RESOLVED, that upon appeal of St. Timothy's Lutheran
Church from the decision of the Commissioner of Parks,
Playgrounds and Public Buildings, a 25 foot building line
is hereby established on North Victoria Street, on property
described as all of Lot 3 south of Nevada Avenue and all of
Lot 6 except the south 125 feet thereof and also excepting
the north 25 feet of the south 159 feet of that part of -Lot 6
lying east of a line running parallel with and 88 feet west of
the east line of the NW/ of Section 23, Township 29 North,
Range 23 W., also East One -half of vacated Quincy Place adjoining
Lot 3 south of Nevada Avenue and except south 125 feet Lot 6,
all in Block 26, Como, also except the west 18 feet the West
One -half of vacated Quincy Place adjoining Lot 1, Nevada Avenue
Addition, situated at the southwest corner of North Victoria
Street and West Nevada Avenue, all in accordance with appellantrs
lever dated.A.ugust 21, 1958 and plan attached thereto.

appeal of St. Timothy's Lutheran Church for the establishment of new building
line on all of Lot 3 south of Nevada Ave. and all of Lot 6 except the south
125 ft. thereof and also excepting the north 25 ft. of the south 150 ft. of that
part of Lot 6 lying east of a line running parallel-with and 88 ft. west of the
east line of the NWu of Sec. 23, T. 29N., Range 23 W., also E2 of vacated Quincy
Place adjoining Lot 3 south of Nevada Ave. and except south 125 ft. Lot-6, all in
Block 26, Como, also except the west 18 ft. the W2-1 of vacated Quincy Place adjoining

Dear Sir:
This is in the matter of the appealrof St.'Timothy's Lutheran Church to relax the
front building line regulation.on property located adjacent to the southwest corner
of north Victoria Street and west Nevada Avenue. This property is described as all
of Lot 3 South of Nevada'Avenue, and all of Lot 6, except the south 125 feet thereof,
and also excepting.the north 25 feet of the south 150 feet of that part of Lot 6
lying east of line running parallel with and 88 feet west of the east line of the
northwest quarter of Section 23; Township 29N; Range 2311', also the east one -half of
vacated Quincy Place adjoining Lot 3, south of Nevada Avenue and except the south 125
feet Lot 6, all in Block 26, Como, also except the west 18 feet the west one -half of
vacated Quincy Place adjoining Lot •l, Nevada Avenue Addition. Th\e zoning has been
"A " Residence since the adoption'of the Ordinance in 1922.
There is an existing two -story church building located approximately on the westerly
one -half of this property. The applicants propose to connect a one -story building to
the east which would necessitate a break in the building line on North Victoria Street
as shown on the attached plan dated June 3, 1958 from 57 feet to 25 feet. The
surrounding area is used for residential purposes.
The applicant,.has an off - street parking.lot across Nevada Avenue to the north. The
proposed development meets all existing yard and area requirements of the. building and
zoning codes._ Field investigation .discloses no objection from the standpoint of
adjacent land'use or traffic.
The proposed expansion of the building on this site will not affect adjacent residences
in tle area.Several property owners within the ,immediate area have signed a petition
in favor of the proposed - development, thereby verifying the contention of the Board of
Zoning that this development would not be detrimental to the neighborhood. It is the
opinion of the Board of Zoning that this site cannot be developed properly to meet
the needs of the church within the framework of the strict application of the Zoning
Ordinance as it applies to this site. f

In consideration of these factors, the Board of Zoning finds the purpose and intent
of the Zoning Ordinance would be substantially achieved under these circumstances,
and that, therefore, they recommend that this appeal to establish a building line of 25
feet on north Victoria Street 'oe granted in-accordance with applicant's letter dated
August 21, 1958,and plan attached thereto.

Subject: Request for change in Zoning Ordinance
In accordance with paragraph j of Chapter 64.03 of the St. Paul Legislative
Zoning Code (Dated 1956, adopted 1958), St. Timothy Lutheran Church hereby
requests your consideration of this request for change of the "Setback"
requirement of the St. Paul Legislative Zoning Ordinance.
The St. Paul Legislative Zoning Ordinance requires a "Setback "of 20% of the
average depth of the lot being considered.. This would require a forty -five
(45) foot setback On Victoria Street for our planned addition to our church
located at 886 Nevada Avenue West, which property is bounded by Nevada and
Victoria and which is legally described in full in the attached Exhibit "A ".
We hereby request that we be permitted to construct the addition to our pre-
sent buildings to within twenty -five (25) feet of Victoria Street instead of
the forty -five (45) feet presently required. We feel that the forty -five
foot requirement will seriously impair the efficient utilization of available
space whereas a twenty -five foot setback will permit us to locate the addition
to better utilize the space and add to the attractiveness of the complete
building layout.
We note that adjacent property owners on the West side of Victoria have houses
and garages located with an approxiamete ten to fifteen foot setback. The
approval of our request for a twenty -five foot setback would result in our
buildings being farther from Victoria than existing - structures and thus not
detract either functionally or esthetically. Attached as Exhibit "B" are names
of property owners Trrithin two hundred feet (200) of our property who do not

object to this request.
Attached as Exhibit "C" is the architects plot plan shoring the location
of our proposed addition with relation to property lines and this requested
change in setback.
Enclosed is our check for twenty (20) dollars covering charges in connection
with processing this request. Please advise if we can be of any assistance.
