W�3EREAS, Department of 3afety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated May 30, 2008; and WHEREAS, this order informed the then lrnown interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order inforxned the interested ar responsible parties that they must repair or demolish the structure located on the Subj ect Property by June 30, 2008; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolirion; and WIIEREAS, this nuisance condition has not been corrected and Departxnent of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, February 24, 2009 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the 0�-3�� 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 87 interested or responsible parties to make the Subject Property safe and not deh to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure in accordance with all applicable codes and ordinances, or in the altemative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within £fteen (15) days after the date of the Council Aearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, March 18, 2009 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 765 EDGERTON STREET. That the Subject Property comprises a nuisance conditiott as defined in Saint Paul Legislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). 3. That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate I�uisance Building(s) was sent to the then lrnown responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been corrected. � 8. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, VacanY/Nuisance Buildings. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. It is further ordered, that a copy of this resolution be mailed to the owners and intexested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. According to our files, it has been a vacant building since May 4, 2007. The current property owner is LaSalle Bank N.A. c!o Chase Home Finance, per AMANDA and Ramsey county property records. The city has had to board this building to secure it from trespass. There have been twelve (12) SUMMARY ABATEMENT NOTICES since 2007. Smoke Detector: Lack of properly installed and operable smoke detector. . As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by June 30, 2008 the Deparhnent of Safety and Inspections, Division of Code Enfoxcement, will begin a substantial abatement process to demolish and remove the building(s). Mr. Magner stated the building was a two- story, wood frame, multi-unit dwelling on a lot of 4,792 square feet and had been vacant since May 4, 2007. A C of O team inspection had been done on December 17, 2007, the vacant building registration fees were current, and the $5,000 performance bond had not been posted. On Apri121, 2008, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on May 30, 2008 with a compliance date of June 30, 2008. An extension was then granted to August 3, 2008. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $48,800 and the building to be $113,200. Real estate taxes were current. Code Enforcement estimates the cost to repair the building to be approximately $100,000 to $110,000. The cost for demolition was estimated to be approximately $17,793 to $22,793. There had also been 12 summary abatements issued to this property since 2007, 11 of which went to work order: to secure the building and the City had to board the building to secure it from trespass, remove improperly stored refuse, boarding, and cut tall grass and weeds. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked how many units were in the building. Mr. Magner responded that the C of O listed it as five units. Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner responded that the building was previously owned by Mahmood Hassan and James Thomas had been called to inspect the building on May 1, 2007 which resulted in the building being condemned. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1901 and was a late Victorian, brick veneer dwelling. She believed it was originally a single-family dwelling and had been owner occupied. She said that the property had been inventoried; however, she did not believe there was any potential historic district designation. The porch columns appeared to be original and the exterior appeared to be intact. She believed that the shed that was attached to the building may have originally been a root cellar; however, she was unswe. Historic St. Paul and the HPC had expressed interest in this property and she suggested the HPC review the property. Mr. Magner stated that tYie property was zoned RTl which would allow for a duplex. Ms. Moermond stated that she would recommend the building be de-converted from a 5-plex to a duplex. She recommended referring this matter to the HPC for a recommendation and laying over to the March 24 Legislative Hearing and April 15 Council Public Hearing. (Referred to the F3PC for a recommendation; laid over from Feb. 24 Legislative Hearing; CPH cont. to April 15) Timothy Kelley, Leonazd Street and Deinard, appeared on behalf of LaSalle Bank National Association, the owner, and Chase Automated Realty, the loan servicer. Mr. Ma�er stated that this property was laid over at Council to obtain input from the HPC. Since Mr. Kelley was not in attendance at the February 24, 2009 Legislative Hearing, Mr. Magner read his report into the record again. Ms. Spong stated that matter was presented to the HPC at their March 12, 2009 meeting. This building was constructed in 1901 as a late Victorian and was asynunetrical with shingles on the end gables. There aze three-sided bay windows on both the front and side elevations with triangulated brick work at the corners. There is an open entrance porch with a central pediment and turned columns. The original owner was John J. Anderson, a plasterer, who also constructed or owned other properties in District 5. The building/contractor was listed as G.A. Mattson. At the meeting, HPC staff cited the seven different criteria that the city had adopted for designation, made findings, as well as a recommendation. The HPC voted 7 in favor to delay demolition in order for alternatives to be explored such as mothballing or rehabilitation. They also recommended that a qualified historian be hired to evaluate both National Register and local eligibility. Ms. Spong stated that Cheryl Peterson, District 5 Planning Council, was in attendance at this meeting and testified that this was a prominent house in the neighborhood and she wished to see the building saved. Ms. Moerxnond asked Mr. Kelley what his clients' intentions were for this property. Mr. Kelley responded that he had talked to Cindy Carlson, HRA, regarding potentially donating this property, as well as other properties, to the HRA. He had received positive responses from Ms. Cazlson who indicated that if the ta�ces were current and the assessments had been paid, they would be willing to accept these properties as a donation. He said he was now awaiting the title wark to be completed on this property, as well as the other properties, before the HRA would make a purchase offer on this property. Mr. Magner stated that he believed the title work would come back as a"clean package;" however, he was unable to speak on what the HRA process was going to be on purchasing this property and what they planned to do once they had possession of the property. He said that the building was still considered a nuisance to the neighbarhood not outstanding the over-occupancy of the building due to zoning for this area. He said that another re-use would need to be considered so that they would not end up with another "Mahmood Hassan" situation. Mr. Moermond explained the history the City had with Mahmood Hassan and the 20+ properties he had owned. Mr. Kelley said that he spoken with Boris Tsvelovat that morning, who said he was a realtor, a contractor and also worked with investors. Mr. Tsvelovat indicated to him that he had purchased a property at 759 Edgerton and was interested in this property as well. He said he understood this was a category 3 vacant building and title could not be transferred under to City Code. Mr. Tsvelovat said that he had talked to a City staff person (didn't have a name) about his interest in purchasing and rehabbing 765 Edgerton and the staff person indicated to him that perhaps an application could be made to the City Council to change the status of the building from a category 3 Mazch 24, 2009 Legislative Hearing Q��� �Jl � Page 8 to a category 2 vacant building. Mr. Kelley stated that his client was also willing to explore this as an option; however, if the potential buyer did not have a good reputarion with the City, he did not wish to waste his clients' time exploring this as an option. He also asked whether it would be possible to change the status of the property from a category 3 to a category 2. Ms. Moermond responded that she had never experienced the change in category status particularly given the amount of time the owner had been given to remedy the nuisance when the order to abate was issued and their failure to maintain the properiy. Ms. Moermond asked Mr. Kelley whether his firm represented the bank during the foreclosure proceeding. Mr. Kelley responded that his firm had not. Mr. Magner stated that the options under Chapter 33.03( fl allows for transfer of title to the HRA, the owner can rehabilitate the property, the owner can raze the building themselves, or they could look for an outcome from the City Council. Mr. Kelley responded that it was his clients' intention to work with the HRA on transferring title of the property. Ms. Moermond expressed concem with the maintenance of the property and whether the Bank had a management company looking after the property so that the City was not having to issue orders and do the work. Mr. Kelley responded that he believed the Bank did have a maintenance firm that was monitoring and maintaining the property. Ms. Moermond stated that she would like to continue this matter in order for a survey to be conducted on the historical significance of this property. She asked Ms. Spong what the recommendation was from the HPC. Ms. Spong responded that staff suggested a reconnaissance survey be conducted to determine historic eligibility for evaluation purposes. Mr. Kelley asked whether the City would require the property owner to pay for an historical assessment. Ms. Moermond responded that under Chapter 45, the City has assessed the cost of a survey when demolition was proposed for any property of historical sigiificance. It was unclear what the cost of any such survey would be at this point in time. The survey process was also a justification for the IIRA to acquire the property as opposed to allowing it to languish for his client then to assume the cost of the removal of the building. Mr. Kelley stated that he did not believe his client should be responsible for the cost of any assessment for a survey especially if the transfer of title to the HRA was successful. Ms. Moermond responded that the fact that the property has historical significance does not belie the fact that the property is a nuisance. She believed a deeper analysis of the property needed to be done in order to qualify saving the building as opposed to demolition. She believed the cost associated with any historical survey work and the responsibility for the cost of the assessment could be a conversation with the chair of the IIRA. Mr. Magner explained that in the demolition of one property of historical significance, a preservation specialist was hired to document the property based on specifications identified in a resolution to remove the building. An historian was idenrified and Purchasing was consulted to write a contract which indicated the cost would not exceed $1,000. He was unsure as to the actual cost as he had not yet received the invoice for the work that was done. PROPOSED CHANGES: During the February 24 Legislative Heazing hearing officer recommended the HPC consider this property for review as a historic resource. A historic resource is defined as "A property that is believed to have historical, cultural, architectural, archaeological or engineering significance and to meet at least one of the criteria for designation as a heritage preservation site or district as provided in this chapter." C. GUIDELINE CITATIONS: Sec. 73.05. Designation of heritage preservation sites. (a) Criteria. In considering the designation of any area, place, building, structure or similar object in the City of Saint Paul as a heritage preservation site; the commission shall apply the following criteria with respect to such designation: (1) Its character, interest or value as part of the development, heritage or cultural characteristics of the City of Saint Paul, State of Minnesota, or the linited States. (2) Its location as a site of a significant historic event. (3) Its identification with a pexson or persons who significantly contributed to the culture and development of the City of Saint Paul. FINDINGS The property was surveyed and identified during the 1983 Historic Sites Survey of Ramsey County but was not included with the final report recommending further study.
