attached map illustrates the uses of the property in
the area in relationship to those owners whose names appear on the petition. In
reviewing;.this proposal, the Board of Zoning makes note of`the fact that this is a
southerly and westerly extension of the "A" residence zoning pattern in the area.
It appears to be the intent of the owners of the property in this area to prevent
future conversions to uses other than single,family occupancy and related land uses
permittedl'in an "A" Residence zone. The petition was initiated primarily to prevent
the conversion of a home at 841 St.Clair Avenue into a rest home for which an Eppli-
cation had been filed, but due to neighborhood opposition was subsequently withdrawn..
It must also be noted that existing apartment and two - family land uses would not be
required to convert to single family occupancy if this property is rezoned to. "A"
Residence', but they would be placed in a non - conforming status.

In view of the expressed desire of the majority of owners of property in this area
to retain,,the existing high standards of this neighborhood, the Board of Zoning
feels that the effect of this proposed reclassification would be in the direction
of securing this objective.
Because of the existing predominance.-,of the single family character of this neigh-
borhood, the Board of Zoning finds that the proposed "A" residence classification
would, ini;fact, reflect the highest and best use of the property within the district
without injury or damage to any existing property owners. In consideration of these
factors,..be Board of Zoning recommends this petition to reclassify from "B" resi-
dente andl "C" residence to "A" residence the property under consideration be granted.
