WHEREAS, the Benida Company having applied.for a permit to
build one seven -.car and one nine -car parking lot in conjunction
with two eight -unit apartment buildings -located on a site described
as the west side of.Cleveland Avenue between Bayard and Sche €fer
Avenues, wholly within a,Commercial -Zone, the legal description
of said property being Lots-3 and,4'. Block-2, of-Kingrs Highland
Addition, and said Company having filed with its petition a map
which is hereto attached andmade a part hereof, and
SEAS, pursuant to the provisions.of,Section 60,23, par.4,
subsection 1, -of tAe Saint;- Paul-L;egis1ative Code,: the Traffic Engineer -and
the Planning Director hawe . made~{,a�.r-eport -to .this Council, dated
October .13, 1958, in which . said ,report it- - appears .that the Traffic
Engineer has approved the peti,tion of said Company,;-. -with the provi-

RESOLVED, that upon all the faets. -and aireumstances and the
finding of this Council that'"the petition for "tile_ parking lots of
said petitioner has answered the requirements of_the'Legislative Code,
said petition for the establishment of`the aforesaid parking lots is
hereby approved,, and the'Building Department of the City of Saint Paul
is hereby authorized to issue the permits..for the apartment house
construction and the parking lots to be'established in conjnction
therewith.

This is with reference to the petition of the Benida Company for a permit
to build one seven -car and one nine -car parking lot in conjunction with
two eight -unit apartment buildings.
The site is located on the west side of Cleveland Avenue, between Bayard
and Scheffer,Avenues,`and is wholly within a commercial zone. The legal
description of the property is Lots 3 and 4, Block 2 of King's Highland
Addition.
Section" 60.23, paragraph (4), subsection (1) of the Legislative Code pro-
vides that "Plans showing the layout and design of vehicular parking places
with a capacity of less than ten (10) motor venicles shall be approved by
the Traffic Engineer and the Planning'Director prior to the issuance of any
building or work permits necessary......." It is a further requirement
that such parking spaces be located on the same plot as the structure, or
not more than 300 feet therefrom..
The parking layout has.been approved by the Traffic Engineer with the pro -
vision,that some legal guarantee is made that one car space on Lot 3 is set
aside for the permanent use of Lot 4, and that an easement is granted through
the parking area of Lot 4 to guarantee access to the parking area of Lot 3.
Although both lots are presently under one ownership, the future sale of
either makes it mandatory that such•,restrictions be placed on this property.
The Board of Zoning and the Planning Director have adopted certain density
and building coverage standards for apartment projects. Based on these
standards, this project exceeds the maximum density by 100%, and the building
coverage by 13.51o.
For this reason, I find it impossible to give my approval to this project.
