ORDINANCE 189501
An ordinance amending Ordinance No. 10080, entitled:
"An ordinance granting permission and authority
to the Village of North St. Paul to connect the
public sewer system of said Village of North St. Paul
to the public sewer system of the City of Sant' Paul
and thereafter maintain and operate the same as an
outlet for said public sewer system of said Village
f6r public sewage conveyance and disposal purposes, f
and providing applicable terms and conditions,
approved May_ 13,1953, as amended. This is an emergencyrordirance
rendered necessary for the preservation of the public peace, health
and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:

- Section 1. That Ordinance No. 10080, approved May 13, 14
as amended, be and the same is hereby further °amended by adding
to the first paragraph of Section 3 of said ordirence, after the.
legal descriptions of certain properties to which sewer con-
nections have heretofore been granted, the following:
"and except that said Village of North St.
Paul may permit the temooxihxz.Llnstallation, '
maintenance and operation of sewer service
connections between its said public sewer ,'•4;
system and the following describea'rreal
property lying beyond its corporate limits
and situated in the Village of Maplewood,
County of Ramsey, State of Minnesota, to -wit:
1. Subject to Frederick Street (formerly Van
Dyke Street), all_of the Northwest Quarter
of the Northwest Quarter of the Southeast
Quarter of Section 2, Township 29 North,
Range 22 West, lying north of Radatz Avenue,
except the west 495 feet and except the north
492- feet, _* according ,_to,_.government._surve I ereof: - -_-_
2. Subject to Frederick Street (formerly Van
Dyke Street) all of the east 3/4 of the
north 1/4 of the Southeast Quarter of-Se`ction

ment survey thereof.
4. The west 76 feet of the east 1766 feet of that part
of the North One Quarter of the Southeast {Quarter
of Section 2, Township 29 North, Range 22 West,
lying north of Radatz Avenue, except the north
492 feet, according to the government survey thereof, -�
upon the express condition, applicable to each such temporary
sewer connection, that the same shall be discontinued and
removed upon the construction by the Village of Maplewood of
a public sanitary sewer abutting the subject parcel of real
estate, and that thereupon the then owner of the subject parcel
of real estate shall cause the same to be connected by proper
sanitary sewer service connection with such public sanitary
sewer hereafter constructed, abutting the same, by said Village
of Maplewood, by and at the expense of said owner in each case.
Section 2. That the operative effect of this ordinance and
its amendment of said prior Ordinance No. 10080, shall be contin-
gent upon the acceptance of the same by said Village not later
than 60 days n6xt after the passage and approval of this ordinance,
such acceptance by said Village to be representedL -:: by its enact-
ment of an ordinance formally accepting this ordinance and agreeing
to abide by-all of the provisions, terms and conditions of the same,
and the filing of a certified copy of such Village ordinance with
the City Clerk and with the City Comptroller of,said City of Saint
Paul.
Section 3. This ordinance is hereby declared to be an
emergency ordinance rendered'necessary for the preservation of
the public peace, health and safety.
, Section 4. This ordinance shall take effect and be in force
upon its passage, approval and publication.

WHEREAS, The City of Saint PaulO Ramsey County, Minnesota, has hereto-
fore by Ordinance No,. 11350,, approved October 299 19580 amended Ordinance No,
100800 by further amending paragraph one of Section three thereof thereby grant-
ing permission to the Village of North St. Paul,, to furnish sewer facilities on
a temporary basis to the following described parcels of land, viz:
1. Subject to Frederick Street (formerly VanDyke Street), all of the
Northwest Quarter of the Northwest Quarter of the Southeast Quarter
of Section 29 Township 29 North, Range 22 West, lying North of RADATZ Avenue,
EXCEPT the WEST 495 feet and EXCEPT the NORTH 492 feet, according to government
survey thereof.
2. Subject to Frederick Street (formerly l►anDyke Street), all of the
EAST 3/4 of the NORTH 1/4 of the Southeast Quarter of Section 29
Township 29 North, Range 22 West,, lying NORTH of RADATZ Avenue, except the
NORTH 492 feet and EXCEPT the EAST 1842 feet, according to Government Survey
thereof.,
3. The WEST 76 feet of the Ee1ST 1842 feet of that part of the North One

hereby is authorized and directed to file a certified copy of this ordinance with
the City Clerk of the City of Saint Paul and with the City Comptroller of the
City of Saint Paul, upon the passage, approval and publication of this ordinance.
This Ordinance shall be in full force and effect from and after its
passage, . pproval and publication as required by law.
